JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center

(NSWC) Crane Division, Code 0221.

2. Description of the Action Being Approved

Award a Firm-Fixed Price (FFP) contract on a brand name only basis for one (1) Mitutoyo American Corporation Model CRTAS9108

SM606 TP20, Coordinate Measuring Machine (CMM) to support material fabrication, inspection and acceptance in support of

AN/SQS-53C Hull Sonar Array Subsystems.

3. Description of Supplies/Services

The Polymer & Undersea Sensors Branch (GXPS) requires a highly accurate CMM operating with MCOSMOS-3 software to support in house fabrication, inspection, validation and acceptance of materials prior to Fleet delivery. The CMM provides a reliable/proven method to inspect and accept over 80 critical components used to fabricate TR-343 transducers and various communication cables supporting the AN/SQS-53C Hull Sonar Array

Subsystem. The AN/SQS-53C Hull Sonar Array Subsystem is a critical part of the AN/SQQ-89(V) ASW System for Spruance and

Arleigh Burke class Navy Destroyers and Ticonderoga class Navy

Cruisers. The TR 343 transducer and communication cables are the system's primary sonar sensor and must be reliable in order for the system to function properly. Inaccurate inspection of critical components used to fabricate the TR-343 transducer components at NSWC Crane could compromise the system's operation.

In order to support these requirements the Polymer & Undersea

Sensors Branch (GXPS) requires:

One (1) Mitutoyo Model CRYSTA-Apex S 9108 CMM at $78,540, One (1) PH10MQ/TP20 Probe System at $24,710, One (1) 606 Line Laser Probe System at $62,465, One (1) MCOSMOS-3 Version 4.1) Software Package With Dell T5810

DEPARTMENT OF THE NAVY

CRANE DIVISION

NAVAL SURFACE WARFARE CENTER

300 HIGHWAY 361

CRANE INDIANA 47522-5001

IN REPLY REFER TO:

Computer at $29,600, and

One (1) Goldcare Support Package at $16,784.

The sum of these items less the Model Bright-A504 CMM Trade-in &

Discounts of ($46,784) brings the total estimated value to

$165,315 with a required delivery of September 2017.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. A projection of the proposed contract utilization by funding type is as follows:

Estimated Dollar Value

FY17 WCF $165,315

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304 (c) (1). Only one responsible source and no other supply will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

This procurement will be issued as Brand Name only for the

Mitutoyo name brand Coordinated Measuring Machine (CMM), MCOSMOS

4.1 software package and system accessories. The Mitutoyo CMM, MCOSMOS software package, and Mitutoyo accessories are the only viable option to meet the Polymer & Undersea Sensors Branch

(GXPS) CMM requirements without a substantial duplication of cost to the Government estimated at $131,628 and unacceptable delays in fulfilling their agency's requirements estimated at

6.25 months as outlined below.

For more than a decade (2006-Present) the Polymer & Undersea

Sensors Branch (GXPS) has used a Mitutoyo Model Bright-A504 CMM and MCOSMOS V3.5 software to conduct high accuracy material/piece part dimensional inspections and acceptance measurements for over 80 critical components used to fabricate

TR-343 transducers and various communication cables supporting the AN/SQS-53C Hull Sonar Array Subsystem.

The Mitutoyo CRYSTA Apex S 9108 CMM and MCOSMOS software is required to interface with existing GXPS CMM programs that have been developed over the past decade using the proprietary

MCOSMOS software. The Bright-A504 CMM and MCOSMOS software have provided high accuracy measurements and acceptance parameters for 81 critical piece parts supporting AN/SQQ-89(V) ASW System components. Procurement and utilization of any alternate CMM system would need to provide 100% interoperability with the existing 81 component inspection programs developed with the

Mitutoyo MCOSMOS software. CMM systems that are not 100% compatible with the existing MCOSMOS (Mitutoyo proprietary) software would require 81 critical inspection programs to be converted into the new inspection program language, and validated with a 100% measurement/comparison of the two inspection results (existing program and new programs).

Mitutoyo conversion software (DMISPAK) supports conversion to

DMIS format. Similar conversion from DMIS format to the new inspection program language would be required.

The cost estimated to procure any alternative CMM and replace/convert existing MCOSMOS inspection programs is $131K with an estimated time delay of 6 months minimum above and beyond procurement of the Mitutoyo CRYSTA Apex S 9108 CMM and

MCOSMOS software. The cost and schedule estimates are based on the following:

6. Description of Efforts Made to Solicit Offers from as Many

Offerers as Practicable

Through market research conducted by the NSWC Crane Platform and

Launch Systems Division, Mitutoya and HAAS (as a distributor) were identified as sources that can meet the government’s requirement. In accordance with DFARS 206.302-1, a Request for

Information (RFI)/Sources Sought was issued on 15 March 2017 with a closing date of 24 March 2017. It stated the Government was accepting information from companies potentially capable of meeting the Model CRTAS9108 SM606 TP20 specifications.

Hexagon responded to the RFI on 3/15/2017 and questioned the restrictive nature of the procurement. Hexagon indicated the cost duplication and time delay may be overstated since

Mitutoyou sells conversion software available for procurement by the Government. The Government reviewed Hexagon’s white paper and price estimate for the conversion software and determined it could be procured. As a result, the cost duplication estimate was reduced from $241,000 to $131,628 and the time delay was reduced from 1 year to 6.25 months. An amendment to the RFI was posted on 12 April 2017 notifying the public of the changes to the estimate. A second amendment to the RFI was posted 11 May

2017 notifying the public of changes made to the salient characteristics. No responses were received on the first amendment, and no responses have been received to date on the second amendment.

A brand name only solicitation will be issued to procure one (1)

Mitutoyo American Corporation Model CRTAS9108 SM606 TP20, Coordinate Measuring Machine. FAR 13.5 procedures will be used and a synopsis will be posted simultaneously with the solicitation. Any offeror capable of providing the required unit will be invited to propose.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated cost to the Government for the supplies covered by this J&A will be fair and reasonable. It is anticipated that price history, published pricing and commercial sales history will be utilized to make this determination.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5 and the lack of additional requirements, NSWC Crane has no plans at this time to re-procure these supplies.
