LIMITED SOURCE JUSTIFICATION
1. Identification of the agency and the contracting activity.
[FAR 8.405-6(c)(2)(i)]
Department of the Navy Naval Sea Systems Command
Crane Division, Naval Surface Warfare Center Crane, Indiana
2. Nature and/or description of the action being approved.
[FAR 8.405-6(c)(2)(ii)]
The acquisition is being conducted under the authority of the Multiple Award Schedule Program, FAR 8.401. Approval of this Justification will authorize a limited source procurement of supplies and/or services under GSA MAS 66 SIN 627-30 with an MOL of $300,000.00. The government intends to award a firm fixed price delivery order to brand name Keysight Technologies, Inc. or their authorized GSA distributors.
This justification will authorize a Sole Source procurement to procure Brand Name Keysight Technologies, Inc. and/or authorized distributors, 12 each, PN: E4990A-010, Impedance Analyzers in the base contract award. Option #1 will be for an estimated quantity of one through two each with an ordering period effective from date of award through 12 months. Option #2 will be for an estimated quantity of one through two each with an ordering period effective from date of award through 24 months.
The resulting award will be a firm fixed price supply delivery order for 12-16 E4990A-010 Impedance Analyzers for an ordering period effective from the date of award through 24 months.
3. A complete description of the supplies and/or services required to meet the agency’s needs, including the estimated value.
A total of 12 to 16 impedance analyzers, PN: E4990A-010, will be procured over a three year performance period. The total value, depending on the quantity procured through the use of the additional options, of this procurement is estimated between
(~ per GSA impedance analyzer).
The government will accept accelerated delivery of the asset(s).
Actual delivery schedule is to be negotiated between NSWC Contracting Personnel and the Vendor. The required delivery date
LSJ NUMBER: <insert log number> for base contract supplies is . The required delivery schedule for option supplies is 8-12 weeks after option award.
4. Identification of the authority that permits limitation of sources.
[FAR 8.405-6(c)(2)(iv)]
FAR 8.405-6(b)(1). The particular brand name product or brand name feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
[This must be the same authority (circumstance) that is cited in the closing approval statement of the justification for limiting sources.]
5. Identify the supporting rationale for the assigned authority and, if applicable, include a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
[FAR 8.405-6(c)(2)(iv)]
The Analyzers are in support of Factory acceptance test during repair, production, and surveillance for the and processes. Any test equipment used in the test station has to go through rigorous qualification testing to ensure reliable performance. Once repeatable FAT testing is accomplished and performance is verified, the test station and all supporting test equipment are considered qualified for FAT for equipment and no changes are allowed without program approval. This control is needed to ensure accurate FAT results for the critical navigation items tested at Crane used on the . The impedance analyzers are also part of surveillance functions / equipment sets where end item components and returned condition are monitored against historical performance. Additional duplication in cost and delay would result in determining compatibility against historical record if a different vendor’s product was chosen. In order to replace and qualify a new vendor’s equipment, extensive tests will need to be carried out in parallel using existing impedance analyzers and new vendor equipment on the same multiple End Items
. New test programs and procedures would need to be created, approved, and certified.
The Engineering Change Request to implement this would also require input from multiple external sources including the program office and engineering prime. It is estimated qualifying a new equipment line will take at least an additional and take approximately additional time to complete which will impact stocks and fleet readiness. While there is no guarantee that a new vendor will be approved, an approximate cost ROM is as follows:
Schedule Impact First article procurement Initial Calibration Initial Test Equipment Programming Comparative testing Initial Approval ECR processing / Follow Procurement (In parallel) Test Equipment Programming and Procedure Updates
Cost Initial Programming Costs Comparative Testing Engineering Analysis of Testing Approval / ECR processing Test Equipment Programming and Procedure Updates
The previous order was N00164-14-A-0014-0018.
6. A determination that the order represents the best value.
The Contracting Officer has determined that the anticipated cost for the supplies/services covered by the Justification will be determined fair and reasonable, and will represent the best value to the Government.
7. Describe the market research.
[FAR 8.405-6(c)(2)(vi)]
[Provide a description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.]
The impedance analyzer and test fixtures are commercially available components. As such the costs are commercially listed and available through multiple distributors. Cost estimates for these components are available on GSA and have been solicited through vendors identified for NSWC Crane Test Equipment BPA , 001 to 0015.
8. Any other facts supporting the justification to limit sources.
[FAR 8.405-6(c)(2)(vii)]
[When FAR 8.405-6(a)(1)(i)(A) is cited, provide data, estimated cost, or other rationale as to the extent and nature of the harm to the government following schedule procedures would cause.]
To repeat this effort and utilize a new/alternate impedance analyzer would incur the government a cost detriment of over and over to qualify.
[When FAR 8.405-6(a)(1)(i)(C) is cited for logical follow on, include an estimate of the duplicative cost and methodology used to formulate the estimated cost.]
9. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
[FAR 8.405-6(c)(2)(viii)]
[Describe actions taken, or that will be taken, to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required, including challenges to restrictive data markings, data rights, preparation of a performance based work statement, etc. If planning a competition, include the estimated date when the competitive procurement will occur.] Due to the circumstances outlined in section four, the Government determines it is impossible to remove barriers to the name brand competition restriction.
