LSJ NUMBER: <SWXS167703>
4. Identification of the authority that permits limitation of sources.
[FAR 8.405-6(c)(2)(iv)]
The authority for this justification to limit sources is

Teamcenter is a Configuration Management (CM) system encompassing Data Management, Version Control, and Process Work Flows and is an essential part of the Configuration Management Plan for Code .

NX is a CAD tool for 3D Modeling and Design. Many mechanical design projects in depend on NX CAD software to model and test the designs before being put into production.
As mentioned, the software specified above is used to create computer models and simulations. The models and simulations are essential to the development and maintenance of in support of the through office, , and other as required. This equipment is used to support requirements for on the Additionally, a transition to another CAD/PLM suite would put work on support, support, support and support, and
Use of any other OEM’s software solution would not be interoperable with the current system. Models generated through one computer aided drafting (CAD) software package are not compatible with other CAD packages developed by other OEMs. Metadata developed using one product lifecycle management (PLM) tool is not compatible with tools made by other OEMs.
If another OEM’s solution were implemented, it would not be possible to use models already created. The models would have to be converted to a neutral format, resulting in data loss, or rebuilt using the new software, which creates a risk for input errors. There are thousands of CAD models developed using NX and related software over the last decade or more. To transition to a CAD/PLM suite offered by a different OEM, a transition plan would need to be developed prioritizing data to be recreated, , and it would
Siemens PLM is the Original Software Publisher of both Teamcenter and NX and owns exclusive license rights to the software. Siemens PLM and their channel partners are the only providers of the licenses on GSA FSS 70, SIN 132-33; no other CAD/CM software meets the Government’s need.
6. A determination that the order represents the best value.
The Contracting Officer has determined that the anticipated cost for the software licenses covered by the Justification will be determined fair and reasonable, based on FAR 8.404(d) and DOD DARS Deviation #2014-00011 utilizing FAR 15.404-1. The contracting officer will conduct a price analysis comparing industry pricing for the same or similar software licenses to determine the price fair and reasonable.
7. Describe the market research. [FAR
8.405-6(c)(2)(vi)] This request is for software maintenance of currently utilized software products. The maintenance can only be purchased through authorized value added resellers with a GSA contract specifically for representing Siemens PLM. Searching the GSA eLibrary for Siemens PLM revealed one schedule contractor for this original software publisher: Spatial Integrated Systems, Inc. Additionally, a quick search of the part numbers on GSA Advantage confirmed Spatial Integrated Systems, Inc. as Siemens PLM’s GSA authorized value added reseller.
IAW DFARS 208.7400, market research was conducted reaching out to DoD ESI and the DoN Enterprise Software Licensing Program Office.
The ESI Web Team confirmed that Siemens PLM software maintenance as a product is not available on DoD ESI or Army Chess. Additionally, the DoN Enterprise Software Licensing Program Office website was checked, finding that no Enterprise Software License Agreement is currently in place for Siemens PLM products.
The acquisition team also considered the NASA SEWP V GWACs for this procurement. Research was conducted via the NASA SEWP V Provider Lookup Tool. A search using “Siemens PLM” as the keyword resulted in no matches. Another search using keyword “Siemens” found the provider Siemens AG with 29 contract holders. Reaching out to a contract holder found that they were unable to receive a quote for Siemens PLM maintenance products because these products can only be offered from a specific division of Siemens. Contacting a Siemens PLM rep directly about utilizing the NASA SEWP GWAC found that Siemens PLM does not currently have value added resellers on SEWP.
8. Any other facts supporting the justification to limit sources. [FAR
8.405-6(c)(2)(vii)] has been using NX software for over and have a significant investment in software and training for its user base.
Many projects, current and previously fielded, depend on NX to support these designs. has a similar investment in Teamcenter software, and it is an essential component of the Configuration Management Plan for Code .
Software maintenance and support is required for both NX and Teamcenter in order to keep them functioning correctly in our ever-changing computing environment. Without software maintenance, CM and engineering support for current projects and fielded systems would be at risk. Software updates are required to maintain cybersecurity readiness; failure to update creates a high risk of work stoppage due to IA non-compliance.
The only providers of software maintenance for NX and Teamcenter are Siemens PLM and their channel partners. As mentioned in Section seven above, Spatial Integrated Systems, Inc. has been determined to be Siemens PLM’s GSA authorized value added reseller.
9. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
[FAR 8.405-6(c)(2)(viii)]
For reasons set forth in Sections five and eight, NSWC Crane has no plans to compete further contracts for the software maintenance as a product listed in this Limited Sources Justification. In addition, the circumstances surrounding the need to obtain additional software maintenance as a product, if required, without providing for Fair Opportunity will be reviewed annually by the Procuring Contracting Officer (PCO). Lastly, this Limited Sources Justification will be posted to the Federal Business Opportunities websites as required for actions being solicited as Brand Name Only.
