CLASS JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN

FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

Naval Sea Systems Command (Naval Surface Warfare Center), Crane Division (Code CXNN)

2. Description of the Action Being Approved

Award of a basic ordering agreement on an other than full and open competition basis to DRS ICAS, LLC (2601 Mission Point Blvd, Suite 205, Beavercreek, OH) to allow for the procurement of engineering services to support the R-2674(C)/A Joint Tactical Terminal – Receiver (JTT-R). DRS ICAS is a business line and service group of DRS Technologies, Inc.

3. Description of Supplies/Services

The required engineering services covered under this Class Justification and Approval (CJ&A) are associated with procurement actions for the JTT-R and its variant/derivative systems. The engineering services may consist of engineering investigations/analyses, technical support, trade & feasibility studies, planning support, logistics analyses, training, maintenance planning, software support, and repair services. Delivery requirements will be identified in each individual Job Order.

The JTT-R is an ultra-high frequency (UHF) receiver used as a tactical terminal onboard aircraft that provides near real-time over the horizon threat data for situational awareness and assessment, threat avoidance, targeting, mission planning, and communications. The JTT-R uses the Receive Crypto Module for embedded decryption, message processing, and tactical data processing and can simultaneously receive and process intelligence reports for the Integrated Broadcast Service - Simplex (IBS-S), the Integrated Broadcast Service - Interactive (IBS-I), and the Common Interactive Broadcast (CIB). The IBS is an information-superiority-enabled service that networks sensors, decision makers, and shooters to achieve shared awareness, increased speed of command, more efficient operations, greater lethality, increased survivability, and a higher degree of precision intelligence. IBS is the worldwide DoD standard network for transmitting tactical and strategic intelligence and targeting data to all echelons of Joint Service operational users.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The estimated requirements and appropriations for fiscal years FY14 -

FY18 are identified below. Authority to act under this class justification expires 15 May 2019, or five years from the effective date of BOA award, whichever is later.

The estimated requirements for fiscal years FY14 - FY18 are identified as follows:

Estimated Dollar Value (in $Ms)

Type of Funds: FY14 FY15 FY16 FY17 FY18 Total Aircraft Procurement, Navy $0.330 $0.340 $0.350 $0.361 $0.372 $1.753

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), Only one responsible source.

5. Rationale Justifying Use of Cited Statutory Authority

The JTT-R is the designated replacement tactical-receiver for the OZ-72(V)7(C)/A Multi-mission Advanced Tactical Terminal (MATT) currently deployed in the EA-18G Growler Electronic Warfare Airborne Attack aircraft to receive the IBS network.

The Department of Defense (DoD) is in the process of expediting a Technical Transition Plan (TTP) whereby existing IBS tactical terminals, including the MATT, are being consolidated and replaced with a common family of terminals called the Joint Tactical Terminal Family of Systems (JTT FOS). In addition, the TPP also involves a comprehensive refresh effort of the IBS network with a re-architecture of its broadcast format structure and a mandated crypto modernization. The JTT FOS are critical components of the new broadcast architecture and crypto modernization as these systems are the only IBS receiver/transceiver devices in the DoD being modernized to support the re-architecture and crypto modernization efforts.

DRS ICAS is the sole designer and original equipment manufacturer of the Joint Tactical Terminal-Integrated Broadcast Service (JTT-IBS) system. The Government is not in possession of a Technical Data Package (TDP) suitable for a full and open competition of this requirement, and DRS ICAS has not indicated a willingness to sell or license its proprietary TDP. At this time, there are no funds to support procurement of a Level III drawing package, any reverse engineering effort, or a licensing agreement even if DRS ICAS was willing. Based on the history of developmental costs, the estimated cost to pursue any of these avenues would be significant and unlikely to be recouped by a later competitive effort. Over a seven year development effort under contract W15P7T-05-D-S015, DRS ICAS has also developed a unique, in-depth corporate knowledge of the JTT-IBS manufacturing process and design complexities, integrated logistic support, and operational requirements.

In 2005 DRS Technologies was competitively awarded a $194 million contract (W15P7T-05-D- S015) for the design, development, and fielding the JTT FOS to the DoD under the U.S. Army's JTT-IBS program to expedite execution of the IBS Technical Transition Plan (TTP). Under this contract, the Army spent $38.2M for non-recurring engineering services and $94.2M to build

285 systems. The JTT FOS currently consists of the JTT-Senior, JTT-Briefcase, JTT-IBS and CIBS-M IBS broadcast receiver/transceiver devices. The JTT/CIBS-M family of systems is a critical component of the TTP as these systems are the only IBS receiver/transceiver devices in the DoD being modernized to support both the new consolidated broadcast architecture and crypto modernization mandate. Use of the JTT FOS upgrades is imperative/essential to execute the over-the-air broadcast portion of the TTP in the near term to avoid a complete cessation of IBS data flow via the existing over-the-air IBS broadcast networks.

In 2009, NAVAIR PEO(T)/PMA-265 began an effort to find a replacement for the MATT on the EA-18G Growler being phased out of DoD inventory. The RT-1934(C)/URC-145(V)1, JTT-IBX was chosen after comprehensive market research and technical evaluation of all the terminals being developed as part of the JTT FOS. From 2010 through 2011, PMA-265 performed a series of proof of concept tests (successfully) on the JTT-IBX to determine whether the JTT-IBX could withstand the environmental stress conditions (temperature, altitude, shock, vibration, electromagnetic interference) for potential modification and incorporation into carrier-based, tactical aircraft. In July 2012, contract N68936-09-0002 T.O. 0019 was awarded to Boeing with DRS ICAS as a subcontractor to development a unique modification of the JTT-IBX for use on the EA-18G Growler. The modified JTT-IBX was designated the JTT-R.

Under contract N68936-09-0002 T.O. 0019, the Navy spent $16M to fully integrate the JTT-R into the EA-18G. These costs included $5.3M for Boeing to perform software integration of the JTT-R into the H10 software build of the EA-18G Operational Flight Program, and $10.7M for DRS ICAS to perform software integration, design changes, qualification testing, construction of seven new JTT-R systems, and modification of eight existing JTT-IBX systems to the JTT-R configuration. Under contract N00019-05-G-0026, Boeing was awarded a $7.5M effort to design and test the physical connections to the aircraft including wiring, trays, and cooling interfaces, retrofit numerous aircraft, update publications and manuals, and provide Integrated Logistics Support. In addition, NAVAIR has spent $5.5M to conduct government EA-18G System Integration lab testing and, Development Testing, and Operational Testing.

In total, the DoD has spent $29M to develop, fully integrate, and test the JTT-R into the EA-18G aircraft. No other IBS radio meets the requirements of the EA-18G. Although additional IBS receivers have been developed since the beginning of the TTP effort, to integrate the necessary EA-18G unique requirements into these radios would require design and developmental efforts, environmental re-qualification testing, platform hardware and software integration, documentation updates, and Development /Operational Testing. It is estimated that these costs would approximate the $29M spent developing and qualifying the JTT-R for use, and take more than three (3) years to complete. These duplicative costs are very unlikely to be recouped through any resulting competitive procurement. Furthermore, a three year slip in the TTP schedule is unacceptable and result in the loss of IBS-CIB receive capability in the aircraft\ causing substantial harm to the aircrafts’ mission effectiveness and capabilities. The result would be missed electronic attack jamming assignments and potential loss of aircraft and aircrew from an adversary surface to air missile.

Based on the facts above, DRS ICAS is the only source capable of fulfilling this requirement.

Any other source would require significant and unacceptable additional costs and schedule delays which would severely and detrimentally impact support of current EA-18G system and mission requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed contract action was synopsized on the Federal Business Opportunities (FEDBIZOPS) website on 31 December 2013. Only DRS ICAS has expressed an interest in this requirement.

Open source internet searches were conducted for information on alternative systems..

Furthermore, the Airborne Electronic Attack Systems Division performed market research based upon their own knowledge of the industry and found no manufacturer providing same or similar compatible systems, and no similar commercial or modified commercial supplies that will meet the Government’s requirements.

Individual or classes of orders to be issued under this BOA will be published on the FEDBIZOPS website. Any responses received from other vendors will be considered.

7. Determination of Fair and Reasonable Cost

The Procuring Contracting Officer (PCO) has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Section 5, Naval Surface Warfare Center, Crane Division has no plans at this time to compete future contracts for the types of supplies covered by this document.

If other potential sources emerge, Naval Surface Warfare Center, Crane Division will assess whether competition for future requirements is feasible. The circumstances surrounding the need to obtain the required services without providing full and open competition will be reviewed periodically by the PCO.
