About this file

This is a Justification for Other Than Full & Open Competition (J&A) document issued by the Department of the Navy, NAVSUP WSS in Mechanicsburg, Pennsylvania.

The Navy seeks to acquire a Compressor Unit, Reciprocating (nomenclature) with NSN 4310-01-547-9404 and part number C-STAR-200D through non-competitive procurement from RIX INDUSTRIES (CAGE Code 28953). The acquisition is classified as repair/overhaul services with an expected final delivery date of April 30, 2025. The contracting activity is NAVSUP WSS - Mechanicsburg (Folder 240580061, PD N0010424U1349). The justification is based on 10 USC 3204(A)(1) and FAR 6.302-1, citing that only one or limited responsible sources can satisfy agency requirements. RIX INDUSTRIES is identified as the sole approved repair source and historical supplier, as no other company possesses the requisite qualifications, data rights, and design control to manufacture or repair this specialized compressor unit. Market research was conducted through searches of government databases (ITIMP, FLIS, and ERP) using part number, NSN, nomenclature, cage code, and other criteria, confirming RIX INDUSTRIES as the only known source. A 15 MAR 2019 Class Waiver applies to this requirement, exempting the need for a Request for Information or Sources Sought notice. The proposed action was synopsized on the government-wide point of entry on February 4, 2025. The contracting officer determined the anticipated cost to be fair and reasonable. Future requirements will be advertised on the government-wide point of entry if alternative sources emerge or competition becomes feasible. Approvals were completed by relevant personnel including the Contracting Officer (Sarah Ream), Competition Advocate (Adam Johnson), and Legal Counsel (Thomas Workman) by April 2, 2025.

The proposed contract action was synopsized on the government-wide point of entry on 02/04/2025 and as a result

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

A technical review, which consisted of searching Government databases including ITIMP, FLIS and ERP, has been completed on this item. Search criteria included Part Number, Design Control Activity, Cage Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved source of supply, historical sources of supply and past contracts. Based on this market research the contracting officer has determined that the only known repair source is RIX INDUSTRIES (28953). If a company other than the one listed believes they have a compatible product or repair process, they can submit the item to the Engineering Program Office, to include research and development, drawings and test specifications. The program office may test and evaluate, when applicable, the item at the company’s expense. Upon qualification, the approved company will be able to participate in current or future solicitations. ITIMP- Reviewed award history and other potential sources of repair, AMC/AMSC code, part number, reflect RIX INDUSTRIES (28953) as the only source of repair in the past. ERP - Search criteria included part number, design control activity, Cage code, NSN, Nomenclature, AMC/AMSC, AAC, and Criticality Coding which all matched with

ITIMP.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
