B. This part must be acquired from/repaired by a source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing/repair knowledge are not available to permit acquisition from/repair by other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources exist, A/RMCs 1 or 2 are valid.
Multiple Method Codes
This acquisition will be negotiated with
Martin-Baker Aircraft, LTD (U1604)
Only the above will be solicited because the articles to be acquired are highly specialized parts, designed and manufactured by a non-Government activity and the technical data required for the above acquisition by other than the above is not available. Martin-Baker is the only manufacturer and the central design authority for these parts. Martin-Baker developed these USRMs at their own expense. As the central design authority, Martin-Baker designed the USRMs and maintains logistic responsibility (i.e, engineering changes and revisions and their effect on the equipment), and subcontracts the actual manufacture of the Rocket Motor metal parts under their proprietary technical data. The Government did not acquire the rights in data during the initial stages for the production program, and as such, Martin-Baker is the only known source to possess rights to the technical. Martin-Baker has stated they are not prepared to sell their proprietary rights and data to the Government for the Underseat Rocket Motors.
