List / Description of items:
NAVSUP Weapons System Support's logistic support program is predicated upon an established turn-around time (TAT). This TAT cycle begins with the time of removal of the time from the ship or Naval Supply Center and includes the overall time required for shipment, repair, and re-delivery into Navy inventory. To the extent that this TAT cycle cannot be maintained, a proportionately greater investment in spares would be required.
The Master Repairables Item List (MRIL) designates the shipping point of retrograde material, either direct to a Designated Overhaul Point (DOP) or collected at a stock point. The MRIL is updated monthly to preclude time loss (for those items having repair requirements) and increased transportation costs.
Demand changes, acute urgent requirements, and carcass availability make shipment of repairables an unknown. Therefore, it is essential that the justification and approval and contractual arrangements for repair be made in advance of the actual need for such repair efforts.
The class of contracts proposed (orders under Basic Ordering Agreement, or BOA) will:
a. Be for commercial repair, modification, and servicing as appropriate for items listed on the attached. Major Weapons Systems supported:
AEGIS Weapons System, MK99 Fire Control System.
b. Apply to those components or equipment, which are listed on the attached, or those items which are later government-approved configurations thereof. All such later configurations athat are authorized to be serviced under the BOA will be specifically identified in an exhibit to said agreement.
c. Generally provide for the teardown, inspection, repair, modification, test, and service necessary to restore the item to serviceable operating condition. The extent of servicing necessary cannot be determined until the equipments are received by the contractor, disassembled, and an inspection made. The work to be performed under the BOA will relate only to previously produced components or equipment; it will not include any research and development effort; nor will it include the furnishing of any parts, components, asubassemblies, or materials not an integral part of the work described herein.
d. Include the acquisition/repair of sole source Government Furnished Material (GFM, e.g. piece parts) and/or the acquisition/repair/ maintenance of sole source Government Furnished Equipment (GFE, e.g. test equipment) when determined necessary to complete repairs or meet established RTAT cycle.
e. Include Commercial Asset Visibility reporting for repair efforts performance under the subject agreement.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL & OPEN COMPETITION: This J&A is based upon the authority of 10 USC 2304(c) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1
5. RATIONALE JUSTIFYING USE OF CITED AUTHORITY:
The current Acquisition/Repair Method/Suffix Code(s) is (are)
0. The part was not assigned AMC/RMC 1 through 5 when it entered the inventory, nor has it ever completed screening.
1. Suitable for competitive acquisition for the second or subsequent time.
2. Suitable for competitive acquisition for the first time.
3. Acquire, for the second or subsequent time, directly from the actual manufacturer
4. Acquire, for the first time, directly from the actual manufacturer.
5. Acquire directly from a sole source contractor which is not the actual manufacturer
D
D. The data needed to acquire/repair this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. A/ RMCS 3, 4, or 5 are valid.
Multiple Method Codes
N. Manufacture/Repair of this part requires special test and/or inspection facilities to determine and maintain ultra-precision quality for its function or system integrity. Substantiation and inspection of the precision or quality cannot be accomplished without such specialized test or inspection facilities. If the test cannot be made available for the competitive manufacture/repair of the part, the required test or inspection knowledge cannot be documented for reliable replication, or the required physical test or inspection facilities and processes cannot be economically documented in a TDP, valid A/RMCs are 3, 4, or 5. If the facilities or tests can be made available to two or more competitive sources, A/RMCs 1 or 2 are valid.
R. The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.
This acquisition will be negotiated with
GENERAL DYNAMICS-OTS INC. (05606)
Repairs will be conducted at another facility, (26978) GENERAL DYNAMICS ARMAMENT SYSTEMS. The selection of this concern as the only approved source for the repair and/or service of the components and equipment listed on the attached is based on the following information:
The contractor was established as the DOP to repair the items listed on the attached to an "as new" (while not necessarily maintaining the appearance of newness) condition. To ensure "as new" condition, fully adequate drawings and quality assurance procedures are necessary. Only the contractor listed above possesses this necessary data.
The GFM (piece parts) and/or GFE (test equipment) described in the paragraph above will only be acquired/repaired/maintained when the government does not have in its possession sufficient, accurate, or ligible data to purchase these piece parts and/or test equipment from other than the current source.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE: A Request for Information / Sources Sought Notice was entered on the FedBizOpps website for government-wide point of entry on
The Sources Sought Notification was posted on October 26, 2017.
and as a result
The Sources Sought Notification invited potential sources to express their interest in providing an offer on this effort to be forwarded to the design and technical authority to be evaluated. No other responses were received during this time frame for repairs of the listed NIINs.
The proposed contract action was synopsized on the FedBizOpps website for government-wide point of entry on
The Synopsis Notification was posted on December 13, 2017.
and as a result
The Synopsis notified and invited potential sources to express their interest in providing an offer on this effort to be forwarded to the design and technical authority to be evaluated. No other responses were received during this time frame for repairs of the listed NIINs.
Market Research was conducted in accordance with FAR Part 10. The results of the Market Research conducted (or the reason(s) Market Research was not conducted) are as follows:
In accordance with FAR Part 10 - Market Research, a Sources Sought Notification was posted to FEDBIZOPS/NECO between October 26, 2017 and October 31, 2017 seeking additional sources for this requirement. The posting yielded no responses from industry. A technical review, which consisted of searching several Government databases including ITIMP, FLIS and ERP, has been completed on this item.
Search criteria included Part Number, Design Control Activity, Cage Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved sourced of supply, historical sources of supply and past contracts. Based on this market research the contracting officer has determined that the only known manufacturing source is (05606) GENERAL DYNAMICS OTS. If a company other than the ones listed believes they have a compatible product, they can submit the item to the Engineering Program Office, to include research and development, drawings and test specifications. The program office will test and evaluate the item at the company’s expense. Upon qualification, the approved company will be able to participate in future solicitations.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The contracting officer determines that the anticipated cost to the Government of the repairs covered by this J&A will be fair and reasonable.
8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION:
For reasons discussed in paragraphs (4) and (5) NAVSUP WSS is currently unable to compete future requirements. However, future requirements will continue to be advertised in the FEDBIZOPS and NECO websites in order to encourage potential suppliers to submit offers for review. NAVSUP WSS will continue to encourage contractors to submit offers by submitting a source approval request (SAR) to be reviewed and evaluated by the technical authority to determine if the offered product could meet this requirement.
