Sy>lems C<m/er

ATLANTIC

IN ACCORDANCE WITH THE FOLLOWING JUSTIFICATION, AS Contracting Officer, SPAWARSYSCEN Atlantic, , I HEREBY

APPROVE THE EXCEPTION TO FAIR OPPORTUNITY (FOE) PURSUANT TO FAR 16.505(b)(2)(i) (C) Logical Follow-On

CONTRACT NUMBER(S) I CRM RESERVATION# I TASK ORDER (TO) NUMBER(S) I ESTIMATED DOLLAR VALUE N00039-l l-D-0032 Pending N6523618F0820 $102,712.28

1. AGENCY AND CONTRACTING ACTIVITY. Department of the Navy, Space and Naval Warfare Systems Center (SPAWARSYSCEN) Atlantic.

2. NATURE/DESCRIPTION OF ACTION(S).

This is a fair opportunity exception to issue a modification to an existing order under a multiple award contract.

3. DESCRIPTION OF SUPPLIES/SERVICES.

This project will require SSC-LANT/contractor engineering services for design and production for the physical layer network infrastructure to provide ONE-Net NIPR & SIPR Services for ; all at Naval Station Rota, Spain. Upon completion of this effort, office space in Bldg will have 6-each NIPR and 6-each SIPR ONE-Net drops operational, office space in Bldg will have 12 Dual NIPR ONE-Net drops operational, and office space in Bldg will have 10 Dual SIPR ONE-Net drops operational.

4. IDENTIFICATION OF EXCEPTION TO FAIR OPPORTUNITY.

D (a) The agency's need for supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

D (b) Only one awardee is capable of providing the supplies or services at the level of quality required because the supplies or services ordered are unique or highly specialized.

[{] (c) The order must be issued on a sole-source basis in the interest of economy and efficiency, because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

D (d) lt is necessary to place an order to satisfy a minimum guarantee.

JUSTIFICATION:

The subject FOE is for physical layer network infrastructure installation at three locations on Naval Station (NS) Rota) Spain.

Task Order N6523618F0820 was awarded to Serco in July 2018 after full and open competition among all Global installation Contract (GIC) Multiple Award Contract (MAC) holders. Task Order N6523618F0820 was awarded to procure survey and design for similar ONE-Net physical layer hardware installations at multiple sites, including NS Rota. 'fhc program identified the subject installations as an emergent requirement after the competition for Task Order N6523618F0820 was completed. The subject installations are urgently required to ensure continuity of operations for ONE-Net at NS Rota in these buildings which have recently completed MILCON upgrades.

If this FOE is not granted, delays of installation will impact ONE-Net functionality for tenant organizations in Buildings , and . The organizations that would be impacted include Naval Sea Systems Command (NA VSEA), Navy Region Europe Africa

Southwest Asia (EURAFSWA), and Center for Surface Combat Systems (CSCS). As Serco already has qualified engineers and technicians performing s.imilar ONE-Net hardvvare installations and working on this site, this effort is being added in the interest of economy and efficiency.

5. DETERMINATION OF FAIR AND REASONABLE COST.

The proposals will be analyzed in accordance with FAR 15.404. It is anticipated that the government will use various cost/price analysis techniques, including but not limited to: (1) comparison of proposed prices to historical prices paid; (2) comparison of proposed prices with independent government cost estimate amounts; and (3) comparison of proposed prices obtained through market research for the same or similar items, such that the anticipated cost to the government will be fair and reasonable.

6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION.

None.
