MILITARY SEALIFT COMMAND
471 EAST C STREET
NORFOLK, VIGINIA 23511-2419
J&A No. N102-14-D-8015
JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity:
Department of the Navy, Military Sealift Command (MSC).
2. Description of the Action Being Approved:
This contract action is for the modification of Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract N00033-14-D-8015 with Chandler Campbelle & Daschle to increase the maximum dollar amounts for the current, which is also the final, option period. This J&A is to address the contractual ceiling limit and to raise that ceiling in order to ensure adequate capacity to meet mission needs. The contract modification will increase the total contract value by $487,852.80 from $1,660,930.22 to $2,148,783.02. Since this contract is an IDIQ, funding will be issued on the task order level. IAW the contract terms, the current ceiling is $1,365,666.74 with remaining contract capacity of $102,881.60. Below is a breakdown of the proposed increase to the CLINS covered by this J&A:

3. Description of the Supplies/Services:
The contract provides Qualified Instructors (QI) to teach MSC Unites States Coast Guard (USCG) approved training and job skill training to support the Joint High Speed Vessel (JHSV) program.
The QIs instruct the following types of classes: High Speed Craft Type Rating Training for Joint High Speed Vessel (JHSV) For Licensed Officers, High Speed Craft Bridge Resource Management Familiarization Courses, High Speed Craft Safety courses for unlicensed personnel, and additional instruction on ship handling and bridge team work as requested. The Contractor provides the organization and administrative controls necessary to ensure that the services performed meet all requirements specified in the Contract. The Contractor assists MSC in maintaining, formatting and providing hands-on training of a comprehensive type rating training and certification program for the JHSV program. The Contractor provides all personnel, supplies, transportation, supervision, and non-personal services necessary to perform as the JHSV QI(s). The Contractor provides instruction and training in classroom, on a vessel in port, on a vessel underway, and in shops and with various simulators, and assists MSC in maintaining complete programs that encompass the total learning experience with the JHSV. The QI(s) transition roles and evaluate personnel who have completed training in accordance with the assessment criteria outlined in NMC Policy Letter 06-01.
This contract has been deemed a small business 8(a) set aside contract.
4. Statutory Authority Permitting Other Than Full and Open Competition:
10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(iii), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority:
In accordance with FAR 6.302-5(a)(2)(i), full and open competition need not be provided for when a statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source. This requirement supports the use of the authority cited in 15 U.S.C. 637 because this requirement is mandated to stay with an 8(a) business and an award to any other source would result in a duplication of effort and cost of Joint High Speed Vessel (JHSV) Trainings.
This request is being sought for the sole purpose to allow for an increase in the maximum dollar amounts on the labor and travel CLINS for Option Period Four to allow for the remaining task orders needed to fulfill the training requirements under this last option period. At the present projected number of trainings needed, it is anticipated that the maximum dollar value of this option period could be exceeded by the end of September 2018, with seven (7) months remaining in the current period. This contract was awarded under the 8(a) small business program.
The reason for these increases is, at the time of award, the JHSV Program was comprised of five (5) ships; whereas, the program now has ten (10) ships with the potential to have a total of thirteen (13) ships. This increase in ships in the program has increased the number of CIVMARS who require the JHSV trainings. At the inception of the contract there was an anticipation of a total of 169 CIVMARs would be needed to man five (5) vessels. With the increase of vessels to thirteen (13) the requirement has been raised to 440 CIVMARs needed in total to properly man all vessels.
The following outlines the remaining number of trainings needed throughout this last option period along with estimated costs:
1. 24 - 28 September 18 - Ship Handling (Deck Only) - Fort Eustis
1 - 12 October 2018 - Classroom, Deck and Engine - Fort Eustis 15 October - 2 November 2018 - Type Rating Shipboard Training (Deck and Engine) - CITY OF
BISMARK
2. 29 October - 2 November 2018 - Ship Handling (Deck Only) - Fort Eustis 5 - 16 November 2018 - Classroom, Deck and Engine - Fort Eustis 26 November - 14 December 2018 - Type Rating Shipboard Training (Deck and Engine) - CITY
OF BISMARK
3. 31 December 2018 – 4 January 2019 - Ship Handling (Deck Only) - Fort Eustis 7-18 January 2019 - Classroom, Deck and Engine - Fort Eustis 21 January – 7 February 2019- Type Rating Shipboard Training (Deck and Engine) -
BURLINGTON
4. 11-15 February 2019 - Ship Handling (Deck Only) - Fort Eustis 22 February - 7 March 2019 - Classroom, Deck and Engine - Fort Eustis 8 – 24 March 2019- Type Rating Shipboard Training (Deck and Engine) – BURLINGTON
Two instructors: Total $123,295.56/class: Labor $110,963.20; Travel $11,000.00 This amount is reflective of the maximum amount needed, i.e. two instructors may not be needed for each class.
We cannot have a disruption of this service as a lack of training of the CIVMARs working on these JHSV ships would prevent the continuous operation of the JHSV program thereby impacting MSC mission.
6. Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable:
For the reasons discussed in paragraph 5 above and in accordance with FAR 19.805-1(a)(2) efforts were not made to solicit offers from as many potential sources as practicable. MSC’s Small Business Specialist confirmed that since this original procurement was awarded under the 8a program and is under the $4 Million threshold, a sole source 8a company was chosen for this contract. Since no competition is allowed under this threshold, the risk of protest is extremely low for this ceiling increase. The Contracting Officer intends to post a synopsis and a redacted copy of this J&A for this proposed contract action on the Federal Business Opportunities (FBO) website in accordance with FAR 5.203(a).
7. Determination of Fair and Reasonable Cost:
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable since the instructor labor rates will be those rates for Option Period Four established in the contract.
8. Actions to Remove Barriers to Future Competition:
The Government expects to continue awarding this requirement to an 8(a) small business. The estimated start date of the follow-on competitive acquisition is April 2019.
File details come from the government source that posted it.
