SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been added by reference:

252.204-7012 Safeguarding of unclassified controlled technical information NOV 2013

The following have been modified:

52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS

In accordance with FAR 12.302 (Tailoring of provisions and clauses for the acquisition of commercial items) the following shall take precedence over the un-tailored paragraphs.

(a) Proposals may be only hand delivered, mailed or e-mailed directly to bina.russell@navy.mil the sole designated

E-mail address and inbox for receipt of E-mail submissions. No other electronic means of submission, used in whole or in combination with E-mail, is permitted.

E-mail proposals shall be in either Adobe or Microsoft Word format, with the exception of the signed 1449 and any amendments, which must be included in a proposal as scanned .pdf files, and the price proposal, which must be submitted in Excel format. Offerors are advised that the Government may be unable to receive other types of electronic files (e.g., .zip files) or files in excess of 20 megabytes. To be timely, an E-mail proposal must be received in its entirety in the designated E-mail inbox by the due date and time for proposal submission. An E-mail proposal that resides on a Government server, but has not appeared in the designated E-mail inbox by the due date and time for proposal submission will be considered late unless the exception at FAR 52.212-

1(f)(2)(i)(A) applies. The exception at FAR 52.212-1(f)(2)(i)(B) shall not apply to E-mail proposals.

Hand delivered and mailed proposals shall be sent to the following location and must be received there prior to the due date and time for proposal submission:

Military Sealift Command

Attention: Bina Russell, N1031, Room 215

Washington Navy Yard

914 Charles Morris Court, SE

Washington, DC 20398-5540

Access to the Washington Navy Yard is restricted. Offerors and couriers and other delivery services may encounter unpredictable and lengthy delays or denied access when attempting to enter that facility. Similarly, mailed and emailed proposals may encounter unpredictable and lengthy routing delays. In all cases, Offerors are responsible for the risks associated with the chosen delivery method and for ensuring that the Government receives the complete proposal at the appropriate designated location prior to the due date and time for proposal submission.

(b) Offerors shall provide all information required as follows, including the Independent Pricing Certificate and the

Representations and Certifications clauses (to be completed by Offerors). All Offerors are required to be registered in SAM. See above instructions in the section on the System for Acquisition Management (SAM).

Failure of an offer to address any items as outlined below may make the offer unacceptable and / or may result in it not being considered for award.

TECHNICAL PROPOSAL - Offerors shall provide the following information to demonstrate that the proposed tugs will meet the minimum requirements at time of delivery:

i. Offerors shall provide a completed Tug Characteristic Sheet (Attachment A) for each proposed tug.

ii. Offerors shall provide a completed Strike Contingency Plan and Vessel Casualty Plan (Attachment B).

iii. Offerors shall provide drawings or pictures of the proposed tugs.

iv. Offerors shall provide proof of ownership or evidence of authority to offer the proposed tugs.

(3) FAR Provision 52.212-3 Alt I

(c) Offerors are requested to provide information on up to five (5) previous Government contracts whose effort is/was recent and relevant to the effort required by this solicitation.

a. “Recent” is defined as a contract in-progress or completed within the last three (3) years. If the offeror has not had five (5) Government contracts within the last three (3) years, information on recent and relevant subcontracts and/or commercial contracts may be submitted.

b. “Relevant” is defined as a contract that is of similar scope, magnitude, complexity to the requirements as set forth in this solicitation.

i. Scope: Experience in the areas defined in the PWS.

ii. Magnitude: The measure of the similarity of the volume, dollar value and/or duration of the work actually performed under the offeror’s submitted contracts to the PWS.

iii. Complexity: The measure of the similarity of technical difficulty, managerial intricacy and/or required coordination of efforts and disciplines performed by the offeror in its submitted contracts to the PWS. For complexity, not only will the tasks performed by the offeror be considered, but also the offeror’s ability to coordinate tasks (e.g., concurrent performance requirements).

A Past Performance Data Sheet (Attachment D) is requested to be submitted for each contract to be considered as past performance. Offerors should provide a detailed explanation demonstrating the similarity of the contracts to the requirements of this solicitation; a detailed description of the work performed for the contract;

and the role performed, including whether the offeror acted as a prime contractor or a subcontractor. Offerors are responsible for the accuracy of all data provided. Past performance information regarding predecessor https://www.acquisition.gov/far/ companies, key personnel who have relevant experience and subcontractors that will perform major or critical aspects of the requirement may be provided as past performance submissions.

For each of the contracts the offeror describes in a Performance Data Sheet (Attachment D) the offeror is requested to provide a Past Performance Questionnaire (Attachment E) to a reference at the organization that awarded the contract. It is requested that the reference, not the offeror, email or fax the completed Past

Performance Questionnaire (Attachment E) BEFORE THE DUE DATE FOR PROPOSALS directly to Bina

Russell, Military Sealift Command, 914 Charles Morris Court SE, Washington Navy Yard DC 20398-5540, e-mail: bina.russell@navy.mil; Fax Number: 202-685-5263. The offeror, NOT THE GOVERNMENT, is responsible for ensuring that the Government receives a sufficient number of questionnaires.

All offerors are requested to address historical compliance with the requirements of FAR Part 52.219-8

(Utilization of Small Business Concerns) in the Performance Data Sheet (Attachment D). In addition, large businesses are requested to address historical compliance with the requirements of FAR Part 52.219-9 (Small

Business Subcontracting Plan) and DFARS 252.219-7003 (Small Business Subcontracting Plan, DOD

Requirements.) in the Performance Data Sheet (Attachment D).

An offeror that does not have recent and relevant past performance to provide for consideration is requested to affirmatively state that it does not have recent and relevant past performance for the Government to consider.

(d) In accordance with FAR 52.219-9 and DFARS 252.219-7003, large business offerors shall submit a Small

Business Subcontracting Plan with their proposal. Offerors shall ensure that they submit a Small Business

Subcontracting Plan with all of the information required by FAR 52.219-9.

In preparing the Small Business Subcontracting Plan, offerors should note that historical compliance with FAR

52.219-8 and FAR 52.219-9 may be evaluated as part of Past Performance in future source selections.

A subcontracting plan is NOT REQUIRED from small business concerns and will not be evaluated.

(e) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.
