5. Rationale Supporting Cited Statutory Authority

The statutory authority for this effort is FAR 8.405-6(a)(1)(i)(B). As identified in Section 6 of this document, Paladin Data Systems Corporation is the only authorized contractor to sell, provide maintenance, and modify the ASMi software application. Therefore, Paladin is the only Contractor capable of meeting SSP’s requirement for ASMi support.

SSP security forces identified the need to merge and automate processes and tools used to track Marine Corps Security Force Battalion (MCSFBn) member qualifications and certifications, generate security watch-standing schedules, perform audits/verifications, and support user general database needs. This software development effort was competed in 2014 and awarded to Paladin Data Systems (N00030-14-C-0016), who developed the SFQCMT utilizing an enhanced and customized version of their Advanced Skills Management Industrial (ASMi) software application. This procurement is a follow-on to N00030-14-C-0016 for support to the modified ASMi software.

6. Market Research Conducted

Due to the proprietary nature of the software involved in this effort, SSP contacted Paladin Data Systems Corporation to inquire if there were any other contractors who are authorized to sell, maintain, or modify the ASMi software. Paladin Data Systems Corporation officially responded that they are the only authorized contractor to sell, provide maintenance, and modify their software. They specifically stated: “Paladin is the software developer of ASMi and owns the ASMi source code, platform, and proprietary tools developed by Paladin to work with ASMi, including the ASMi SFQCM tool. Paladin is the only vender/provider authorized to sell, maintain, and/or modify ASMi code. SSP currently uses the SFQCM Tool built on and delivered through the ASMi software platform. As such, the proprietary source code developed by Paladin for SFQCM also falls under Paladin control. Paladin is the only vendor authorized to sell, maintain, or modify the SFQCM tool and/or the overall ASMi software code base.”

This contract action was synopsized via a Sources Sought Notice in FEDBIZOPS and received responses from five vendors, including Paladin. The Government technical experts reviewed the responses and determined that none of the other four responding vendors were capable of meeting SSP’s requirement. Additionally, Paladin verified no other vendors are authorized to sell, maintain, and/or modify ASMi code. Thus, there is presently no opportunity for a competition in this area, even of a limited nature.

The results of the market research shows there is only one contractor authorized to sell, maintain, and modify the SFQCMT. There would be significant cost to the Government and significant loss of MCSFBn effectiveness if the Government were to attempt to utilize or develop a replacement software to replace the SFQCMT software. Development and certification of new software would not be acceptable due to the significant interruption to the Integrated Nuclear Weapon Support System (INWSS) mission.

7. Best Value Determination

In accordance with FAR 8.404(d), GSA has determined the prices of supplies to be fair and reasonable for the purpose of establishing the schedule contract. The Contract Specialist will perform a price analysis using the proposal analysis techniques at FAR 15.404-1(b)(2)(iv), comparison with competitive published price lists to further validate and substantiate the reasonableness of proposed prices.

8. Actions to Remove or Overcome Barriers to Competition

Based upon the aforementioned facts and details identified in Paragraphs 5 and 6 above, the Government does not foresee a feasible alternative to the selected source. However, future requirements will be reviewed for ways to enhance competition and identify additional sources.
