About this file
This document is a Justification and Approval (J&A) for a sole source contract award. The J&A states that the incumbent contractor, Lockheed Martin Services (LMS), is the only responsible source identified to perform the required work for the production of the Common Hypersonic Glide Body (C-HGB) system within the established timeline. The key issues highlighted are LMS's lack of capability to integrate and produce all the required components, and the government's inability to transfer current government-furnished equipment to LMS without a gap in effort. The J&A also mentions that the government has contracted for a Technical Data Package (TDP) that could enable future competition, but the program is still in the rapid prototyping phase, and the near-term requirements will not be competed. The Contracting Officer has determined the anticipated cost to the government will be fair and reasonable.

(1) (U) cannot perform the work in the timeline required without major investment in additional integration and production equipment. The Government will not be able to transfer current Government-Furnished Equipment to without incurring a gap in effort because the current incumbent is using it on active government contracts.
(2) (U) white paper does not clearly identify capability to integrate and produce missile bodies with glide bodies.
(3) (U) response did not explain how they are going to produce and integrate the other CPS WS components, such as the WCS and APMs. also fails to mention the ability to build the Army Canister and ability to integrate it with the AUR.
(4) (U) Most importantly, is not capable of performing the CPS system engineering, integration, and production requirements within the established, required mission schedule without a CPS TDP available, which the Government does not expect until at the earliest.
c. (U) The Head of the Contracting Activity waived the requirement to post a new sources sought notice or request for information, as LMS is the only responsible source identified at this time, as discussed in detail above.
7. (U) Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies and services covered by this J&A will be fair and reasonable.
8. (U) Actions to Remove Barriers to Future Competition
a. (U) The Government has contracted for delivery of a TDP in that could enable a competitive approach to obtaining future requirements; however, because the program is still in the rapid prototyping phase, it does not intend to compete its near-term requirements. As the CPS program matures, SPC will consider opportunities for competition.
b. (U) SSP will encourage competition at the sub-tier level to the maximum extent possible for the long lead materials and parts with the utilization of commercial item procurement, if possible.
