1. Combined Synopsis/Solicitation includes FAR 52.211 6 “Brand Name or Equal,” which would normally allow an equivalent product meeting all salient characteristics. However, the attached Justification & Approval (J&A) document specifies “brand name only” for the Malpass B 3B 2A chair and states that an “or equal” description cannot be used. Could you please confirm which requirement governs for this procurement — the brand name only restriction in the J&A, or the brand name or equal provision in the solicitation? This clarification will ensure that any offer we submit is fully responsive.

Answer: This requirement is a brand name only. The justification and approval for a brand name only item takes precedence. I will modify the solicitation to remove that provision and extend the buy until 10 September at 1:00 P.M. Pacific Standard Time.
