About this file
This is a Terms of Use Agreement for RFP N0002426R6222 issued by the Department of the Navy Naval Sea Systems Command on March 31, 2026. The agreement governs the receipt and use of AN/BYG-1 technical documents and Government Furnished Information (GFI) by contractors responding to the RFP. Recipients must possess a valid SECRET security clearance, have an executed DD Form 2345 Military Critical Technical Data Agreement, and comply with all distribution statements and markings on individual documents. The agreement requires strict confidentiality and prohibits duplication, external distribution, disclosure to individuals without proper clearance, and transmission outside the United States without a valid Technical Assistance Agreement or export license.
The agreement imposes specific obligations on recipients regarding document handling, copying, and destruction. Recipients may make internal company copies but must maintain a log documenting distribution and destruction of all copies. Original documents and all copies must be destroyed no later than 180 days after the RFP closes, unless the Government issues a subsequent formal solicitation for the BYG-1 Applications requirement. If the recipient intends to submit a proposal based on a subsequent solicitation, certification of destruction must be provided to the Contracting Officer within 30 days of contract award, and destruction records must be maintained for five years. The Facility Security Officer must acknowledge and accept the agreement terms by signature and return the completed form to Contract Specialist Michael J. Ravnitzky and Contracting Officer John N. Butto.
