About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition to procure fifteen (15) 7m shipboard Rigid Inflatable Hull Boats (7m RIBs) from Willard Marine on a sole source basis. The Navy has an urgent requirement for the 7m RIBs to support critical operations, including search and rescue, personnel and cargo transfer, maritime interdiction, and tow and recovery. The estimated value of the procurement is redacted. The J&A cites the statutory authority under 10 U.S.C. 3204(a)(2) for unusual and compelling urgency, as the 7m RIBs are a critical safety item for Navy surface combatants, amphibious ships, and aircraft carriers. The Contracting Officer has determined the anticipated costs will be fair and reasonable. The Navy intends to avoid the circumstances driving this sole source requirement in the future.

DEPARTMENT OF THE NAVY
NAVAL SEA SYSTEMS COMMAND
1333 ISAAC HULL AVE SE IN REPLY TO
WASHINGTON NAVY YARD DC 20376-0001
J&A Number: 22,079
Code: 02222 P.R. Number: N00024-24-NR-55029
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA) Shipbuilding Contracts Division, SEA 022
2. Description of the Action Being Approved
The proposed action is for the modification of Foreign Military Sales (FMS) contract N00024-22-C-2210 to procure fifteen (15) 7m shipboard Rigid Inflatable Hull Boats (7m RIBs) from Willard Marine (Willard) on a sole source basis
This Justification and Authorization (J&A) documents the Navy’s determination that the proposed modification is necessary to meet the Navy’s unusual and compellingly urgent need to acquire 7m RIBs on an expedited schedule will be issued to Willard Marine (Willard), on a sole source basis, which necessitates this J&A in accordance with FAR 6.302-2 and DFARS 206.302-2.
3. Description of Supplies/Services
NAVSEA has an urgent requirement to procure fifteen (15) 7m RIBs to support critical US Navy operations, including service as the Ready Service Rescue Boat for Search and Rescue (SAR) missions, personnel and cargo transfer, Anti-Terrorism/Force Protection (AT/FP) Maritime Interdiction Operations (MIO) Visit, Board, Search and Seizure (VBSS) Safety Boat/ Escort, and Tow and Recovery Boat.
The Government’s needs have been verified by the requirements personnel.
The estimated dollar value per fiscal year is as follows:
Estimated Dollar Value by Fiscal Year
FY24 Totals
Per FAR 6.302-2(d), the period of performance for this modification will neither exceed the time necessary to meet the unusual and compelling requirements of the work to be performed and for NAVSEA to enter into another contract for the required 7m RIBs through the use of competitive procedures or one year without determining that exceptional circumstances apply.
4. Statutory Authority Permitting Other Than Full and Open Competition
In accordance with 10 U.S.C. § 3204 (a)(2), NAVSEA has determined that its need for the 7m RIBs is of such an unusual and compelling urgency that the Government would be seriously injured unless NAVSEA is permitted to limit the number of sources from which it solicits proposals.
5. Rationale Justifying Use of Cited Statutory Authority
The 7m RIBs are a key piece of safety gear for the Navy’s sailors, serving as the man-overboard Ready Service Life Boat for multiple classes of US Navy surface combatants, amphibious ships and aircraft carriers.
For the reasons stated in paragraph 5, the Navy has determined that it is not practicable for any other company besides Willard to provide the required 7m RIBs in time to meet the fleet’s schedule. Therefore, the Navy is utilizing the authority under FAR 6.302-2 to sole source a limited number of 7m RIBS to meet its most urgent needs
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
The Navy does not normally limit competition for 7m RIBs and intends to avoid the circumstances driving the current urgent and compelling need to sole source a limited number of 7m RIBs
