JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Shipbuilding Contracts Division (SEA 022).
2. Description of the Action Being Approved
This proposed action is to request approval to award a contract for one Hydrographic Survey Vessel and support equipment for the on a sole source basis to Workskiff Inc (Workskiff), 500 Metcalf St, Sedro-Woodley, WA. 98284.
3. Description of Supplies/Services
The Defense Security Cooperation Agency (DSCA) authorized a Hydrographic Survey
Vessel and support equipment to be sold to . requested the Hydrographic
Survey Vessel have identical specifications as the Naval Oceanographic Office (NAVOCEANO) Fleet Survey Team (FST) Workboat (WB) and procured from the original equipment manufacturer (OEM), Workskiff, on a sole source basis, under the authority of 10 U.S.C. § 3204 (a)(1).

4. Statutory Authority Permitting Other Than Full and Open Competition
In accordance with 10 U.S.C. § 3204 (a)(1), FAR 6.302-1, and DFARS 206.302-1, the supplies required by NAVSEA are available from only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The FST WB, for which the Hydrographic Survey Vessel will be based off of, is currently in service within the United States Navy (USN). Workskiff is currently the only prime contractor and supplier of the FST WB and serves as the Class Design Support agent for all vessels of that type.

It is in the Government’s best interest to procure the Hydrographic Survey Vessel, on a sole source basis, from Workskiff.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A Request for Quote (RFQ) for the first four FST WBs procured under N00024-15-F-2241 was issued on 26 February 2014 via GSA eBuy. The RFQ was cancelled after 30 days due to no response from industry. Due to the no bid a Request for Information (RFI) was posted via the Federal Business Opportunities (FedBizOpps) in May 2014. Three companies replied to the RFI. In June 2014 a new RFQ was issued via GSA eBuy and three companies submitted a proposal. Workskiff was determined to be the only responsive bidder.
On 5 December 2017 NAVSEA posted a pre-solicitation synopsis to FedBizOpps for two FST WB’s ultimately procured under contract N00024-18-C-2204. One company responded to the synopsis requesting more information about the requirement and specification. Further market research into the company and a review of past Government work determined that it has not demonstrated the ability to build cabin variant that meets the C130 Internal Airlift Requirement.
In accordance with FAR 5.201, the contemplated contract was synopsized via the Government-wide Point of Entry (GPE) at SAM.gov on 17 January 2023. On 31 January 2023, NAVSEA received a response to the sole source synopsis from Sea Machines, a small business located in Boston, MA. Sea Machines response which are not included in the scope of work. Sea
Machines did not express interest in this requirement as a prime contractor
If any responses are received from interested parties as a prime contractor, they will be evaluated prior to award.
A waiver to the DFARS PGI requirement 206.302-1(d) requirement to post a sources sought notice or request for information for any justification utilizing the authority at FAR 6.302-1 was approved on 03 February 2023.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NAVSEA has no plans at this time to compete future contracts for the type of supplies/services covered by this document. If another potential source emerges, NAVSEA will assess whether competition for future requirements is feasible.
