SF33
We would like to request an extension of the solicitation due date so that we are able to obtain and review the changes in the SOW and have time to review the Solicitation GFI against Attachment 5 and the soliciation requirements.
The Government has extended the proposal submission deadline to 07 November 2016
53
9/20/2016
Page 1, Paragraph 9
The due date for this proposal is 17 October 2016. Questions are to be submitted NLT 30 September 2016 (30 days after RFP posting). Answers to the questions are necessary for the contractor to develop a compliant proposal in response to the RFP. Would Government extend proposal submission deadline by 90 days?
The Government has extended the proposal submission deadline to 07 November 2016
54
9/21/2016
p. 176, Section L, Paragraph 2.2
Volume II is limited to 130 pages. Within this paragraph there are two places that list several items that do not count against the page count. Section L, paragraph 2.5.1.1.1.g requires a Quality Assurance Plan be submitted with the proposal that includes objective evidence to all of the ISO 9000 standards. Section M, paragraph 1.1.1.1.1.g also validates the Government will be evaluating the contractor’s submitted Quality Assurance Plan. Since a full Quality Assurance Plan can easily exceed 100 pages (especially in order to meet all ISO and program-unique requirements), can the Quality Assurance Plan be included as one of the documents excluded from the page count requirements?
Concur, QA Plan(s) and supporting QA documentation submitted as compliance with RFP requirements will not count towards the page number total of the proposal. RFP Amendment 0003 will reflect this change.

9/22/2016
SF 33, Box 9, Due Date for Proposals
Will the USG extend the due date for receipt of bidder's proposal until November 17, 2016?
The Government has extended the proposal submission deadline to 07 November 2016

Page 80, Section C, Paragraph 3.4.1.3
The second paragraph of 3.4.1.3 (Category C Depot Repair Items) of the SOW states: “… the system/assembly shall be shipped back to the Government CONUS/OCONUS point of debarkation and placed back into the spares pool.” In addition, Section I of the solicitation includes DFARS clause 252.225-7048 (Export-Controlled Items). Please confirm whether or not the scope of work to be awarded under this contract will require delivery of production systems to an OCONUS location, return of repaired items to an OCONUS location, or actual performance of services at an OCONUS location. If so, please confirm whether Section 3.9 (International Traffic In Arms Regulations) applies to these scenarios and the Contractor will be solely responsible for obtaining any State Department approvals, licenses, Technical Assistance Agreements required by the ITAR. Lastly, please provide a list of the potential OCONUS locations in conjunction with the type of services and/or deliveries to be performed there. This information is required for cost estimation purposes as well as export requirements review.
There is no requirement for OCONUS Delivery.

Page 167, Section L, Paragraph 1.0
In Section L, 1.0 General Support, the RFP references three support contractors, Alcyone Consulting Inc., AECOM, and Science Applications International Corp. Can you provide the POC information for each so we can contact them and put non-disclosure agreements in place?
Potential Offerors that require Non-Disclosure Agreements (NDAs) with support contractors listed in the RFP should email the blank company-specific form to brendan.kittredge@navy.mil and copy krysten.ellis@navy.mil. The Government will then facilitate the NDA process through to applicable POCs at each support contractor.
58
9/22/2016
Attachment 9, Identified WBS
With respect to the WBS provided in Attachment 9, can the government clarify if the funding for the JCREW Increment 1 Block 1 Full Rate Production contract will allocate all of the CLINs under the government’s “Procurement Contracts” cost element, level 3? Are there any activities that would be funded under any other level 3 line item?
RFP Amendment 0002 will include a revised Attachment 9.
59
9/22/2016
Page 170, Section L, Paragraph 2.1
Please confirm that under RFP, Section L, Page 170, paragraph 2.1, entitled “Restriction on Disclosure and Use of Data”; the reference to FAR 52.215-12 should be FAR 52.215-1.
The Government has corrected the reference under paragraph 2.1, entitled “Restriction on Disclosure and Use of Data” to FAR 52.215-1 in RFP Amendment 0003.
60
9/27/2016
Page 53, Section B, Note F
Section B, Note F specifies that the “Fixed Fee shall be proposed by the Offeror at 6% of Estimated Cost.” Additionally, Paragraph 3.6 (Engineering Support Services) of the SOW includes potential tasking, such as insertion of new technologies (TIE), configuration changes, verification of system to operational specifications, and sustainment engineering that would require more senior-level engineering expertise that qualifies for a higher fixed fee percentage under the USG’s weighted guidelines. For this reason, we respectfully request that the directed fixed fee be revised to reflect a higher percentage that is more commensurate with the types of tasking to be performed under this CLIN.
RFP Amendment 0003 has been updated to include a MAXIMUM fee of 8%. Offerors may propose less than 8% fee and are reminded that fixed fee will be evaluted in the Total Evaluated Cost/Price.
61
9/27/2016
Section I, Page 136
DFARS 209.571-8 (b) states: “Use the clause at 252.209-7009, Organizational Conflict of Interest—Major Defense Acquisition Program, in solicitations and contracts for systems engineering and technical assistance for major defense acquisition programs or pre-major defense acquisition programs.” Normally this clause is incorporated into SETA contracts where the SETA Contractor is providing Systems Engineering and Technical Assistance only, and is not also providing the “build to print” production system deliverables. Given that this contract’s scope of work does not include “systems engineering and technical assistance” from a SETA perspective, we request that DFARS clause 252.209-7009 (Organizational Conflict of Interest—Major Defense Acquisition Program) be removed from Section I of this solicitation.
Clause 252.209-7009 has been removed in RFP Amendment 0003.
62
9/27/2016
Section C, Page 136
FAR 46.805 (Contract clauses) paragraph (3) states: “In contracts requiring delivery of both high-value items and other end items, insert both clauses prescribed in (a)(1) and (a)(2) of this section, Alternate I of the clause at 52.246-24, and identify clearly in the contract schedule the line items designated as high-value items.” For this reason, we request that FAR clause 52.246-23 (Limitation of Liability) be added to the solicitation.
FAR 52.246.23 has been added to the Solicitation in RFP amendment 0003.
63
9/27/2016
Section I, Page 141
Section I, FAR 52.209-3 First Article Approval—Contractor Testing (SEP 1989) – ALTERNATE I (JAN 1997): Given that it is essential for the Contractor to purchase production material to some extent before first article approval in order to meet the contract delivery schedule, FAR 9.308-1(b)(3) advises that the contracting officer shall use a clause substantially the same as the clause at 52.209-3, First Article Approval—Contractor Testing, with its Alternate II. For this reason, the Contractor requests the solicitation be revised to include FAR 52.209-3 First Article Approval—Contractor Testing (SEP 1989) – ALTERNATE II (SEP 1989).
RFP Amednment 0003 includes FAR 52.209-3 First Article Approval—Contractor Testing (SEP 1989) – ALTERNATE II (SEP 1989).
64
9/27/2016
Section B, Note A, Page 52
In regards to Stepladder Pricing, Section B, Note A, of the RFP states: “First exercise of option CLIN 9999: quantity of 150 at a unit price of $150 each for an extended price of $22,500 (=150*$150) funded on CLIN 9999. Second exercise of option CLIN 9999: quantity of 200. The second exercised quantity of 200 plus the first exercised quantity of 150 equates to 350 in total for CLIN 9999. The unit price for 350 units is $100, thereby making the extended total price $35,000 (=350*$100). Therefore, the unit price for CLIN 9999 would be unilaterally adjusted in accordance with Note A and Note G to reflect a quantity of 350 at a unit price of $100 with an extended price of $35,000.” Please confirm that the each time a CLIN is exercised, the quantity of systems ordered for each task order will only be used once to determine unit pricing during a 60 day ordering period. For instance, using the scenario provided above, if the first exercise of option CLIN 9999 is awarded July 1st, and the 2nd exercise is awarded August 30th, which is within 60 days of the first exercise, resulting in a unit price adjustment based on Stepladder pricing, if a 3rd exercise of CLIN 9999 is awarded September 15th (past 60 days from the first exercise but within 60 days of the 2nd), that the quantity of systems ordered in the 3rd exercise will be considered the first order/exercise for the next 60 day period, and that it will not be added to the quantities of exercise 1 and 2 to adjust unit pricing a second time.
The 60 day window applies from the date of the first option exercise. This has been clarified in RFP Amendment 0003.
65
9/06/2016
Overall
Please advise if you would permit an offshore division to perform portions of this requirement to help save overall labor costs.
A Potential Offeror is expected to comply with all RFP terms and conditions including security requirements listed in the DD254, the Buy American Act, and procedures for handling ITAR controlled material.
66
9/16/2016
Paragraph 3.6, Engineering Support Services
The SOW defines all Engineering Support Services (ESS) as government directed TI efforts. This does include sustaining engineering *Removed for Sanitization*. If the Offeror is not clear on what the government defines as sustaining engineering or we expect confusion between LRIPs and FRP then we may wish to clarify. As written all cost associated with unit build/test and delivery are in the FFP of the other CLINs even if engineering is called in to resolve or help. Defined items such as FRACAS,R&M, or DMS reporting, RFV etc would not be costs attributed to sustaining engineering.
Efforts funded under Engineering Services Support CLINs will be clearly defined in the respective Technical Instructions. ESS related to LRIP units are not intended under this contract.
67
10/01/2016
Section B, Note A, Page 62
Section B Note A of the RFP states that the Government may unilaterally exercise a given CLIN more than once, prior to the latest option exercise date identified in clause 52.217-7, and up to the total quantity. However, CLINs 0001-0009 are not identified as Option CLINs in Section B or listed under FAR 52.217-7, Option for Increased Quantity – Separately Priced Items. Does this mean the USG intends to exercise the Base Year CLINs only once during the period of performance of the Base Year, and will all Base Year CLINs be exercised simultaneously?
CLINs 0001-0009 are not option CLINs and will be exercised accordingly at contract award. Note A does not apply to CLINs 0001-0009.
68
10/01/2016
Section F, Page 107, Delivery Note 1
Section F, Page 107, Delivery Note 1 states that the delivery information will be “filled in” upon each option exercise, including period of performance, quantities, and ship to information. Please confirm that this Note 1 applies to the Delivery Information beginning at the bottom of Page 107, and is applicable to all CLINs (Base & Options).
Delivery Note 1 applies to options CLINs only. Delivery Information for Base Year CLINs 0001-0004 and 0009 has been filled in in RFP Amendment 0003.
69
10/01/2016
Section I, Page 142
Section I, Page 142, 52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989), the RFP provides the latest exercise option date applicable to the Option CLINs. However, the contract does not identify the earliest exercise Option Date. Is it the intention of the USG to exercise Option Year CLINs in conjunction with the GFY? Is there potential that exercise of the Option Years could overlap?
While it is the intent of the Government to award each Option to coincide with the Government Fiscal Year, Options may be exercised as solicited.
70
10/01/2016
Section I, Page 142
Section I, Page 142. 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT; This clause states in paragraph (c) that the total duration of this contract, including the exercise of any option(s) under this clause, shall not exceed five (5) years, with the exception of the LOE ESS CLINs when the total delineated hours have not been expended. However, this clause seems to be in conflict with the Option for Increased Quantity, 52,217-7, which identifies the latest option exercise date for the Option Year 4 CLINs to be 60 months (five years). If an Option Year 4 CLIN is exercised on the latest exercise option date with delivery required within 22 months of exercise, the total performance of the contract would be (7) years. Does “duration” in the context of this clause cover the ordering period only or actual performance?
CLINs 5011-5036, which are for O-level Parts, Depot Level Parts, and Support Equipment, are intended to have a Latest Option Exercise Date of 60 months ADC.
71
10/03/2016
Section I
Section I of the solicitation incorporates DFARS Clause 252.246-7001, ALT II, Warranty of Data (Mar 2014) by reference. This ALT II clause imposes additional potential liabilities upon the Contractor that will need to be accounted for in the original bid price and in every future engineering change proposal. For this reason, the Contractor requests that the Government consider removing ALT II from the solicitation and simply leave in DFARS clause 252.246-7001, Warranty of Data (Mar 2014).
DFARS Clause 252.246-7001 and DFARS Clause 252.246-7001 Alt II have been removed in RFP Amendment 0003.

9/8/2016
RFP Page 2-16; Section B, Supplies or Services and Prices (CLINs 002-004, 0102-0104, 0202-0204, 0302-0304, 0402-0404)
The “OPTION” note that accompanies each of the referenced CLINs states “xxx shall be built IAW TDP Drawing No. 8664665 (SEE NOTE A, B, G and H)”

Referencing only drawing 8664665 is not sufficient to adequately describe the material listing that comprises each of the three CLIN types (JCREW I1B1 MOUNTED/FIXED SYSTEMS, JCREW I1B1 MOUNTED AUXILIARY KITS, and JCREW I1B1 FIXED AUXILIARY KITS).

Please provide a unique Ordering or Parts List number (for example 8664665-1, 8664665-2, 86647667-2, or otherwise) that explicitly defines the contents of each of these three CLINs. A complaint proposal cannot be provided without a better definition of what is being requested.

Note H states "The RT box and Auxiliary kits are detailed in Section J, Attachment 6." The specifics to this note are defined in two main drawings: 1) The Drawing PL8664665 lists multiple parts of which all are considered Auxiliary Kit item except 8664667-1 (Mounted) and 8664667-2 (Fixed Site). 2) The Drawing PL8664667 lists multiple parts of which All parts with the "Notes" column filled with "NOTE 3" are Auxiliary Kit items and the remaining parts without "NOTE 3" are considered the RT Box.

RFP p. 176 paragraph (d) "Disposition of Technical Data Package"
Last sentence of this paragraph states that, " Offerors shall not download any files from the CD/DVD onto any local area network (LAN) or integrated digital environment (IDE)." Does this statement apply only after contract award or to the entire proposal process including the time before the award?
This statement applies to the entire proposal process including time before award.
28
9/16/2016
RFP Page 53, Stepladder Pricing
The table for Stepladder Pricing does not include an estimated start date for the Base Year. Can the bidder assume that the estimated start date for the Base Year is 6/01/2017, and that it will run for twelve months with each Option Year starting at the end of the previous year? If not, can you provide estimated start dates for Base/Option Years?
An estimated date of award of 01 July 2017 has been added to the Solicitation in Section L in Amendment 0002.
29
9/16/2016
RFP Section C Paragraph 3.6, Page 82
This SOW section (3.6 Engineering Services) lists vehicle installation and integration. In order to assign appropriate labor rates please confirm the OCONUS support will not be required?
OCONUS support will not be required for vehicle installation and integration

RFP Page 2-16; Section B, Supplies or Services and Prices (CLINs 0002, 0003, 0004, 0102, 0103, 0104, 0202, 0203, 0204, 0302, 0303, 0304, 0402, 0403, and 0404)
The note that accompanies each of the referenced CLINs states “xxx shall be built IAW TDP Drawing No. 8664665 (SEE NOTE A, B, G and H)” Referencing only drawing 8664665 number does not adequately describe the ordering item (i.e. Parts List) for the JCREW I1B1 MOUNTED/FIXED SYSTEMS and AUXILIARY KITS. Understanding that the 8664665-1 is the MOUNTED system and 8664665-2 is the FIXED system, each uses a different configuration of the Receive/Transmit box (8664667-1 or 8664667-2) with the difference being the inclusion of the parts that make up the shock isolation solution. In order to improve the government’s desire for equivalent competitive proposals, suggest that the government provide a Parts List number for the common Receive/Transmit box (CLINs 0002, 0102, 0202, 0302) and prove a Parts List for each of the MOUNTED AUXILIARY KIT (CLINs 0003, 0103, 0203, 0303) and FIXED AUXILIARY KIT (CLINs 0004, 0104, 0204, 0403).

Page 191, Paragraph 2.7.1.1.1

Section 2.4.1 Solicitation Set, b), 4. Completed Attachment 2 requires the Cost and Price Summary Workbook in Volume I. However, Paragraph 2.7.1.1.1 Cost and Price Summary Format Workbook (attachment 2) states that Attachment 2 is required in Section IV Cost Price Proposal. Should Attachment 2 be included in both volumes?
Attachment 2 shall be included in Volume IV. Attachment 2 will be removed from Section L 2.4.1 in RFP Amendment 0002.

9/20/2016
Page 191, Paragraph 2.7.1.1
Will the Labor Categories provided in the table for the Labor Mix be incorporated into the contract for billing purposes? Or are the categories for evaluation purposes only and each contractor will bill its applicable approved direct labor rates with approved indirects if awarded?
The Labor Categories provided in the solicitation are for evaluation purposes only. Actual contractor specific labor categories may differ in title and shall be clearly mapped to the solicitation labor categories as stated in RFP Section L 2.7.1.1 as follows: "The Offeror shall provide a mapping of any contractor specific labor categories it, or one of its subcontractors, proposes in the “ESS Cost Summary” Tab of Attachment 2 to the Government Labor Category Definitions above in the Cost Narrative described below. "

Page 176, Paragraph 2.2,

Page 178, Paragraph 2.2.3

On RFP page 176, the table states that 1 original and 4 copies (5 total) of electronic files for each volume are required. However, on page 178, the RFP states that 1 original and 2 copies (3 total) of electronic files for each volume are required. Please clarify the correct number of electronic CD-ROM copies required.
RFP Section L 2.2.3 has been amended to correspond with RFP Section L 2.2 in RFP Amendment 0002. One (1) Original and four (4) copies of electronic files shall be submitted.
36
9/20/2016
Section B, Note G
The RFP requests stepladder pricing for a minimum quantity of 1 to a maximum quantity of 1000. How many systems of each variant (# of units)are anticipated in the base year and option years?
As solicited the Government could potentially order anywhere from 1 to 1,000 units of each variant in each contract year.
37
9/20/2016
Page 74, Paragraph 3.1
The RFP states this is a build-to-print effort and the contractor shall build systems in accordance with the TDP as provided as GFI. Has the TDP baseline system passed all qualification tests? Will the test artifacts be provided? Will the test plans and procedures as well as test limits be provided?
TDP baseline systems will be qualified by Contract Award. All test limits are documented in all test plans, currently available in Bidder's Library as documented in Attachment 5, GFI list, Items 3, 15, 16.
38
9/20/2016
Page 74, Paragraph 3.1
If the LRIP systems have passed FAQT and the TDP meets all requirements, why is it necessary for the contractor to execute FAQT (assuming the contractor passes PCA)? Does FAQT include all environmental testing, reliability demonstration, EMI/EMC, shock & vibration, etc.?
Production start mandates a new PCA and FAQT. FAQT shall be executed in accordance with FAQT Plan and Procedures (A005) as specified in the RFP.
39
9/20/2016
Page 80, Paragraph 3.1.6.2.1
Does an ESS profile already exist for the system? If so, will it be provided? What is the time duration estimated for each cycle?
No ESS Profile currently exists for the system. This Profile shall be required to be developed and delivered for USG approval prior to test execution. Development of ESS Profile shall be IAW MILHDBK-2164A. Delivery of ESS Plan shall be under CDRL A015 (Environment Stress Screening Plan and Procedures)
40
9/20/2016
Page 80-81, Paragraph 3.1.6.2.2
The duration of PRAT (16 hours) is long for each manufactured system, and appears to include thermal and electrical stresses. Because the system has already been through ESS for 5 thermal cycles, is there an opportunity for the contractor to update test plans and procedures to optimize for manufacturing while ensuring the system meets all requirements?
Conversion to a sampling plan shall be IAW PRAT Plan, provided as GFI, Section J, Attachment 5
41
9/20/2016
Page 83, Paragraph 3.2.2.4, 3.2.2.5
If the contractor builds the system exactly to print and in accordance with the TDP and the resulting unit does not pass qualification tests, the RFP states the contractor is responsible for failure analysis and corrective actions. Does this include design changes to make the system meet the requirements? Where is this funded? Does the contractor have access to the OEM of JCREW I1B1 for design discussions?
Failures shall be handled as outlined in RFP Section C paragraph 3.2.2. All design discussions will be handled by the Government.
42
9/20/2016
Page 90, Paragraph 3.9
Is it anticipated that the system will be exported? Is FMS a consideration? Does an ITAR approval/exemption exist for the system?
At this time FMS is not a consideration.
43
9/20/2016
Page 79, Paragraph 3.1.6.1
Is special-purpose test equipment necessary for conducting FAQT or PRAT? Does automated test equipment (ATE) exist? If so, will the ATE or ATE documentation be provided to the contractor?
The Government will not provide ATE or ATE documentation. ATE is not required per the solicitation requirements, however the Offeror must demonstrate a viable test approach and identify manufacturing risks in CDRL A001.

Will system software and firmware be included in the TDP? Who is responsible for maintaining the software and firmware for the system (e.g., the contractor or the Government)? Are SW/FW issues treated the same as hardware defects in the FRACAS? Will the source code for the SW/FW be provided? Do the LRU components (such as circuit cards) have unique unit-level test software/firmware? Does the system have unique test SW/FW or is the tactical SW/FW used for testing? Does the Government own the system SW/FW?
No SW/FW is included with the TDP. Source code will not be provided. SW/FW required to operate the system will be furnished and maintained by the USG. SW/FW required to to validate subassembly, assembly, and system production will be the responsibility of the contractor. USG owns the SW/FW used to operate the system. SW/FW discrepancies will be managed IAW the contractual requirements, including the FRACAS process.

Page 136, Paragraph ( c)
Given that this is a build-to-print effort, the contractor assumes the TDP baseline meets all design requirements and that no engineering design changes are necessary to meet the design specifications. The RFP states that the contractor bears all costs associated with rerunning FAQT. Does this include failures that result from the TDP baseline not meeting design specifications?
Failures shall be handled as outlined in RFP Section C paragraph 3.2.2. All design discussions will be handled by the Government.

Concur, QA Plan(s) and supporting QA documentation submitted as compliance with RFP requirements should not count towards the page number total of the proposal. RFP Amendment 0002 will reflect this change.

Overall
Please advise if you would permit an offshore division to perform portions of this requirement to help save overall labor costs.
A Potential Offeror is expected to comply with all RFP terms and conditions including security requirements listed in the DD254, Buy American Act, and procedures for handling ITAR controlled material.

NOTES

NOTE A - The Government may unilaterally exercise a given CLIN more than once, prior to the latest option exercise date, identified in clause 52.217-7 (Section I, herein) for that CLIN and up to the total quantity listed. If an option CLIN is exercised more than once within sixty (60) days, the unit price for that CLIN shall be unilaterally modified to reflect the appropriate stepladder unit price for the entire quantity purchased for that CLIN. Exercising options will only result in quantity increase for given CLINs. The following hypothetical example illustrates how pricing will be adjusted if a given CLIN is unilaterally exercised more than once:

CLIN 9999

Step-ladder Quantity
Unit Price
100 – 200
$150
201 – 300
$120
301 – 400
$100

First exercise of option CLIN 9999: quantity of 150 at a unit price of $150 each for an extended price of $22,500 (=150*$150) funded on CLIN 9999.

Therefore, the unit price for CLIN 9999 would be unilaterally adjusted in accordance with Note A and Note G to reflect a quantity of 350 at a unit price of $100 with an extended price of $35,000.

NOTE B - Option item to which the option clause in SECTION I-2 applies and which is to be supplied only if and to the extent said option is exercised.

NOTE C - JCREW I1B1 FRP Support Equipment Pricing Tables are provided as Section J, Attachment 13. SECTION I - CONTRACT CLAUSES

The following have been added by reference:

52.246-23
Limitation Of Liability
FEB 1997

The following have been added by full text:

52.209-3 FIRST ARTICLE APPROVAL -- CONTRACTOR TESTING (SEP 1989) - ALTERNATE II (SEP 1989)

[Contracting Officer shall insert details]

(a) The Contractor shall test one (1) unit of each variant unit(s) of Lot/Item 0009as specified in this contract. At least 30 calendar days before the beginning of first article tests, the Contractor shall notify the Contracting Officer, in writing, of the time and location of the testing so that the Government may witness the tests.

(b) The Contractor shall submit the first article test report within 30 calendar days from the date of this contract to [insert address of the Government activity to receive the report] marked "FIRST ARTICLE TEST REPORT: Contract No. , Lot/Item No. " Within calendar days after the Government receives the test report, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall repeat any or all first article tests. After each request for additional tests, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall then conduct the tests and deliver another report to the Government under the terms and conditions and within the time specified by the Government. The Government shall take action on this report within the time specified in paragraph (b) above. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule, or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article report on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, and if the approved first article is not consumed or destroyed in testing, the Contractor may deliver the approved first article as part of the contract quantity if it meets all contract requirements for acceptance.

(f) If the Government does not act within the time specified in paragraph (b) or (c) above, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) Before first article approval, the Contracting Officer may, by written authorization, authorize the Contractor to acquire specific materials or components or to commence production to the extent essential to meet the delivery schedules. Until first article approval is granted, only costs for the first article and costs incurred under this authorization are allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government. If first article tests reveal deviations from contract requirements, the Contractor shall, at the location designated by the Government, make the required changes or replace all items produced under this contract at no change in the contract price.

(h) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. The offeror/contractor may request a waiver.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

SECTION L

The purpose of this solicitation is to obtain competitive proposals for the JCREW I1B1 full rate production (FRP) requirement. The Government intends to award a contract that results from this solicitation, using Best Value Tradeoff source selection procedures. Offerors shall submit their proposals for the JCREW I1B1 FRP requirement, prepared in accordance with the instructions presented herein. Evaluation of proposals will consist of a review of Offerors’ written Technical Approach; Management Approach; Past Performance Information, and Cost/Price.

The RFP will be made available only through the Internet at the Governmentwide Point of Entry (GPE). Offerors are hereby notified that from time to time, the Government may post additional information to the web site relating to this solicitation (e.g. responses to questions, amendments, etc.). It is the Offeror’s responsibility to check the web site for any such information.

The Government may reject any or all proposals if such action is in the best interest of the Government.

1. GENERAL

The Government desires to procure systems, support equipment, training, spares and the depot capability necessary to support the production and sustainment of JCREW I1B1 systems. The Offeror shall submit all information required by this RFP. Failure to comply with the terms and conditions of the RFP may result in the Offeror being removed from consideration for award. The Offeror’s proposal shall be based on the requirements contained in this RFP (including those documents, exhibits, and other attachments to the RFP identified in Section J). Offerors are required to submit a proposal encompassing all items listed in this RFP. The Government will only accept one offer per Contractor. As such, an Offeror cannot be the prime contractor on one offer and a subcontractor on another.

The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Each Offeror is required to complete Standard Form 33, “Solicitation, Offer and Award”.

Government support contractors may assist the Source Selection Organization. The Source Selection Advisory Council (SSAC), the Source Selection Evaluation Board (SSEB), and the Cost/Price Analysis Team (CPAT) will be composed of Government employees. The Government support contractors may participate as Advisors to the Source Selection Organization and/or as administrative support.

The following firm(s) may assist in the technical/management proposal review in an advisory capacity only to the source selection process, but will not evaluate proposals or have voting authority:

- Alcyone Consulting, Inc.

- AECOM

- Science Applications International Corporation

The Government has both hardware and information exclusion clauses as well as proprietary data protection clauses in Government contracts with the above listed firms. All support contractor personnel acting in an advisory role will be required to fill out non-disclosure agreements and organizational conflict of interest forms. Offeror shall provide written notification to the PCO no later than ten (10) days after issuance of the Solicitation if Offeror does not consent to the use of the firm listed above in the proposal evaluation process. Otherwise, submission of a proposal will be considered consent of use of the abovementioned firms.
