JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Shipbuilding Contracts Division (SEA

022) -

2. Description of the Action Being Approved

Award of a sole source Indefinite Delivery Indefinite Quantity (IDIQ) contract for the procurement of an estimated forty-two (42) Rapid Response Skimmers (RRS5) to Kvichak Marine located in Seattle, WA. The period of performance is five (5) years from date of contract award.

3. Description of Supplies/Services

The proposed action is to procure an estimated forty-two (42) RRSs and associated components from Kvichak Marine, Seattle, WA, for the Naval Facilities Oil Spill Response Program (NAVFAC OSRP), Port Hueneme, CA.

The Naval Facilities Engineering and Expeditionary Warfare Center (NAVFAC EXWC) in Port Hueneme, California executes the NAVFAC OSRP mission as an agent for the Naval Facilities Engineering Command (NAVFACENGCOM) . The organization provides manned, advancing oil skimmers to Navy facilities worldwide. New skimmer procurements are required to maintain the in-service skimmer fleet.

Kvichak RRS unique characteristics:

• 3Oft notional length, loft notional beam;

• Aluminum construction with ‘semi-catamaran’ design, twin hulls forward with center slot, transitioning to mono-hull aft;

• Marco Filterbelt oil skimming module mounted on centerline with pivot assembly and hydraulic cylinder for raising and lowering the module. The Filterbelt is a 12” wide conveyor-belt style mechanism that lowers into the slot between the forward hulls to collect oil floating on the water surface;

• Three Oil Recovery Tanks (1,300 gal total capacity) for storage of oil collected by the Filterbelt module;

• Hydraulic Power Unit (HPU) and hydraulics system with controls for operation of the oil skimming module and associated support systems (Washdown pump, Transfer/Offload pump);

• Transfer/Offload pump for emptying Oil Recovery Tanks to offboard stowage/handling facilities;

• Washdown system with reversible pump, three-way valve and piping to support seawater washdown or transfer of oil from alongside skimmers into onboard Oil Recovery Tanks;

• Oil Skimming Sweeps at bow, to funnel oil into the slot between the forward hulls for collection by the Filterbelt module. Sweep width can be extended by removable extender plates. Adapter plates allow sweeps to be interfaced to Oil Response Boom sections for efficient oil collection from containment facilities;

• Wheelhouse (three-sided) with control console located on aft deck.

• Twin outboard gasoline engines (90 hp each), 15 kt minimum transit speed (Oil Recovery Tanks empty), 1.5 kt nominal skimming speed, SO gal gasoline fuel tank;

• Boat systems adhere to all applicable American Boat and Yacht Council (ABYC) standards and applicable Navy boat guidance documents;

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The Office of the Chief of Naval Operations (OPNAV) N4 has also established a funding line across the Future Years Defense Program (FYDP) to procure these replacement craft through the remainder of the program life. The funding profile is identified below.

Delivery of the first boat is expected to be approximately 210 days after award.

4. Statutory Authority Permitting Other Than Full and Open Competition

FAR part 6.302-1 (a) (1) and 10 U.S.C 2304(c) (1) Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority

NAVFAC OSRP requires an integrated advancing oil skimmer system (boat with integrated skimming module) for Navy harbor oil spill recovery operations. Kvichak is the only source capable of providing an integrated oil skimming system (Kvichak RRS) meeting OSRP’s requirements, including key requirements (Throughput Efficiency of 65%, Recovery Efficiency of 60%, and Recovery Rate of 6.5 gpm), when tested using ASTM Standard F 631-93 with DFM and JP-S. The Kvichak RRS is a unique proprietary design employing integrated skimming technology (Marco Filterbelt system) , not available from other vendors, to meet the specific requirements of the Navy.

The Kvichak RRS is the culmination of an extensive Research & Development (R&D) project conducted by NEXWC to identify suitable oil skimming technology to meet Navy requirements. From May 2000 to October 2001, NEXWC personnel conducted performance tests on eight advancing skimmer designs at the National Oil Spill Test Facility (Ohmsett) , Leonardo, NJ. The test results and subsequent product development and enhancement by the builder have yielded the highly specialized Kvichak RRS as the only design solution that satisfies Navy harbor oil spill recovery requirements.

The Kvichak RRS has the ability as an advancing manned oil skimmer to meet the Navy’s requirements for adequate light oil recovery rates and efficiencies. The Kvichak RRS technologies were able to conform to the ABYC manufacturing standards, sustained operations in a Navy port environment (daily use and maintainability), and meet the standards contained in the Navy guidance documents with regard to materials, logistics, supportability, and safety. No other companies on the market can meet these requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed sole source contract was synopsized on the FEDBIZOPS website on 6 November 2013 with the following key requirements and information:

• OSR Skimmer requires testing using American Society for Testing and Materials (ASTM) Standard F 631-93, “Standard Guide for Collecting Skimmer Performance Data in Controlled Environments,” with DFM and JP-5;

• Throughput Efficiency of 65%;

• Recovery Efficiency of 60% and Recovery Rate of 6.5 gpm;

• The Kvichak RRS is a unique proprietary design employing integrated skimming technology (Marco Filterbelt system) to meet the specific requirements of the Navy.

The Government received a capability statement from one interested party, on November 29, 2013, with follow-up emails on 1 December 2013 and 8 December 2013. Upon request from the Government submitted the following supporting information for consideration:

This information was forwarded to the Acquisition Engineering Agent (ABA) Group Combatant Craft Division (CCD) for a technical evaluation of the proposed systems and the vendor’s manufacturing capability. On 13 December 2013, CCD completed the technical evaluation. Based on the submitted information, the ABA concluded that proposed skimmer models did not meet the specified performance and test requirements of the sole source synopsis and are not equivalent to the Kvichak RRS.

On 13 February 2014 the Government requested more information from to determine the capabilities of its proposed skimmer models with a response date of 25 February 2014. when no response was received by 25 February 2014, the Government contacted again on 5 March 2014. On 10 March 2014, answered the Government’s request for more information. This information was again forwarded to CCD for technical evaluation. The second technical evaluation was completed on 13 March 2014, and concluded that did not present sufficient evidence to indicate an existing capability to build oil skimmers that complied with the requirements of the Synopsis.

provided no substantiated documentation of a design that complied with the key requirements of the Synopsis.

The Government’s decision was based in part on the following:

• Neither product proposed by currently meets key requirements for oil recovery capacity or speed because rather than the minimum required 1,000 gal oil recovery tank capacity and transit speed of lskt.

Modification to either of the products will likely require significant changes to the parent craft and introduce significant technical risk to the program;

• Neither product proposed has been independently tested to verify oil skimming performance parameters (throughput efficiency, recover efficiency, recovery rate) with light refined oils in accordance with the cited ASTM standard;

• The current outboard engine platform proposed does not meet the minimum required oil recovery tank capacity of 1,000 gal and transit speed of lSkt.

proposed skimmer has an oil recovery capacity of and transit speed of stated that the current outboard design can be readily modified to provide the oil recovery tank storage capacity of 1000 gallons and speed and performance of the craft would be unaffected. Lengthening the craft and increasing the oil storage capacity is likely to degrade speed and performance due to the added weight of the lengthened hull and stowed oil;

• To achieve the oil recovery storage capacity requirement proposes augmenting storage capacity with off vessel tanks towed astern which does not meet the requirements and is not an acceptable US Navy operational procedure.

On 25 April 2014, the Government informed of its technical evaluation results and that it would be proceeding with a sole source solicitation for the RRS. As of 30 April 2014, the Government had received no other communication from regarding the sole source categorization of the solicitation.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

The Naval Sea Systems Command, Shipbuilding Contracts Division (SEA

022) will continue assess the marketplace for potential sources of supply that can meet the requirements to conduct a competitive procurement if and when future requirements emerge.
