JUSTIFICATION AND APPROVAL FOR USE OF
OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Sea Systems Command (NAVSEA), Surface Systems Contracts Division, SEA 025.
2. Description of Action Being Approved.
NAVSEA intends to utilize other than full and open competition to award a contract to Raytheon Company, Integrated Defense Systems (Raytheon IDS), 8680 Balboa Avenue, San Diego, CA 92123-1502. For administrative purpose, this action will be executed as an contract extension of N00024-14-C-5128. This effort will extend the period of performance through CY19 and into part of CY20. The extension will provide Platform Systems Engineering Agent (PSEA) support of the Ship Self Defense System (SSDS) MK 2 to develop and deliver requirements for CVN and Amphibious Modernization Advanced Capability Build 12 (ACB 12) on Technical Insertion 12 (TI-12), TI-12 Hybrid (TI-12H) (SSDS Software Build 10), and TI-16 (SSDS Software Build 11).
3. Description of Supplies/Services.
Raytheon IDS is currently the PSEA and Design Agent (DA) for SSDS performing system engineering, integration, testing, and support certification of software upgrades addressed in SSDS ACB 12 for CVN and Amphibious Combat System Modernization and hardware upgrades addressed in TI-12, TI-12H, and TI-16.
This contract action is needed to complete ACB 12 software development on TI-12 for CVN 78 from the Land Based Engineering Test 16 (LBET-16) event through Deployment Certification as part of the “CVN 78 Recovery Plan.” This action will enable completion of Test Analyze and Fix (TAAF) efforts associated with computer program deficiencies discovered during Fire Control Loop Improvement Project (FCLIP), Total Ship Training Capability (TSTC) and Task Force Cyber Awakening (TFCA) Cyber Security/Boundary Defense Capabilities (BDC) from Land Based Engineering Testing (LBET) and Combat Systems Testing (CST) for LPD 23, LPD 24, and LHD 6 (as lead ships with TI-12H) through completion of baseline certification and from LBET through Formal Qualification Testing (FQT) for CVN 73, LPD 18 and LHD 6 (as lead ships with TI-16). The PSEA will also complete TAAF for deficiencies discovered during Far Term Interoperability Improvement Project (FTIIP) baseline and LINK certifications. The PSEA will implement computer program corrections for Engineering
Deficiency Reports (EDRs) and Test Observation Reports (TORs) to eliminate Severity 1 and 2 trouble incidents discovered during the land based, shipboard, and interoperability testing referenced above. Upon completion of the aforementioned efforts, all SSDS MK 2 ships will have Identification Friend or Foe (IFF) Mode 5 Fire Control and Tactical Data Information Link (TADIL) integration with the exception of the LSD 41 and 49 Classes which will have the Fire Control capability only.
The “CVN 78 Recovery Plan” will, as part of the ACB 12/TI-12 Development, complete Fire Control, Air Traffic Control, and Interoperability functions required for CVN 78 deployment by providing war fighting capabilities to include: Tactical Data Links (TADIL) via Product Line System Track Manager/Track Server (STM/TS), Dual Band Radar (DBR), Cooperative Engagement Capability (CEC), Aircraft Carrier-Tactical Support Center (CV-TSC) (Increment 2) Integration, Surface Electronic Warfare System Improvement Program (SEWIP Blk 2). Weapons Coordination and Launch, Battle Force Tactical Trainer (BFTT) modifications, and Information Assurance (IA) Cross Domain Solutions (CDS) for Rolling Airframe Missile (RAM) and Navigation Sensor System Interface (NAVSSI).
This modification will also provide support for TAAF of FCLIP capabilities from Land Based Engineering Testing (LBET) and Combat Systems Testing (CST) for LPD 23, LPD 24, LHA 6 and LHD 6 (as lead ships with TI-12H) through completion of baseline certification and CVN 73 (as lead ship with TI-16) through FQT. The PSEA will implement computer program corrections for Engineering Deficiency Reports (EDRs) and Test Observation Reports (TORs) to eliminate all Severity 1 and 2 trouble incidents discovered during testing. When completed, FCLIP will provide capabilities to include; RAM Blk 2A, NATO SeaSparrow Missle System (NSSMS) Multi-Target Tracking (MTT) and Terrier/Tarter Uplink (2T Uplink), CIWS Sensor Integration, Weapons Scheduler updates, and BFTT modifications to support embedded training for the critical warfighter capability improvements.
Additionally, the modification will provide support for TAAF of FTIIP capabilities through baseline and LINK certifications. The remaining work to be executed by the PSEA DA will include implementing computer program corrections for EDRs and TORs to eliminate all Severity 1 and 2 trouble incidents discovered during land based, shipboard, and interoperability testing for SSDS MK 2 Software Builds 6, 9, 10, and 11. The delivered capability upon completion will provide all SSDS MK 2 ships Identification Friend or Foe (IFF) Mode 5 Fire Control implementation and Tactical Data Information Link (TADIL) integration with the exception of the LSD 41 and 49 Classes (LSD 41 and 49 Classes will have the Fire Control Capability only as they do not have the prerequisite CEC and Common Data Link Management System (CDLMS) equipment to support TADIL integration).
The ceiling increase and extension will provide PSEA delivered baseline support for CVN and Amphibious class ships with SSDS (CVN 68, CVN 78, LHD 7/8, LHA 6, LPD 17, LSD 41 and LSD 49). The PSEA will continue to provide systems engineering analysis in order to enhance delivered capability, reliability, and maintainability of SSDS hardware and software in the Fleet, continued software and hardware engineering to resolve identified engineering deficiencies, implementation of approved system changes, engineering support to maintain program generated capability, maintenance of the single source library and test bed environment, and engineering support to maintain technical data and configuration control until the Fleet support responsibility transitions to the Combat Systems Engineering Agent (CSEA), anticipated to be awarded in FY19.
Table 3.1 below provides a summary of the aforementioned work scope and major developmental, integration and test events to be completed under this ceiling increase and contract extension (CY17-CY20). The tasking aligns with the revised SSDS Build Plan that was approved on 27 March 2017.

4. Statutory Authority Permitting Other Than Full and Open Competition.
As described in 10 U.S.C. 2304(c)(l), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Authority.
Pursuant to 10 U.S.C. 2304(c)(l), Raytheon IDS is the only responsible source capable of providing the SSDS PSEA functions and support needed to fulfill the Navy’s requirements to complete the development and integration for CVN 78 (“CVN 78 Recovery Plan”) and the completion of FCLIP Phase 2 and FTIIP TAAF. An award to any other company will result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements.
First, this contract award is for the development of a major system or highly specialized equipment. SSDS is an inactive ACAT IC program. The functions performed by the PSEA are highly specialized because the SSDS software is highly complex. There are in excess of source lines of SSDS code divided into dozens of software components. Furthermore, there are over twelve major interfaces with other systems, which increases the complexity of implementing new hardware and migrating software to comply with OA Category 3 standards. Raytheon IDS has been the sole source provider of each of the previous evolutionary developments including the Advanced Combat Direction System (ACDS), SSDS MK 1 and SSDS MK 2 baseline upgrades. Currently, only Raytheon IDS has the experience and has retained the requisite staff experienced in ACB 12 development to understand the system and to provide PSEA functions for the baseline upgrade.
Second, award to any other company will likely result in unacceptable delays in fulfilling the agency’s requirements. The Program Office estimates that if the Government chose to award to a source other than Raytheon IDS for the requirements under this J&A, such an award would delay the completion of the development and testing of ACB 12 by approximately forty-eight
(48) to fifty-four (54) months. Much of this additional delay would result from the additional time required for: 1) Raytheon IDS to complete a CVN 78, FCLIP, and FTIIP data package describing the current SSDS baseline; 2) the Program Office to validate that data package as sufficiently accurate and detailed to permit competition of these requirements; 3) the development of new acquisition documentation and procurement documentation to include ACB-12 “to-go” work and make an award of the new competitive contract; and 4) a new awardee to develop the capabilities and expertise necessary to satisfactorily complete the required functions from that data package. More specifically, this 48-54 month delay estimate is based upon the following potential competition milestones: twelve months to complete data package development and verification; eighteen months to run a competitive procurement; and eighteen to twenty-four months from contract award for a new source to develop and deliver the SSDS Build 11 capabilities. Such delays would severely impact the Navy’s ability to deliver the current SSDS baseline in time to meet the CVN 78’s ACB 12/TI-12 Combat System Ship Qualification Test in and the preparations for Operational Testing which are scheduled at . (Note: Enclosure (1) provides the notional schedule for CVN 78 Post Delivery Test Trials (PDT&T)). If the Navy cannot meet these critical in-yard need dates, it would delay fielding these critical warfighting capabilities, which would degrade the Fleet’s ability to defend itself against attack or incur extremely expensive shipbuilder claims. Neither of these options represent acceptable delays.
In sum, this contract action is for the final development and testing support of ACB 12 by the PSEA. It is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements. Therefore, the functions required to be performed under this modification are deemed available only from the original source.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed action was synopsized in the Federal Business Opportunities (FEDBIZOPS) website in accordance with FAR Subpart 5.2, Synopses of Proposed Contract Actions on 28 February 2017. No responses from industry were received. No additional market research was conducted because it is not practicable for the reasons discussed in paragraph 5 above.
A waiver of the request for information and/or sources sought notice requirement under DFARS PGI 206.302-1 was approved for this effort by the Director of Surface Systems Contracts Division (SEA 025) on 08 May 2017 (Ser 0251/071).
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The NAVSEA contracting office will use cost and price analysis to determine a fair and reasonable price. Assistance from the Defense Contract Audit Agency (DCAA) and the Defense Contract Management Agency (DCMA) will be utilized to analyze, evaluate, and negotiate based upon detailed cost or pricing data, which will be certified by Raytheon IDS at the conclusion of negotiations. Raytheon IDS has produced similar software in the past which will provide actual cost data that will allow the Navy to negotiate a fair and reasonable contract value for this procurement.
8. Actions to Remove Barriers to Future Competition.
The Navy intends to compete the CSEA and SDA support for SSDS MK 2 as a follow-on to the current PSEA contract planned for award in 1st quarter CY19 for the period CY19-CY27.
A full and open competition for SSDS engineering and technical support required for ACB 20 is feasible based on projected industry capabilities and availability of an SSDS technical data package in FY17. The Government expects adequate competition for the CSEA requirements.
