. The

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U. S.C. 2304(c) (1 ) - Only one responsible source and no other supplies or services will satisfy agency requirements applicable IAW 6.302-l(b)(2).
5. Rationale Justifying Use of Cited Statutory Authority
Naval Surface Warfare Center , Philadelphia Division (NSWCPD) confirms that the TeamTec Incinerator model GSA500CSW MKIIB is the only model that can be acquired and installed during the upcoming PIA as a result of the following actions already taken in support of its installation and sustained use :
1. Developed a system installation integration requirements document by NSWCPD with significant input by NAVSEA and the Type Commander.
2. Developed a complete system installation drawing package by Code 280 Planning Yard.
3. Conducted an extensive l 5 t article testing.
4 . Conducted Human Health Risk Assessment of the emissions for this model only onboard USS NIMITZ (CVN- 68) and e missions met the Navy Environmental Health Center (N EHC ) and Office of t he Chief o f Naval Operations (OPNAV) requirements.
5 . Develope d a NAVSEA Technical Manual 609-8506117 Rev C and 609-8506499 Rev A.
6. Developed Engi neering Operational Sequencing Syst em (EOSS).
7. Developed Allowance Parts Lists and repair parts support.
8. Developed an electronic/hands-on training course and
Personnel Qualification Standards (PQS).
9. Developed ash removal system compatible only with this incinerator and is being installed v ia Ship Alteration 9281D during t h e PIA.
If the TeamTec GSA500CSW MKIIB Incinerator is not selected, at a minimum, the above a~t ions would need to be accomplished at an estimated cost for research and development of this major system in its entirety and would be a grave detriment to the Navy should a delay result risking the possibility that this Ship Alteration will not be scheduled , and as a result , never be accomplished .
The on-time procurement of the incinerator assembly is required to allow for timely delivery , receipt inspection , quick problem resolution , and ultimately for the accomplishment of S/A 9254D
6 . Description of Efforts Made to Solicit Offers from as Many Offerers as Practicable
It is not practicable to conduct market research for any company other than TeamTec Incinerator model GSA500CSW MKIIB to provide the required supplies due to the f a ct the ship configuration authority previously approved this model on all Nimitz class aircraft carriers. This is the only model approved by higher authority per Nimitz class ship configuration that meets the technical design , installation and upgrade pertaining to this incinerator . Pursuant to 5 . 202(a) (11) , the proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of FAR 5 . 207 .
7 . Determination of Fair and Reasonable Costs
PSNS & IMF has suffi cient cost history for this particular incinerator resulting from previous availability requirements.
Specifically, PSNS & I MF procured this incinerator on the previ ous MSMO contract N00024 - 08 - C-4416-A00501 in October 2012 in the amount o f
8. Actions to Remove Barriers to Competition
TeamTec is the only responsible source that can satisfy agency requirements and Gerard Technoiogy Associates (GTA) Marine LLC is the only authorized agent of TeamTec .. Therefore , PSNS & IMF has no plans at this time to compete future contracts for the type of s uppl ies covered by this document. If another potential source emerg~, PSNS & I MF will assess whether competition for future requirements if feasible.
