Q1. Does Berry Amendment Exception applies for this contract via Qualifying Countries.

A1. We cannot apply a blanket answer to a Berry Amendment exception question at this time.

However, if an offeror properly complies with an existing Berry Amendment exception, the

Navy will take that into account in its evaluation. The application of Berry Amendment exceptions, including any potential qualifying country exception, is contingent upon the details of an individual offeror's technical approach. While the Navy cannot apply a blanket answer to a

Berry Amendment exception question at this time, each offeror must apply its own analysis to determine whether it is compliant with the Berry Amendment and the relevant regulations --including any of the exceptions.

Q2. DOD has exception on Plates as exception I have enclosed some background information in regard to Exception. DOD has made Plates (i.e: SAPI Plates) to be exception and Exception provision via Qualifying Countries; approx 20 plus countries.

A2. Please note that DOD does not have a blanket exception for Plates, including Small Arms

Protective Inserts (SAPI). The PGI 225-7002-1 SAPI reference that is cited in your question is not a blanket exception for SAPI plates. Rather, the cited PGI 225-7002-1 SAPI reference simply provides a sample of how to apply the Berry Amendment analysis to both the end item and the individual fabric/components that are relevant in that particular example.
