About this file

This is a Class Justification and Approval (CJ&A) document for the use of other than full and open competition for a federal contract procurement.

The Naval Sea Systems Command (NAVSEA), Surface Systems Contracts Division (SEA 025), seeks to award a series of modifications under contract N00024-21-C-5322 on a sole source basis to L3Harris of Northampton, Massachusetts for the procurement of the Electro-Optical Sensor System (EOSS) MARK (MK) 20 MOD 1 and related equipment, engineering support, spares, and provisioned item orders. The EOSS MK 20 MOD 1 is an integral element of the MK 34 Gun Weapon System and consists of an above-deck, self-stabilized pedestal mounting with an electro-optical sensor suite containing a Daylight Imaging Sensor, Thermal Imaging Sensor, and Laser Range Finder, along with below-deck power supply and interface electronics units. The procurement will span fiscal years 2026 through 2028 and is estimated at a classified value. Statutory authority for sole source procurement is cited under 10 U.S.C. 3204(a)(1), with the rationale that L3Harris is the only responsible source capable of satisfying requirements without unacceptable delays. The original contract was awarded to L3Harris on April 23, 2020, under J&A 53,322, and a subsequent CJ&A 53,377 was approved on September 21, 2022 for MK 20 EOSS fiscal years 2023-2025 requirements. The Government lacks a Level 3 Technical Data Package with sufficient data rights for build-to-print competition; acquisition of such a package proved impractical due to L3Harris's unwillingness to remove certain conditions. An alternative vendor would require an estimated 79 months to manufacture and qualify the first Optical Sensor System, resulting in unacceptable delays and missed in-yard need dates for DDG-51. A sources sought notice was posted June 23, 2025 and closed July 8, 2025 with no responses received. The CJ&A was approved by the Director, Surface Systems Contracts Division on December 29, 2025, with authority expiration set for September 30, 2028.
