About this file
This is a Class Justification and Approval (CJ&A) document for other than full and open competition issued by the Naval Sea Systems Command (NAVSEA) Shipbuilding Contracts Division for a Basic Ordering Agreement (BOA) with General Dynamics Bath Iron Works (BIW).
The BOA covers Post Shakedown Availability (PSA) Class Planning and Support services for eight DDG 51 Class Destroyers (DDG 124, 126, 127, 130, 132, 134, 136, and 138) built by BIW. The services include advance planning, engineering support, on-site engineering liaison, ordering and processing materials, and supporting emergent repairs through the ships' Shipbuilding and Conversion Navy (SCN) Obligation Work Limiting Date (OWLD) of December 2031. The sole-source justification cites BIW's unique knowledge of ship configuration and construction methodology as the building yard. The requirement was synopsized on SAM.gov on November 20, 2024, with no other sources expressing interest. The contract will provide coverage from one to three months prior to ship delivery through completion of PSA for each vessel, including support for emergent industrial availabilities such as Selected Restricted Availabilities (SRAs) and other maintenance periods.

CLASS JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Shipbuilding Contracts Division
(SEA 022).
2. Description of the Action Being Approved
Award of a basic ordering agreement (BOA) on a sole source basis for the accomplishment of Post Shakedown Availability
(PSA) Class Planning and Support for eight (8) DDG 51 Class
Destroyers to General Dynamics, Bath Iron Works
Corporation (BIW), 700 Washington St, Bath, ME. Authority to act under this CJ&A expires with the Shipbuilding and
Conversion, Navy (SCN) Obligation Work Limiting Date (OWLD) of DDG 138; currently December 2031, based on the
6 March 2024 DDG 51 Class Master Planning Schedule.
3. Description of Supplies/Services
Historically, PSA Planning has been contracted via BOAs established with each DDG 51 Class shipbuilder for their respective hulls. The current PSA Planning BOAs provide coverage through DDG 122 for BIW built DDGs and coverage through DDG 125 for Huntington Ingalls
Incorporated (HII Ingalls) built DDGs.
This procurement contemplates a class of orders that will be issued under a newly established BOA for the accomplishment of PSA Class Planning Support for eight (8) DDG 51 Class
Destroyers (DDG 124, DDG 126, DDG 127, DDG 130, DDG 132, DDG 134, DDGG 136, and DDG 138) built by BIW, commencing between one and three months prior to ship delivery and concludes at the SCN Obligation and Work Limiting
Date (OWLD). The total estimated value of this contract is
, as illustrated below:
CJ&A Number: 22,108.1
Estimated Dollar Value:
FY 25 – 31 Total
SCN
Total
Orders placed under the PSA Class Planning Support BOA will provide advance planning, engineering support, on-site engineering liaison, and ordering and processing required material in support of PSAs and emergent repairs.
Emergent industrial availabilities include, but are not limited to, Selected Restricted Availabilities (SRAs), Restricted Availabilities (RAVs), Drydocking
Availabilities, and Technical Availabilities which may be required from time of ship’s delivery through the SCN
OWLD. Additionally, class configuration control, logistics support, and technical documentation is required for the resolution of class problems.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 3204(a)(1); FAR 6.302-1 (Only one responsible source and no other supplies or services will satisfy agency requirements).
5. Rationale Justifying Use of Cited Statutory Authority
In accordance with FAR 6.302-1(a)(2)(ii), the complexity of the DDG 51 Class Destroyers dictates that PSA engineering, advanced planning, and SCN-funded emergent repairs are assigned to the shipbuilder who is most knowledgeable of the ship class and the ships constructed by their respective yard. PSA Class Planning Support is provided during the period preceding the scheduled PSA start date through the scheduled PSA completion date for each respective hull. The work to be completed is based on the requirements of each individual ship at delivery and must be provided promptly in order to preclude a delay in a scheduled PSA start or completion date. The scope of work, which consists primarily of advance planning (inclusive of the ordering of material) and engineering support for the PSA, must commence prior to the date the shipyard is required to provide final drawings and related data for construction of the individual ship to
Navy. Consequently, only BIW, as the building yard for the above mentioned DDG Class Destroyers, has the adequate and unique knowledge of each ship’s delivered configuration, deferred work and incomplete changes, to competently perform
PSA Class Planning and Support for each ship built by BIW without incurring unacceptable delays to agency requirements.
Any emergent availability during the post-delivery period for a particular ship must be planned and accomplished within a relatively short time frame to avoid delays to the deployment of the ship. Given that only the shipbuilder for these DDG 51 Class ships possesses adequate data and knowledge of and familiarity with the unique detail design upon which to provide planning for a post-delivery emergent availability, adequate knowledge of the unique construction methodology used for the ship class, experience and resources necessary to quickly respond to these emergent requirements, and given the limited interval of time defined as the post-delivery period, only BIW can competently perform the planning and accomplishment of any emergent industrial availability of ships built by BIW without unacceptable delays.
HII Ingalls might be capable of providing these services;
however, to attempt to obtain these services from HII
Ingalls or any other source would not be possible without incurring delays and increased costs. The time and resources necessary to develop another source would hamper the efficient implementation of PSA planning. Award to any firm other than BIW for the above-stated requirements would result in unacceptable delays in fulfilling the agency’s requirements (i.e., ship deployment) due to inadequate long lead time support and high startup costs. For these reasons, the services required in support of these ships built by BIW within the required program schedules are only available from BIW.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
The proposed acquisition was synopsized on SAM.gov website on 20 November 2024 in accordance with FAR 5.2 and no other potential sources expressed an interest in the requirement.
Individual or classes of orders to be issued under this BOA will be published on the SAM.gov website. A waiver to the
DFARS PGI 206.302-1(d) requirement to post a sources sought notice or request for information for any justification utilizing the authority at FAR 6.302-1 was approved on
22 November 2024. No additional market research was conducted because it is not practicable, for reasons discussed in paragraph 5 above, for any company other than
BIW to provide the requirements documented herein.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Naval Sea Systems
Command, Shipbuilding Contracts Division (SEA 0223) has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSEA will assess whether competition for future requirements is feasible. The circumstances surrounding the need to obtain the required supplies/services without providing full and open competition will be reviewed annually by the Procuring
Contracting Officer (PCO). As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with
DFARS PGI 206.304(A)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
