DEPARTMENT OF THE NAVY
NAVAL SEA SYSTEMS COMMAND
1333 ISAAC HULL AVE SE
WASHINGTON NAVY YARD DC 20376-0001
IN REPLY REFER TO
J&A Number: 42,769 Code: 02433 P.R. Number: N00024-22-NR-38030
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Fleet Support Contracts Division, SEA 024.
2. Description of the Action Being Approved
Award of a contract to General Dynamics Electric Boat (GDEB) on a sole source basis, without providing for full and open competition, for non-nuclear submarine repair work under the New England Maintenance Manpower Initiative (NEMMI). This action is necessary to provide skilled craftsmen to supplement the Naval Submarine Support Facility (NSSF), located in Groton, CT. NSSF is the Navy maintenance activity that executes maintenance, repair, and overhaul on submarines homeported, or undergoing availabilities in Groton, CT, in support of returning mission ready submarines to the Fleet.
3. Description of Supplies/Services
This procurement is a follow-on to an existing requirement currently being fulfilled by GDEB under contract N00024-18-C- 4321. The requirement is to provide skilled craftsmen from a nuclear-qualified shipyard in support of returning mission-ready submarines to the Fleet. The primary scope of this maintenance, repair, and overhaul effort covers non-nuclear repair services required to support submarine modernization upgrades; ship alterations; temporary modifications and field changes; and corrective and preventative maintenance for the VIRGINIA, SEAWOLF, and LOS ANGELES class submarines assigned to the Naval Submarine Support Facility (NSSF), New London, CT. Execution of the primary scope may result in requirements for ancillary repair services to support floating dry docks, support and services craft, and other platforms and equipment assigned to NSSF New London.
The total estimated value of the contract is . The estimated number of labor hours for this effort is .
It is anticipated that the requirements will be funded using
The contemplated contract will consist of a base year commencing at time of award and four separate one-year options, for a total anticipated period of performance from to . The Government's minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 3204(a)(1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
GDEB is the only known source capable of accomplishing the requirements described in this justification based on current and historical market research. The contemplated efforts will require the contractor to provide skilled craftsmen to supplement the NSSF workforce during scheduled submarine availabilities at NSSF in Groton, CT. Market research has shown that only two nuclear qualified shipyards, GDEB and Huntington Ingalls Industries-Newport News Shipbuilding (HII- NNS), possess the highly technical and specialized research resources and workforce necessary to support the Navy's submarine repair requirements in this regard.
. GDEB is located in New London, CT, and is the only source that offers the necessary facilities and personnel within a reasonable distance from NSSF to support the requirements identified herein. HII–NNS is located in Newport News, VA, and lacks facilities or personnel in the vicinity of NSSF. Executing the required efforts outside of the immediate Groton, CT, area is not feasible as the work must be concurrent with ongoing maintenance efforts performed by the Navy civilian workforce at NSSF. Attempting to establish a source other than GDEB with highly technical and specialized research resources and workforce necessary to support the Navy's submarine repair requirements at NSSF would result in unacceptable delays to Navy mission readiness.
Furthermore, GDEB is currently, and has historically been the only contractor who has expressed interest in performing the NEMMI efforts under the contemplated contract. As discussed in paragraph (6) below, in response to market research inquiries from NAVSEA, HII-NNS confirmed that that it has no interest in pursuing this requirement. For all of the reasons enumerated herein, GDEB is the only responsible source that can satisfy the NEMMI requirements described in this document.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
NAVSEA synopsized this proposed contract via the System for Award Maintenance (SAM) website on 1 February 2021 and received an expression of interest from GDEB. Additionally, NAVSEA published a sources sought notice via SAM on 14 November 2021 and received no responses. NAVSEA subsequently conducted additional market research by inviting HII-NNS to review the proposed contract action and submit an expression of interest. HII-NNS indicated that the NEMMI contract opportunity was not of interest to the company.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. To determine reasonableness, the Contracting Officer will conduct cost and/or price analysis and seek assistance from the Regional Submarine Support Group Groton and the Supervisor of Shipbuilding Groton to analyze, evaluate, and negotiate the proposed costs for this contract. Additionally, the Contracting Officer will obtain a certificate of current cost or pricing data from the contractor at the conclusion of negotiations for any action that meets the threshold for requiring certified cost or pricing data.
8. Actions to Remove Barriers to Competition
For the reasons set forth in paragraph (5) above, NAVSEA has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, the Naval Sea Systems Command will assess whether further competition for future requirements is feasible.
As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
