About this file

This document is a Class Justification and Approval (CJ&A) for a sole source contract with Huntington Ingalls Incorporated (Ingalls) for LHA(R) Class post-delivery planning yard support. The contract will provide post-delivery planning, engineering, production, management, material procurement, and support for various industrial availabilities from CY2025 through CY2030, with a total estimated dollar value across SCN-End Cost and SCN-Post Delivery appropriations. The Navy is sole sourcing to Ingalls due to their unique qualifications, including their previous contracts for LHA 8 and LHA 9 construction, comprehensive knowledge of ship design and specifications, and pre-existing vendor relationships.

The contract will cover multiple types of post-delivery availabilities such as Industrial Post Delivery Availability (IPDA), Post-Delivery Availability (PDA), Fitting-Out Availability (FOA), Post Shakedown Availability (PSA), and others through the Ship Construction (Navy) Obligation Work Limiting Date. The Navy determined that Ingalls is the only practicable source due to their detailed knowledge of the ship's configuration, ability to quickly respond to emergent requirements, and a PEO Ships Memorandum assigning them as the planning yard. The solicitation was posted on sam.gov on 23 January 2025, with no responses received, and a waiver for the sources sought notice was approved.

DEPARTMENT OF THE NAVY

NAVAL SEA SYSTEMS COMMAND

1333 ISAAC HULL AVENUE, S.E.,

WASHINGTON NAVY YARD, DC 20376-2020

IN REPLY REFER TO

CJ&A Number: 22,057 Code: 02244

P.R. Number: 24NR57042

CLASS JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Shipbuilding Contracts Division (SEA 022).

2. Description of the Action Being Approved

Award of a class of contractual actions on a sole source basis to Huntington Ingalls Incorporated, acting through its Ingalls Shipbuilding division (“Ingalls”), 1000 Access Road, Pascagoula, MS 39567 for LHA(R) Class post-delivery planning yard support.

Authority to act under this class justification expires on 31 December 2030.

3. Description of Supplies/Services

The proposed contract actions will provide post-delivery planning, engineering, production, management, material procurement and support for planned and unplanned industrial availabilities and emergent work; as well as, the execution of the Industrial Post Delivery Availability (IPDA) and Post-Delivery Availability (PDA).

Industrial availabilities include, but are not limited to, IPDA, PDA, Fitting-Out Availability (FOA), Post Shakedown Availability (PSA, Continuous Maintenance Availabilities (CMAV), Restricted Availabilities (RAVs), Dry- docking Availabilities, and Technical Availabilities which may be required from the time of ship delivery through the Ship Construction (Navy) (SCN) Obligation Work Limiting Date (OWLD).

The anticipated period of performance (PoP) for these efforts will be from CY2025 through CY2030. The anticipated contract will consist of a base period and, if all options are exercised, work will continue through 2030.

The total estimated dollar value for this procurement is as illustrated below. This requirement will be funded with SCN and Post Delivery (PD)-SCN appropriations.

CJ&A Number: 22,057 the ship has not yet sailed away. There is another availability, called a PDA, which must be accomplished for crew training, familiarization and certifications. Emergent work is often found during this period, necessitating industrial efforts to occur.

These efforts must be done by the construction yard as the ship has not yet sailed away.

Any unplanned availability during the post-delivery period for the ships must also be scheduled and accomplished within a relatively short time frame as to not delay the deployment of the ships.

Given the limited interval of the ship's post-delivery period, Ingalls is uniquely qualified to competently perform the planning and accomplish any emergent industrial availability for LHA(R) Class due to their knowledge of the detail design and the construction methodology. Additionally, Ingalls has experience with and access to resources that are necessary to quickly respond to the emergent requirements.

Ingalls was awarded a sole source contract for the Detail Design and Construction of LHA 8 in June 2017 and for LHA 9 in October 2022. In constructing LHA 8, Ingalls has acquired a level of knowledge of the ship that cannot be duplicated. Ingalls possesses all of the construction drawings and design specifications for the Hull, Mechanical and Electrical and Combat Systems.

Ingalls also has pre-existing contractual relationships with equipment vendors that will enable them to provide reach-back, as required. Therefore, Ingalls is uniquely qualified to perform the role as Post-Delivery Planning Yard.

In addition, PEO Ships Memorandum for the Record, Ser SHIPS/142 of 22 Sep 15, assigns the LHA(R) construction yard as the planning yard through the ship’s OWLD.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

The proposed efforts addressed by this Class Justification and Approval (CJ&A) were synopsized on the sam.gov website on 23 January 2025. No responses have been received to date and none are anticipated. No market research was conducted for this effort because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Ingalls to perform the contemplated efforts. A waiver of the sources sought notice requirement at DFARS PGI 206.302-1 was approved via NAVSEA Letter Ser 0224/012 dated 25 March 2025.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The Contracting Officer will use cost and pricing analysis to determine that the final cost and price is

CJ&A Number: 22,057 fair and reasonable. The Contractor will submit cost and pricing data in accordance with FAR 15.403-4. Information from technical analysts, the Supervisor of Shipbuilding, Gulf Coast and DCAA rate analysts may also be utilized to analyze, evaluate and assist in negotiations based upon detailed cost and pricing data which will be certified by the Contractor at the conclusion of negotiations.

8. Actions to Remove Barriers to Competition

For the reasons set forth in paragraph 5, the Naval Sea Systems Command, Shipbuilding Contracts Division (SEA 022) has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, the Naval Sea Systems Command, Shipbuilding Contracts Division (SEA 022) will assess whether competition for future requirements is feasible.
