CLASS JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER

THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Shipbuilding Contracts Division (SEA 022).

2. Description of the Action Being Approved

This action will modify Contract N00024-19-C-2322 with General Dynamics Corporation, Bath Irons Works, Inc. (BIW), to accommodate an increase in engineering support requirements and additional material procurements, fabrication and kitting requirements to support post-delivery, post-shakedown, combat, and continuous maintenance availabilities, as well as Dry-dock Selected Restricted Availabilities (DSRA); primarily to support the Conventional Prompt Strike (CPS) alteration for the DDG 1000. The authority to act under this Class Justification and Approval (J&A) expires 25 December 2023.

3. Description of Supplies/Services

Engineering support requirements for the DDG 1000 Class includes 4E work specification development, Ship Installation Drawing (SID) development, Ship Change Document (SCD) development, emergent technical problem investigation and resolution, integrated logistics support, maintenance and modernization planning and other design and engineering products as required to maintain, modernize and sustain the class. Continued engineering efforts by the PY is required to support ongoing post-delivery availabilities, , and the Conventional Prompt Strike (CPS) alteration for the DDG 1000 Class, Level of effort (LOE) engineering and design efforts in support of the CPS alteration for the DDG 1000 Class is

CJ&A No. 21,770

Due to the technical complexity and stringent requirements associated with the DDG 1000 Class ships, it is estimated that the procurement of planning yard efforts from an alternate source would result in a duplication of cost to the Government of

These costs would not be expected to be recovered by competition. Substantial investment by the Navy would also be required in order to duplicate the unique program experience and knowledge held by

BIW.

In summary, BIW is the only source who can execute continued engineering requirements, LLTM fabrications, and procurements related to the Navy’s decision to introduce CPS requirements without unacceptable schedule impacts or substantial duplication of costs that is not expected to be recouped through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The requirement to issue a sources sought notice per Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 206.302-1 was waived because BIW is the only vendor that can support continued engineering support requirements and LLTM fabrications and procurements related to CPS without significant schedule impacts to the program resulting in unacceptable delays to the Navy. The sources sought waiver was approved on 24 March 2022. In accordance with FAR 5.2, a synopsis of this solicitation was posted on the SAM.gov website on 29 March 2022. No responses to the synopsis have been received to date. No additional market research was conducted because it is not practicable for the reasons discussed above for any other company other than BIW to provide the required supplies and engineering support.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer has determined that the anticipated cost to the Government for this contract action will be fair

CJ&A No. 21,770 and reasonable. Pricing assistance may be required to facilitate analysis of costs proposed by the contractor.

8. Actions taken to remove barriers to competition.

For the reasons set forth in Paragraph 5, the Naval Sea Systems Command, Shipbuilding Contracts Division (SEA 022) has no plans at this time to compete contracts for continued engineering support requirements and LLTM fabrications and procurements related to CPS.
