JUSTIFICATION AND APPROv~
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Shipbuilding Contracts Division
(SEA 022)
2. Description of the Action Being Approved
Award of contract, on a sole source basis, to Raytheon Company for planning yard interface and Life Cycle Engineering and Support (LCE&s) Services for select electronic systems in the LPD 17 Class Amphibious Transport Dock Ships.
3. Description of Supplies/Services
This procurement is for planning yard interface and LCE&S services efforts fOr LPD 17 Class Ships electronic systems.
The services include planning yard interface support, systems engineering, in-service engineering functions, obsolescence management, logistics support, training, software support, and engineering and design modifications to an LPD 17 Class baseline for follow-on ship variants.
The LPD 17 Class LCE&S contract contemplates the following types of work for select integrated electronic systems:
LPD17 Class Suppprt Activity Services including engineering services, production and PARN liaison, TYCOM/fJ.eet support, planning, logistics and engineering, homeport technical support, Class Integrated Product Data Environment (IPDE), Class Land Based Test Environment, data maintenance, equipment management, configuration management, LPD 17 class systems change development and integration and design engineering, software support, research engineering, testing, obsolescence management (both technical and logistics), LPD 17 Class material readiness support, J&A Number: 20,917 emergent repair planning, training and logistics support.
The integrated shipboard electronic support activity services are provided for in-service, post-delivery, and new construction ships.
LPD 17 Class Planning Yard support of select electronic systems including Post-delivery (post shakedown and fitting out availabilities) planning, Fleet Modernization Program planning, engineering, ship alteration development and installation, material support and management, configuration data management, research engineering, emergent work, logistics documentation, and other logistics and executing activity coordination, and management.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel (PMs317).
The contract will consist of a base period and four option years commencing when the period of performance or level of effort on the current contract, N00024-1o-c_2205, has been expended (estimated end of calendar year 2014).
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c) (1) only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Avondale Industries (now Huntington Ingalls Industries) won the initial competition to design and construct the LPD 17 Amphibious Transport Dock Ships. The competition resulted in a contract award to the prime contractor of a team, known as the Alliance, which included Raytheon Company. The LPD 17 Class program has pursued a long-term sole source relationship with the contractor that won the initial competition to design and construct LPD 17 Transport Dock Ships.
This award is considered to be a contract for follow-on services. FAR E.302-1(a) (2) (iii) states that for DOD, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition, or unacceptable delays in fulfilling the agency’s requirements The cost to the government to acquire an alternative source to perform the Lifecycle Engineering and Support Services contained in this contract would be prohibitive Notwithstanding the delay in performance (estimated at 18-24 months) that would result from such a deviation from the approved Acquisition Strategy, the disruptive impact to actually performing the work with a new contractor lacking LPD 17 class experience is estimated a.t 41% nf Phia estimated contract value,I
Successful and efficient Ese.L.&o~mancu or LCE&S services in support of the above listed LPD 17 Ship systems requires intimate familiarity with the systems. Detailed knowledge of the system configurations as well as an understanding of production techniques and practices utilized in building the systems is required to provide the support needed during the ship post delivery shakedown availability, as well as subsequent repair and overhaul availabilities The contractor must be familiar with the technical documentation for each system and be able to access and amend that -documentation via the IPDE, in order to devise a complete and accurate maintenance and modernization plan for the applicable systems and to keep the technical documentation up-to-date. As a subcontractor under the LPD 17 design and construction contract and a prime for LPD 26 and LPD 27 ISE Production, Raytheon has developed and possesses a complete set of engineering tools, products, and processes, which are integrated within the LPD 17 Class IPDE.
Raytheon’s familiarity with and continuous maintenance of these tools and processes makes it uniquely qualified to provide the life cycle support for the ship systems identified above. Additionally, the conjunctive nature of the LCE&S efforts with ISE production makes it uniquely qualified to continue the support of those systems that it desi work of the subcontractors..,e.flp.r..
__________ As a result, Raytheon is the only company qualified to provide the LCE&S services necessary to sustain the specified systems at their design performance levels in an effective and efficient manner, Particularly as commercial technology evolves across the LPD 17 Class.
The goods and services to be procured under this J&A are also consistent with the plan of action for LCE&S Services with Raytheon in AP NAVSEA 05-001 Rev 4 as well as the approved LPD 17 Program Acquisition Strategy Report (ASR) and Acquisition Plan (AP).
S. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The requirement was synopsized 15 April 2014 in the Federal Business Opportunities. No responses have been received to date. No additional market research was conducted for this effort because it is not practicable, for the reasons specified in paragraph 5 above. The Federal Business Opportunities (FBO) synopsis will function as a market survey for subcontracting opportunities.
7. - Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
J&A Number; 20,917
8. Actions to Remove Barriers to Competition
The LPD 17 Program Acquisition Plan documents the approved acquisition strategy. Full and open competition was conducted for the lead ship contract. The Acquisition Plan contemplates the award of follow-on contracts and modifications for further ship construction as well as life cycle support to the successful bidder, along with its Alliance team members, one of which is Raytheon Company.
For the reasons set forth in Paragraph 5, the Naval Sea Systems Command, Shipbuilding Contracts Division (SEA 022) has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges the contracting officer will revisit competitive opportunities as the LPD 17 class transitions completely to the life cycle support phase.
