About this file

This Simplified Acquisition Procedures Determination Memorandum for Sole Source Acquisitions documents a non-competitive procurement for operational training related to the High Power Transmit Set-Modernization (HPTS-M) on the E-6B aircraft. The training will be awarded solely to Collins Aerospace of Cedar Rapids, Iowa, who is the original equipment manufacturer (OEM) of the HPTS system. Collins Aerospace is the only vendor deemed capable of providing the specialized training due to their exclusive access to the Simulation Integration Laboratory (SIL) and extensive knowledge of the mission system's upgrade.

The procurement is being conducted under simplified acquisition procedures, with a synopsis posted on sam.gov on 22 April 2025. No competing responses were received. The training is specifically designed to ensure fleet personnel gain operational competence on the modernized HPTS system, with the training to occur during verification (VER) installation. The memorandum justifies the sole source selection based on Collins Aerospace's unique position as the OEM, their proprietary training facilities, and the highly specialized nature of the required technical training.

SIMPLIFIED ACQUISITION PROCEDURES

DETERMINATION MEMORANDUM FOR SOLE SOURCE ACQUISITIONS

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION

UNDER SIMPLIFIED ACQUISITION PROCEDURES (SAP)

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

The proposed SAP effort is for operational training during verification (VER) installation of the High Power Transmit Set-Modernization (HPTS-M) on the E-6B aircraft. This action will be awarded to Rockwell Collins, Inc., dba Collins Aerospace Government Systems (hereafter Collins Aerospace) of Cedar Rapids, Iowa. The training is required to ensure that the Fleet possesses operational competence on the HPTS-M system, as upgraded from the legacy HPTS system. This training shall occur during VER installation.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

A. _X__ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. _X__ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. _X__ OTHER REASONS.

Collins Aerospace is the OEM of the HPTS and the subsequent modernization efforts on this E- 6B mission system, for which this training is being provided. Additionally, only Collins

Aerospace has the fully integrated Simulation Integration Laboratory (SIL) that is necessary to provide hands-on training for the Fleet personnel. No other sources exist that can perform the training based on the highly specialized services which require extensive knowledge of the HPTS mission system and its upgrade; nor the facilities identified herein to support this requirement.

Based on the reasons presented above, Collins Aerospace is the only vendor that can fulfill the Government’s requirement.

A synopsis was posted on sam.gov on 22 April 2025 in accordance with FAR 5.201. No responses were received.

Specific characteristics of the material or service that limit the availability to a sole source are as follows:

ADDRESS THE FOLLOWING AND INDICATE YES OR NO YES NO

The requested material or service represents the minimum requirements of the Government

X

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, or interface with the existing system. (Explain)

The material and training addresses the HPTS-M upgrade to assist the fleet with learning the changes from Legacy to Modernization. The training is required to ensure that the Fleet possesses operational competence on the HPTS-M system, as upgraded from the legacy HPTS system. This training shall occur during VER installation.

X

A patent, copyright or proprietary data limits competition. The proprietary data is:

(Explain)

These are “direct replacements” parts/components for existing equipment.

B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.

C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.

Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

4. If appropriate, include any additional pertinent information.

IV. CERTIFICATIONS/APPROVALS:
