About this file

This document is a Justification and Approval (J&A) for the sole-source award of a firm-fixed-price contract to Armtec Countermeasures Company for the production and delivery of RR-198/AL and RR-199/AL chaff countermeasures for the Passive Radio Frequency Airborne Expendable Countermeasures (PRFAEC) program. The rationale for the sole-source award is that Armtec is the only manufacturer with the required technology, infrastructure, capacity, and timelines to meet the Navy's and Air Force's delivery requirements. The Government does not possess the technical data package or production capabilities required for these items, and it would take a new source at least 3 years to achieve the necessary product maturity. No responses were received to the sources sought notice or solicitation synopsis posted on SAM.gov. The Contracting Officer has determined the anticipated cost to be fair and reasonable. The Government will continue to pursue a technical data package that would allow for future competition, if another potential source emerges.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii)(B), the Government has deemed the requirements listed above to be available only through the original source and award to any other source would result in unacceptable delays in fulfilling the Navy’s requirements.

Armtec is the only manufacturer that possesses the technology, infrastructure and capacity to produce the RR-198/AL and Training Chaff RR-199/AL within the timeframe to meet USN deployment schedules as well as United States Air Force (USAF) requirements and other Global operations. The Government does not possess a Type 3-Dimensional (3D) Product Technical Data

Package (TDP) nor the specific processes, testing and testing equipment, program tooling, and factory tooling required for the production of the RR-198/AL and RR-199/AL. On 19 May 2023, NAVAIR requested a rough order of magnitude (ROM) from Armtec for a Type 3D Product TDP with a Government Purpose Rights (GPR) license. On 25 May 2023, Armtec provided a response, declining to provide a ROM. Armtec is capable of fulfilling the Government’s delivery requirements with first deliveries required in September 2024. There is no other contractor who can meet the U.S. Government requirements. The prior RR-198/AL and RR-199/AL contract award was not competed.

Award of this contract to any source other than Armtec would result in an unacceptable delay. A new source would require at least three years to achieve the desired product maturity in order to provide the required supplies. The unacceptable delay product maturity calculation includes two years for development and verification and one year for production readiness in preparation for a low rate production line. This estimate is based on subject matter expert analysis of historical information, including the most recent production lots. Any interruption in procurement of these items would pose critical setbacks to deployment schedules and global operations for the Joint

Strike Fighter (JSF). Based on unacceptable delays, the Government has determined that Armtec is the only responsible source capable of meeting the U.S. Government’s requirements.

The efforts described herein cannot be performed by any source other than Armtec without unacceptable delays. No other type of supplies or services beyond the RR-198/AL and RR-199/AL will satisfy the agency requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The sources sought notice required by Defense Federal Acquisition Regulation Supplement

(DFARS) Procedures, Guidance, and Information (PGI) 206.302.1 was posted on 01 June 2023 and revised on 12 January 2024. In accordance with FAR 5.201(b)(1), the proposed action was synopsized and posted on the SAM.gov website on 13 June 2023 and revised on 19 January 2024.

No responses have been received to date. Any responses received will be evaluated by the contracting officer prior to negotiations. No additional research was conducted because it is not practicable, for the reasons discussed in Paragraph 5 above, for any company other than Armtec to provide the required supplies.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this CJ&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVAIR has no plans at this time to compete the types of supplies covered by this document. The Government will continue to pursue a TDP with rights that will permit future competition. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.

As this effort is a follow-on for supplies previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior CJ&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
