About this file

This document is a Justification for Other than Full and Open Competition (CJ&A) for a planned Blanket Purchase Agreement (BOA) to provide engineering, production, test, and travel support services for the Digital Red Switch System (DRSS) upgrade on the E-6B aircraft.

The CJ&A cites 10 U.S.C. 3204(a)(1) as the statutory authority, stating that Collins Aerospace is the only responsible source able to provide the highly specialized supplies and services required, as the original equipment manufacturer and integrator for numerous E-6B mission systems. Competitive award would result in unacceptable 24-month delays for certification, facilities, tooling, and testing by another supplier. The CJ&A describes the specific systems and services covered, including the Mission Avionics Processing System, VoIP Intercommunications, power and cooling, and others. Despite posting a Sources Sought notice, only Collins Aerospace was able to demonstrate the capability to fulfill the requirement. The CJ&A concludes that the anticipated cost will be fair and reasonable, and NAVAIR has no plans to compete these services in the future unless another potential source emerges.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. § 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with FAR 6.302-1(a)(2)(ii)(B) and (iii)(B), the Government has deemed these highly specialized supplies and services are available only through the original source. Award to any other source would result in unacceptable delays in fulfilling the agency’s requirement.

Collins Aerospace is the OEM and integrator of a significant number of mission systems for the E-6B platform. These mission systems were originally competed and are now sole-source to Collins Aerospace. The supplies and services required under this CJ&A would be performed on the following systems: The Block I System (inclusive of the Mission Avionics Processing System, 13 multi-level security work stations, a Voice over Internet Protocol Intercommunications System, and associated electrical power and cooling systems), the Sustainment and Support Systems (SASS) Tech Refresh, the Very Low Frequency Transmit Terminal (VTT), the Internet Protocol Bandwidth Expansion (IPBE) Phase 4 Control Display Unit (CDU) Tech Refresh, the High Power Transmit Set (HPTS) Refurbishments, Digital Red Switch System (DRSS) Power Control System and associated Support Equipment, Drive storage solution to replace DSS, Workstation Tech Refresh, DNS Modem and Power Amplifier Tech Refresh, ARC-171 R/T and High Power Amplifier Update, C3 Modem, Block II Software Graphical User Interface (GUI) Updates, HF Tech Refresh, ARC-210 Radio Tech Refresh, ATRM Tech Refresh, TBNH Tech Refresh and GCUs. Additionally, Collins Aerospace specifically provides E-6B system specialized services such as sustaining and technical support and engineering investigations that exclusively rely upon their extensive knowledge of these mission systems.

For the supplies and services listed above, competition and award to any source other than Collins Aerospace would be an unacceptable delay by no less than 24 months for certification of the new source, stand-up of all necessary facilities for production, tooling, laboratories, and test equipment. Additionally, required certifications from NSA, DISA, and SPAWAR would provide unacceptable delays in fulfilling program requirements. Taking into consideration current E-6B readiness requirements, this level of program risk would significantly delay the delivery of Fleet products/support, reducing the operational effectiveness of this platform, and jeopardize its ability to meet USSTRATCOM mission requirements. Therefore, the efforts described herein

CJ&A No. 24-0175 cannot be performed by another source other than Collins Aerospace without unacceptable delays in meeting fleet capability and performance of the E-6B.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

As required by DFARS PGI 206.302-1, a Sources Sought Notice for the requirements that are intended to be procured under BOA task and delivery orders was posted to SAM.gov website on 2 November 2023 and closed 17 November 2023. Collins Aerospace was the only company who provided the requested information to demonstrate the ability to fulfil the Government’s requirement. Boeing Government Systems expressed interest in the Sources Sought requesting to be kept in the distribution, however did not provide a capability statement. Despite further engagement by the Government, no further communication was received from Boeing. Therefore, without Boeing providing the requested information demonstrating their ability to perform the requirement, Boeing’s response was determined unable to satisfy the requirements.

In accordance with FAR Subpart 5.201, the proposed BOA was synopsized on the SAM.gov website on 2 April, 2024. Only one response was received from a vendor interested in subcontracting opportunities and they were referred to Collins Aerospace, any future responses will be evaluated by the Procuring Contracting Officer prior to award. In accordance with FAR 5.201, orders will be individually synopsized on the SAM website. The contracting officer will evaluate any responses received prior to award of each order. Additionally, parties interested in subcontracting opportunities will be referred to Collins Aerospace to maximize competition in subcontracted efforts.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVAIR has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.

As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior CJ&As were provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
