About this file

This document is a Justification and Approval (J&A) for other than full and open competition for a contract modification under an existing contract N0001922C0045 with Rockwell Collins Incorporated, part of Collins Aerospace. The modification is to expand risk reduction non-recurring engineering efforts for a power distribution system trade study for the E-XX Very Low Frequency (VLF) Modernization program from Fiscal Year 2024 through 2026. The authority permitting other than full and open competition is based on 10 U.S.C. 3204 (a) (1), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. A sources sought notice was published on the SAM website, but no responses were received. The Contracting Officer has determined the anticipated cost to the Government will be fair and reasonable. Naval Air Systems Command has no plans at this time to compete future contracts for the types of supplies and services covered by this document, unless another potential source emerges.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A waiver of DFARS PGI 206.302-1, Sources Sought requirement was approved on 4 December 2023. In accordance with FAR Subpart 5.201, the proposed contract was synopsized on the SAM website on December 1, 2023. No responses were received. Any future responses will be evaluated by the Procuring Contracting Officer prior to award.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Collins to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For reasons set forth in paragraph 5, NAVAIR has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.
