5- Rationale Justifying Use of Cited Statutory Authority
H Ti^? 4 ?J rtrAo S ^ S i S G U r r e n t l y i n t h e p r o d u c t i o n P h a s e o f t h e P^ ra^ ' NGMS is the sole designer of the MFAS and the Government has limited rights in the technical data. The MFAS is a highly specialized pari. designed and manufactured by NGMS and the technical data required to manufacture by other than NGMS is not available. At this phase of the program, the schedule and cost to compete and qualify a new source to fulfill the MFAS requirement would result in unacceptable delays estimated at five years and as much as $M*n duplication of costs, which would not be recovered through competition Therefore, award to NGMS would avoid unacceptable delays due to the time it would take to qualify an ' alternate source. 6- Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Request for information or sources sought notice required by DFARS PGI 206.302-1 was waived bv Triton Sources Sought Memorandum AIR-2.4.2.3.
In accordance with FAR 5.201, a Presolicitation Notice for the spares requirement was posted to the Federal Business Opportunities website on 20 February 2018. To date, no responses to this announcement have been received. Any responses from interested sources will be evaluated by the Contracting Officer prior to contract award-. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than NGMS to provide the required supplies and services. In addition, no other known source produces an MFAS that can meet the Triton interface requirements.
7- Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402(a), the Contracting Officer shall purchase supplies and services from responsible sources at fair and reasonable prices. The contractor will submit certified cost and pricinq data in accordance with FAR 15.403-4. Technical analysts and contract specialists will perform analyses ofthe proposal, in conjunction with analyses from the Defense Contract Management Agency (DCMA) Defense Contract Audit Agency (DCAA) auditors, Program Management (PMA-262), and other Government Resources in accordance with FAR 15.404. The Contracting Officer will use cost and price analysis as the basis for negotiating a fair and reasonable price.

8- Actions to Remove Barriers to Future Competition.
