SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION H - SPECIAL CONTRACT REQUIREMENTS
The following have been modified:
H-10 COMMERCIAL COMPUTER SOFTWARE LICENSE AGREEMENT
(a) It is anticipated that the contractor will procure and deliver "commercial computer software" as defined by
DFARS 252.227-7014(a)(1) and the commercial computer software license agreements identified in Attachment 13 under CLINs 0002, and Options 0102, 0105, 0202, 0205, 0302, and 0305. The contractor shall ensure the following:
(1) that the license agreements are legally transferrable to the Government;
(2) that all of the licensees' rights under the license agreements will fully insure to the benefit of and be transferred to the Government;
(3) that the software and the terms of the license agreement will meet or exceed the requirements of this contract;
Open source software (OSS) is generally regarded as commercial computer software. It is sometimes licensed under terms that require the user to make freely available in source code form: (i) the user's modifications to the OSS or
(ii) any software that the user "combines" with the OSS. If the Contractor uses OSS in the performance of this contract, the Contractor must ensure that the use of the OSS complies with subsection (b) of this clause.
(b) The Contractor shall acquire the commercial computer software under the licenses customarily provided to the public, except to the extent that the licenses are inconsistent with Federal procurement law (see DFARS 227.7202-
1(a)). A list of common material terms and conditions of commercial computer software license agreements
NAVAIR has determined are inconsistent with Federal procurement law or do not otherwise satisfy user needs are incorporated into an addendum that may be executed by the Contractor when negotiating the license agreements to be delivered to the Government. The Contractor shall either execute Attachment 13 as an addendum to the license being delivered or ensure that the license being delivered to the Government complies with the list of terms and conditions on Attachment 13.
(c) The contractor shall provide copies of the license agreements within 90 calendar days of license purchase or at least 90 days prior to delivery, whichever occurs first.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
L-1 CONTENT OF PROPOSALS (SUPPLIES OR SERVICES) (JUNE 2013)
PART A GENERAL INSTRUCTIONS
1. GENERAL
Offerors are required to submit sufficient information concerning all factors to enable Government personnel to fully ascertain capabilities of the Offeror to perform the requirements. The proposal must be sufficient in detail and scope to permit evaluation and provide the evaluators a clear understanding of the Offeror’s approach, expertise, and capability as required by the solicitation. All proposals must clearly and convincingly demonstrate that the Offeror has a thorough understanding of the requirements, associated risks, and is able, willing, and competent to devote the resources necessary to meet the requirements and has valid and practical solutions for all requirements and potential risk areas. The Offerors are required to respond to all requirements of the solicitation and are not to alter or rearrange the solicitation. The burden of proof as to technical capability and price reasonableness rests with the
Offerors. The Offerors are advised that the Government may incorporate into the final contract any part of the
Offeror’s proposal deemed beneficial to the Government. With the exception of Volume 3 (Cost/Price), Volume 4
(Contract Administration), Volume 5B (Classified N00019-13-R-0060 – Book B), Volume 6B (Classified – Book
B), Small Business Considerations (Annex O), and Section J Attachments (6), (7), (16), and (17), no cost information should appear in any other Volume. Alternate proposals are not acceptable.
In presenting material in the proposal, the Offeror is advised that quality of information is more important than quantity. Clarity, brevity, and logical organization should be emphasized during proposal preparation. It is the responsibility of the Offeror to present enough information to allow the various work efforts, support, and management approaches, as well as price, to be meaningfully evaluated. Unsubstantiated statements that the prospective Offeror understands, can or will comply with the specifications, and paraphrasing the requirements or parts thereof are considered inadequate and may render a rating of unsatisfactory.
The Offeror must include any data necessary to illustrate the adequacy of the various techniques, approaches, and solutions to problems. The Offeror shall explain assumptions used to develop the proposal. Failure to clearly address a specific factor caused by a gross lack of information may be considered a combination of significant weaknesses and therefore a deficiency. There is no need to repeat information in more than one Volume if an overlap exists; the detailed information must be included in the most logical place and summarized and referenced in other areas. Unnecessarily elaborate brochures or other presentation beyond that sufficient to present a complete and effective proposal is neither necessary nor desired.
Offerors are expected to comply with all requirements of the solicitation. The Government advises Offerors that taking exception or deviation from any term or condition of the solicitation may make an offer unacceptable, and the
Offeror ineligible for award. The Government may consider any exception or deviation to any term or condition of the solicitation that is not expressly authorized by the solicitation to be a deficiency, as defined in Federal
Acquisition Regulation (FAR) 15.001. Additionally, any approach that relies on Government resources or operations (e.g. Government Furnished Property, Government Furnished Equipment, Government personnel/actions, Government Concept of Operation changes, etc.) in order to comply with a requirement, unless otherwise allowed, may be considered non-compliant and therefore a deficiency. A proposal assessed to contain a deficiency is considered unawardable.
Throughout these instructions, “Principal Subcontractors” are defined as a subcontractor who provides at least 10% of the proposed total cost (excluding the Offeror’s profit/fee), for the contract. “Joint Venture (JV) Team Members” are the entities that make up a joint venture or any other partnership or teaming arrangement that is formed for the purpose of responding to this solicitation. “Critical Subcontractors” are entities of the Offeror that perform a critical function in the performance of the resulting contract, whether it is technical or financial, and/or have important roles in any high or medium risk areas identified in the Offeror’s proposal.
2. PROPOSAL FORMAT
Proposals must be formatted using a Times New Roman 12 pt normal font (no reduction permitted), single-spaced with 1-inch margins all around, and formatted for/printed on standard 8.5 x 11 inch paper. All pages should be numbered with section and page numbers. When foldout pages are used they must not exceed 11 x 17 inches and will be counted as 1 page. Drawings may be provided separately and may be any size but should be folded to approximately 8.5 x 11 inch standard size and will count as 1 page. If the Offeror uses graphs to convey information, the graphs must show enough accuracy to easily discern the information shown. Graphs shall be presented in no smaller than a 10 pt font and shall contain a grid, which allows values to be read directly from the graph to the same accuracy that a 10 x 10 to the ½ inch grid provides. Text utilized in charts, figures, and graphics shall also be no smaller than a 10pt font and may use a font type selected by the Offeror. Each Volume or book or
Annex shall be provided separately in a 3-ring binder. Each binder shall be of an appropriate thickness for the number of pages it contains (e.g. a 30-page Book shall not be placed in a 2-inch binder).
2.1. Electronic Submission of Proposal
This section is intended to provide information to the Offeror on the electronic format and application software to be used for submitting proposals. Use of the software and procedures described in this section will reduce the amount of time and effort needed to receive and install proposals onto the electronic evaluation system, and will help ensure that the proposals received are suitable for reading electronically.
a. Electronic Proposal Media
In addition to the paper copies (discussed in Section 3), the Offeror shall submit all volumes of its proposal electronically on CD-ROM(s) compatible with the operating system and applications defined in Section
2.1.b below. The Offeror shall put as much proposal material as possible on each CD-ROM, keeping the portions of the proposal that contain pricing information on separate CD-ROM(s) from the portions of the proposal that do not contain pricing information. For this solicitation, Volume 3 (Cost/Price), Volume 4
(Contract Administration), Volume 5B (Classified N00019-13-R-0060 – Book B), Volume 6B (Classified –
Book B), Small Business Considerations (Annex O), and Section J Attachments (6), (7), (16), and (17), contain price information and shall be delivered on separate CD-ROM(s) from the remainder of the proposal. The Offeror shall submit three (3) copies of its proposal on CD-ROM. One set of CD-ROM disks shall be marked "Master." The two backup sets shall be individually packaged and marked as “set 1 or 2”. All sets of CD-ROM disks shall be clearly marked with the Offeror's name and address, the point of contact's name and phone number, and proposal volumes contained therein. The Offeror is responsible for ensuring electronic proposals are virus free in accordance with Section 2.1.d. If a discrepancy exists between the original paper copy of the proposal and the disk copy, the paper copy shall take precedence.
b. Operating System and Applications
The proposals will be accessed via Navy Marine Corp Intranet (NMCI) server network on workstations utilizing the Microsoft XP Professional Service Pack 3 Operating System. The Offeror shall submit two identical proposals in separate, paperless versions: one version in Adobe Acrobat Reader X (.pdf) and one version in Microsoft Office 2007 Applications (Microsoft Word, Microsoft Excel, and Microsoft
PowerPoint) and Microsoft Project 2007. The .pdf document must be fully searchable. The Microsoft
Office applications version may vary slightly from the page suggestions, discussed in Section 3.0, as a result of print drivers or formatting. However, the Offeror is responsible for ensuring that the .pdf and
Microsoft Office applications versions contain identical information. The Government shall have the discretion to use the information in either version, and shall not be responsible for any differences in content between the two proposal formats submitted by the Offeror. Use of other application software for submission of proposals is prohibited except where specific instructions for non-PDF or Office applications are provided. However, other applications (e.g., non-Microsoft drawing programs) can be used in proposal preparation as long as the electronic product can still be viewed by the Microsoft application as an object embedded within the document (i.e., Word, Excel, PowerPoint, or Project). The source selection network uses Microsoft Internet Explorer 7.0.
c. Hyperlinks

Procedures for accessing unclassified or classified technical data protected within SAP channels shall be coordinated with the POC identified in the DD Form 254 for Volume 6.
8. MINIMUM SECURITY QUALIFICATIONS (The following section is applicable to information provided under the DD Form 254 for Volume 6)
All classified information that needs to be submitted to address the proposal instructions shall be identified in either classified Volumes 5 or 6, identifying the Section L paragraph to which they are responding.
8.1 General
a. General. Offeror or Offeror’s subcontractors performing classified work are a United States Contractor, licensed, chartered, or incorporated in the United States, or otherwise authorized to compete in subject procurement and afforded access to proscribed information (up to and including Top Secret Special Access
Program (SAP)).
b. Offerors are advised that National Interest Determination will not be processed for this acquisition.
Security requirements as defined in DoD Contract Security Classification Specification (DD Form 254) associated with Volume 6, impose strict requirements for need-to-know access, special handling procedures, physical security measures, and administrative controls (exceeding those prescribed within the
National Industrial Security Program Operating Manual (DoD 5220.22-M)), as set forth in the following
Joint Air Force-Army-Navy (JAFAN) Manual series of publications:
1) JAFAN 6/0 – SAP Security Manual
2) JAFAN 6/3 – Protecting SAP Information within Information Systems
3) JAFAN 6/4 – SAP Tier Review Process
4) JAFAN 6/9 – Physical Security Standards for SAPs
c. Facility Clearance/Safeguarding. The Offeror must have a valid Top Secret Facility Clearance Level (FCL) clearance issued by the Defense Security Service (DSS). The Offeror must have, or be able to achieve, designated contract secure work area(s) meeting SAP Facility (SAPF) closed storage physical security safeguards, as set forth in the JAFAN 6/9 Manual. The area(s) must be formally approved in writing by the
Government Program Security Officer (PSO) prior to the Offeror conducting any SAP activities. The
Offeror’s facility must have appropriate facility security clearance and SAPF approval in place a minimum
30 days prior to beginning work on a proposal.
d. Personnel Clearance/Access. The contractor shall formally certify in writing (showing name, social security number, U.S. citizenship, personal clearance level, and clearance investigation type/date), for those requiring access to classified information. Contractor employees nominated for SAP access must be able to achieve and maintain enhanced adjudicative standards, as set forth in the JAFAN 6/4 Manual, subject to polygraph testing and be subject to the requirements for random drug testing. Nominees must have a valid need-to-know and certification that they will materially and directly contribute to the SAP. Nominees must possess a minimum of a current (within 5 years) FINAL TOP SECRET security clearance, based on a
Single Scope Background Investigation (SSBI). For SECRET SAP access a current (within 5 years)
National Agency Check (NAC) with Local Agency and Credit Check (NACLC) is required. The contractor shall provide, in paper, a copy of a completed and updated SF 86, signed and dated within 1 year, for each candidate requiring SAP access. Nominations for SAP access (current SF 86) must be received by the Government PSO a minimum 30 days prior to required access date. Nominees will be determined SAP eligible/ineligible by the Government PSO and Access Approving Authority.
e. Automated Information System (AIS) Processing. Processing of SAP data on any Offeror AIS requires prior written approval of the Government PSO. The Offeror will provide the Government PSO with the required documentation, as set forth in the JAFAN 6/3, when required to process SAP data.
f. Subcontracting. Any SAP relationship with a prospective subcontractor requires prior approval of the
Government PSO.

The Offeror’s proposal shall demonstrate its ability to conduct classified program work, at both the collateral and SAP levels.
i. Security Reviews. The Offeror shall provide copies of the last two Security Reviews from the DSS. The
Offeror shall include, at a minimum, the last two security reviews from the DSS and any Offeror responses thereto and copies of correspondence regarding corrective action taken, if any.
j. Security Verification. Because National Security is involved, the agency’s Source Selection Authority may request the Government PSO to verify any or all security information for all Offerors prior to award. Such verification shall not be deemed to be “discussions” and shall in no case allow an Offeror to revise or change its proposal. Prior to commencing classified work, the Offeror must have access to an approved facility to afford protection to sensitive information and material. Program facilities are generally approved for only one Program. “Sharing” of the facility between two Programs or the introduction of material from one Program requires a prior Memorandum of Agreement (MOA)/Co-Utilization Agreement (CUA) between all parties concerned.
k. Special Access Program Facility. The Offeror and the Offeror Subcontractors must be able to possess an accreditable Special Access Program Facility (SAPF) utilizing standards as set forth in JAFAN 6/9. If the
