JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Systems Command (NAVAIR) Headquarters
2. Description of the Action Being Approved.
IN REPLY REFER TO:
J&A_14_24097.
Amendment #1
This Justification and Approval (J&A) authorizes the award of a sole source order under Basic Ordering Agreement (BOA) N00019-12-G-0006 with the Bell-Boeing Joint Project Office. This order will be awarded for a V-22 cabin fuel line protection trade study.
3. Description of Supplies/Services.
The BOA order covered by this J&A is for a trade study for the V-22 cabin fuel line. The major components of the V-22 aircraft system to be studied are the fuel transfer pump, transfer valve and fuel lines. The trade study is required to analyze different technologies for cabin fuel line protection/mitigation from potential aircraft main cabin fuel fires, identify design changes to the V-22 aircraft system, and provide a recommendation for sustained fuel line protection that would reduce the risk of cabin fires and loss of aircraft.
See Appendix A for Estimated Dollar Value
4. Statutory Authority Permitting Other Than Full and Ooen Competition.
10 U .S.C. 2304(c)(1 ), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutorv Authority.
Bell-Boeing is the sole designer, developer, integrator and producer of the V-22 Tilt-Rotor aircraft. As such, Bell-Boeing is the only known responsible source possessing the engineering data, technical skills and requisite knowledge of the design, fabrication, performance and operational characteristics of the V-22 Tilt Rotor aircraft to perform the Trade Study efforts contemplated under this J&A.
The acquiring activity has no plan to compete future requirements for the supplies/services described in paragraph three (3) because award to any other source would cause unacceptable schedule delays in fulfilling Government requirements and result in substantial duplication of costs to the Govemment that
J&A_14_24097 Amendment #1 would not ordinarily be recovered through competition. Procurement of the subject supplies/services from another source would add delays associated with coordinating aircraft modifteations to accommodate new systems, procuring sufficient data rights and qualifying testing. Therefore, NAVAIR has determined that Bell-Boeing is the only responsible source capable of meeting the Govemmenfs needs by providing supplies and/or services within the program cost and schedule constraints.

6. Description of Efforts Made to Solicit Offers from as Many Offerors a.Practrcable •
. This BOA order was synopsized on the FEDBIZOPPS website on 5 May 2014 and any inquiries (if received) will be addressed. For the reasons discussed in paragraph 5 above, it is not practicable for any company other than the Bell Boeing Joint Project Office to provide the required trade study.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402(a), the Procuring Contracting Officer (PCO) must ensure that all supplies and support are procured at a fair and reasonable price. Analysis of the proposal will be performed by technical analysts and contract specialists, with the assistance of DCMA analysis and DCAA auditors as needed. The PCO will analyze the various cost elements that are presented in the proposal, as well as review the actuals from previous procurements if available. The PCO will use Government expertise, including DCMA, DCAA, the PMA, and other Government resources as needed, to evaluate the proposed material, labor, and subcontract positions. A detailed report developed as part of the Government evaluation will be utilized to establish a NAVAIR position.
8. Actions to Remove Barriers to Future Competition.
A pre-solicitation notice will be posted on the FEDBIZOPPS website. For the reasons set forth in paragraph 5, NAVAIR has no plans at this time to compete future contract(s) for the requirement. If other potential source(s) emerge, NAVAIR will assess whether competition for future requirements is feasible.
