JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below:
1. Identification of Agency and Contracting Activity.
Department of the Navy, Office of Naval Research (ONR).
2. Nature/Description of Action.
ONR intends to issue a sole source bridge contract to continue support services currently provided by American Technology Solutions International Corp (ATSI) under task order N00178-11-D-
6432/EE02. The bridge will provide administrative, programmatic, and financial management support services for ONR Code 34 Warfighter Performance Department. The period of performance for the bridge contract is 01 December 2019 through 31 May 2020. This bridge will also include FAR clause
52.217-8 “Option to Extend Services”, with the potential to extend services on a month-to-month basis for up to an additional six months.
3. Description of Supplies/Services.
The contractor shall provide general administrative, programmatic, financial management and technical services in support of ONR Warfighter Performance efforts. These efforts encompass the
Human & Bioengineered Systems Division, the Warfighter Protection and Applications Division, and
Senior Executive Office within ONR Code 34 Warfighter Performance Department. The period of performance for the bridge contract is 01 December 2019 through 31 May 2020. The level of effort for this bridge contract is 15 full-time equivalent contractor support personnel. The estimated value of this bridge contract including potential options to extend under FAR 52.217-8 and all other direct costs is
$2,272,900.00. This bridge contract action was reviewed and approved by the ONR Service
Requirements Review Board (SRRB) on 16 September 2019 under approval number 20-131-0.
4. Identification of Statutory Authority.
The statutory authority permitting other than full and open competition is Title 10 U.S.C.
2304(c) (1), Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by the Federal Acquisition Regulation (FAR) 6.302-1.
5. Demonstration that Nature of Acquisition Requires Use of Cited Authority.
ATSI has been successfully performing the support services currently required for this effort under task order N00178-11-D-6432/EE02 since 01 December 2014, which is set to expire 30
November 2019. There is a continuing requirement for these services pending award of a longer-term

task order. ATSI is the only source that can provide the continuing support services that ONR requires without disrupting ongoing efforts during the bridge period.
Per ONR leadership, the long-term goal is to reduce the number of service support contracts and separate Admin/Program Analyst (non-technical) support from SETA (technical) support. With this in mind, a short-term bridge contract with ATSI will allow the necessary time to provide a full and open competition for the next award. Additionally, the requirements for the follow-on award are evolving due to the recent re-organization of ONR and the ongoing current critical billet review, so additional time is needed to ensure that the follow-on contract will meet ONR’s future support requirements. The current
ATSI PWS under a contract bridge will provide the needed services until a new contract is awarded.
6. Description of Efforts to Ensure Other Potential Sources Were Sought.
Pursuant to FAR 6.302-1(d)(2), a Notice of Intent to Award a Sole Source was posted to the
Government Wide Point of Entry, www.fbo.gov, on 09 October 2019 and no responses were received.
On 30 Oct 2019, the Program Office revised the cost estimate to increase the total value by $1,400,000.
A new Notice of Intent was posted to FBO on 05 November 2019 to update the estimated total cost, including options under FAR 52.217-8, to $2,272,900.00. Responses to the notice will be reviewed prior to contract award.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer shall determine the cost to be fair and reasonable prior to award utilizing proposal analysis techniques described in FAR 15.404.
8. Description of Market Research.
Market research was not conducted for this action, because only the incumbent contractor can successfully provide continuity of services during the bridge period. In addition, a Notice of Intent to
Sole Source was posted to www.fbo.gov on 09 October 2019 and no responses were received from any other interested parties. An updated Notice of Intent was posted to FBO on 05 NOV 2019 and any responses submitted will be reviewed prior to contract award.
9. Any Other Supporting Facts.
If a bridge contact is not awarded, there will be significant impact to the day-to-day operations of
Code 34 Warfighter Performance. These include the following: inability to efficiently/accurately process the majority of PRs, retrieve proposals, and track financial commitments, obligations, and expenditures;
failure to provide well-timed financial reports, lack of resources to process CONUS/OCONUS travel and visit requests; provide timely updates to the DON human/animal test protocol database; and ensure quality administrative support to the Senior Executives.
10. Listing of Interested Sources.
A Notice of Intent to Award a Sole Source was posted to www.fbo.gov on 09 October 2019 and 05
NOV 2019. No interested sources responded.
11. Actions Taken to Remove Barriers to Competition.
http://www.fbo.gov/
ONR anticipates a six-month contract bridge will provide sufficient time to release a request for proposals (RFP) and make a competitive award for Code 34 Warfighter Performance administrative, programmatic, and financial management support. The bridge contract will allow continuous support up to the point of a new contract award. FAR clause 52.217-8 is included in the event that additional support is needed prior to completion of the procurement process for the follow-on award.
12. Statement of Delivery Requirements.
The contractor shall provide monthly status reports, ad hoc reports and presentations, and a final report as described in the statement of work for the bridge contract.
13. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation. .
A Management and Oversights Process for Acquisition of Services-Streamlined (MOPAS) has been approved for this requirement.
14. Explanation of all actions attempted to make the immediate acquisition competitive and the cost
/benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.
The requested bridge contract covers only the period-of-performance believed necessary to support this continuing requirement. Given the short duration of the bridge contract, no benefit to the
Government would be obtained by conducting a competition for the bridge, in addition to the follow-on competition.
