JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency:

The U.S. Army Corps of Engineers, Vicksburg District Contracting Office, 4155 Clay Street, Vicksburg, MS 39183-3435.

2. Description of Action:

This requirement is being procured on a sole source to basis with intent to award to Surface Systems, Inc, 2619 Tchoupitoulas Street, New Orleans, LA 70130. Their Cage Code is (1PTR8) and they are a small business. The estimated value of this action is . The purchase request and certification (PR&C) number is W807PM92777036. The work is to be completed no later than (NLT) 20 June2020.

3. Description of Supplies/Services:

The Mat Sinking Unit of the U.S. Army Corps of Engineers, Vicksburg District requires a Contractor to provide services to replace flooring in the kitchen of Quarterboat 9901 and in staterooms on its three Quarterboats (9401, 9501, and 9901).

4. Authority Cited:

Authority permitting other than full and open competition for this requirement is 10 U.S.C.

§2304(c) (3) and FAR 13.106-1(b) (1) (i).

Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, and brand-name or industrial mobilization).

5. Reason for Authority Cited:

The Mat Sinking Unit is in need of a contractor able to replace the flooring in three staterooms and in the kitchen area. The contract requirements include replacing marine underlayment and Dex-o-Tex epoxy which requires a contractor that regularly works with this product on marine vessels.

The proposed contractor, Surface Systems, Inc., is the only known contractor that is able to complete this work. According to a recent email from the manufacturer of the products, Surface Systems is the suggested contractor for our area. Surface Systems is familiar with the barge as they have performed work for the Mat Sinking Unit multiple times in recent years.

6. Efforts to Obtain Competition:

A Small business search under NAICS code 238330 in the System for Award Management populated only Dex-o-Tex.

7. Actions to Increase Competition:

Due to no other vendors being capable of performing this work, no further actions to increase competition were taken.

8. Market Research:

Market Research determined that the contractor that can support the requirement at a Fair and Reasonable price and within the required delivery date is: Surface systems, Inc., (Cage Code:

1PTR8), Small Business. Surface Systems, Inc., provided a quote for the requirement and has knowledge of the MSU and using Dex-o-Tex to install flooring on marine vessels. Upon approval, this J&A will be posted to beta.SAM.gov as a notice of intent to award sole source on or around 16 December 2019.

9. Interested Sources:

Surface Systems, Inc., is the only interested source.

10. Other Facts:

There are no other facts.
