About this file

This is a Statement of Work (SOW) for an Online Music Library contract with the National Ocean Service (NOS), a line office of the National Oceanic and Atmospheric Administration (NOAA) under the Department of Commerce.

NOAA requires a web-based music and sound effects library accessible to up to 20 named users from multiple NOAA Video Group locations, including the Communications and Education Division, NOAA Fisheries, NOAA Ocean Today, and the NOAA TV Studio. The contractor must provide unlimited downloads and unlimited use of music and sound effects during the contract term via a secure, password-protected website available 24/7/365. The government will receive non-exclusive rights to use downloaded music in various formats including non-broadcast productions, digital/online/streaming/social media (organic non-paid), broadcast television (worldwide, subject to broadcaster performance licenses), productions for sale (up to 1,200 units per production), film festival releases (up to 25 theatrical screens), and sound effects. Products will be developed in the United States but disseminated globally via public websites, museums, aquariums, film festivals, and other venues. The contractor shall submit quarterly usage reports listing downloaded titles within five business days after each quarter-end. The base contract term runs September 1, 2026 through August 31, 2027, with two optional one-year renewal periods through August 31, 2029, unless NOAA provides written notice of non-renewal. The government anticipates award of a Firm Fixed Price (FFP) contract. Upon termination or expiration, NOAA must destroy all downloaded electronic files within ten days while retaining perpetual rights to disseminate any previously incorporated music in unaltered products. The technical point of contact is Robert Levy at NOAA's Communications and Education Division in Silver Spring, Maryland.

1. BACKGROUND AND PURPOSE

The National Ocean Service (NOS) is a line office of the National Oceanic and Atmospheric Administration (NOAA), which is a bureau of the United States Department of Commerce. The mission of NOS is broad and includes a variety of technical and scientific services in support of coastal ocean natural resource stewardship and navigation support. Within NOS are program offices that are charged with carrying out the NOS mission.

The NOAA Video Studio is managed by the NOS Communications and Education Division (CED) and includes staff of the NOAA Office of Communications and External Affairs. The studio produces videos for both internal and external projects. The studio’s productions range in scope from short public service announcements to broadcast-level narrative documentaries.

NOAA Fisheries has members in Seattle Washington and Silver Spring, MD. This production group produces videos highlighting NOAA Fisheries' diverse science, technology and the Office of Law Enforcement.

The Communications and Education Division (CED) of the NOS Office of Management and Budget, NOAA Ocean Today and the NOAA TV Studio are located at NOS Headquarters in Silver Spring, MD. Collectively these groups are known as the NOAA Video Group and need access to an online audio library with Internet download. This will allow all groups the ability to use audio clips in new video and audio productions.

NOAA Communications, NOAA Fisheries, CED, NOAA Ocean Today and NOAA TV Studio do not have the staff, specifically a musician or group of musicians, to create music for its audio, video and other multimedia products. The cost of contracting musicians to create scores for each product created for its varied audiences would be prohibitive. Therefore, purchasing rights to a music library would provide NOAA with hundreds of selections to choose from, but would be far less expensive than contracting for each body of work.

Type of Order: The government anticipates award of a Firm Fixed Price (FFP) contract.

2. SCOPE OF WORK:

A music and sound effects library are required for the majority of multimedia products produced by the NOAA Video Group. The total number of products that will be created in a given year vary. For example, more than 13 videos will be produced in 2026/27 for the Ocean Today program. Each multimedia product is unique so NOAA requires a large catalog of music to make appropriate selections as needed. For purposes of this statement of work, “music” refers to musical compositions and sound recordings in the contractor’s libraries. “Libraries” refers to groupings of music such as classical, contemporary, and sound effects that are appropriate for the products listed above. The widest possible selection of music and sound effects should be available.

The element(s) of this project are (listed in no particular order):

The NOAA Video Group has a requirement for unlimited downloads and unlimited use of music and sound effects during the term of the agreement for up to 20 user accounts. The music blanket license should grant NOAA the following:

Task 1. Provide online access to a variety of music that will be used in products described above.

The contractor shall make the music and sound effects available to the government via a web site that is secure and password-protected.

The government will:

● Have the non-exclusive right, license and authority to use music and sound effects downloaded from the contractor’s libraries in the government’s products, and

● The ability to make and disseminate products incorporating this music and sound effects per the clearances outlined below.

The government requires up to twenty users for access to the vendor’s music and sound effects collection (downloaded from the Internet) at the Silver Spring, MD and Seattle, WA locations and through NOAA VPN connections for individuals working remotely from other NOAA offices creating video/audio products.

The government may continue to disseminate these products in perpetuity, even after termination or expiration of this contract, so long as the product is not altered in any way (either its audio or visual parts). Upon expiration of this agreement by either party, the government’s ability to download music from their website will terminate.

Products created using music from this library will be developed within the United States.

However, these products will be posted on public websites that can be accessed worldwide.

Additionally, products developed for the NOAA Video group will be sent to museums, aquariums, and other institutions worldwide and to film festivals and other competitions.

Productions using music from this contract must include the following clearances:

1) NON-BROADCAST - Audio, video, and digital media, corporate intranet, and closed-circuit communications. Production not for sale to the general public.

2) DIGITAL/ONLINE/STREAMING/SOCIAL (ORGANIC NON-PAID) - Free digital downloads / streaming. Does not include episodic/series productions or themes. For the purpose of this “Digital (Non-Paid)” clearance, the territory is the World.

3) BROADCAST (TV)- Programming authorized for distribution and exhibition for television broadcast on a worldwide basis, subject to each broadcaster having a valid performance license for the Works used in the Productions transmitted in each applicable territory. Does not include episodic / series productions or themes.

4) PRODUCTIONS FOR SALE - Audio, video, digital media, and download up to a cumulative total of one thousand two hundred (1,200) units per production during the Synch Term.

5) FESTIVAL AND LIMITED RELEASE - Film festival and limited theatrical release up to twenty-five (25) theatrical screens.

6) SOUND EFFECTS – access to a sound effects library applicable to the Works, subject to the same terms in the agreement.

Products requiring any clearances other than those noted above will be licensed separately from this contract.

The term for this agreement will be a one (1) year term, commencing on September 1, 2026 and ending on August 31, 2027. The agreement shall have the option to be extended for an additional two (2) years commencing on September 1, 2027 and ending on August 31, 2028 (Option Period

1) and September 1, 2028 and ending on August 31, 2029 (Option Period 2), unless NOAA notifies the contractor in writing prior to this option period ending.

Task 2. Provide monthly reports on access and downloads.

At the end of each quarter, NOAA will supply the contractor with a listing of each music title downloaded under this contract.
