1.

Description of Service

The Contractor shall furnish all personnel, equipment, labor, tools, materials, supervision, transportation and other items and services necessary to perform Instructor services for the LAAFB Youth Center at Fort MacArthur, San Pedro, California in accordance with Appendix A – Estimated Workload Schedule. The contract duration consist of one base year plus four option years (option years are awarded contingent to “satisfactory” evaluation performance).

1.1 Basic Services

The Contractor shall provide all personnel, equipment, tools. Materials, vehicles, supervision, (Except as specified in Appendix C as Government-Furnished property and services), and other items and services necessary to perform all planning, teaching, and conducting of music activity tasks and functions for the LAAFB as defined in this SOW, LAAFB includes Fort MacArthur located 20 miles south in San Pedro, California.

1.2 Programs

1.2.1 Fort MacArthur Youth Center Guitar Lessons and Band

The Contractor shall provide musical instruction approved by Youth Programs Director to assist musicians (focus on teens, all ages welcome) in developing skills for performing and improvising on the guitar or other instruments. At minimum, the instruction shall include the following:

a. Techniques for using the guitar or other instruments

b. Proper holding and use of strings for each sound as well blending the sounds.

c. After introducing the guitar, blending in the sounds of additional instruments.

1.2.2.

Summer Youth Center Day camp Music Hour The Contractor shall lead musical songs, sessions for identifying musical instruments and sounds, sessions for making music with various instruments (e.g. drums and guitar), sessions for movement (i.e. dancing or dance with hula hoops in rhythm with music), and musical games for elementary aged children classes at the Youth Center Day Camp Program.

1.2.3 Fort MacArthur Youth Center Holiday Winter/Spring Performing Ensembles:

The Contractor shall plan a performance and prepare children at the LAAFB Youth Center for the Tree Lighting Ceremony at Fort MacArthur, San Pedro, California. The

Contractor shall prepare children for Winter and Spring ensembles of voices and/or instruments for spring and winter each year featuring school-aged youth.

1.2.3 Youth Center Performing Groups:

The contractor shall lead the group in a recital after participants have received the appropriate amount of training and instruction (i.e. within a seven week time period). The performing group will practice and prepare for the performance at the Fort MacArthur Youth Center in a room to be determined to be acceptable by both the Contractor and the activity manager. If music, costuming, and props are needed, the Contractor shall submit a request for purchase to the Youth Director at least two weeks in advance, (if funding is available).

2. Performance Evaluation

Performance of a service shall be evaluated to determine whether or not (i.e. "Satisfactory" or "Unsatisfactory") it meets the performance requirements of this contract. Re-performance of unacceptable services at no additional cost is the preferred course of action when appropriate. In the case of issued Corrective Action Reports (CARs), the Contracting Officer shall take appropriate measures according to the "Inspection of Services-Fixed Price (Aug 1996)”.

3. Government Furnished Property and Services The Government will provide, without cost to the Contractor, the equipment or materials listed below and in Appendix A:

Youth Center Guitar Lessons: Workshop will be held at Youth Center facility. Individuals will provide their own instruments. The Youth Center will provide an amplifier, electric guitar, and acoustic guitar which will remain at the facility at all times and is the property of the Youth Center.

Ensemble Performing Groups: Workshops will be held at the Youth Center.

The Contractor shall complete a Government furnished property inventory AF IMT 1297 with a 61 FSS representative within 20 working days of the contract start date.

3.1 Facilities:

No smoking as allowed in Government facilities. The Contractor shall leave the facility in the same condition (or better) as received. The Contractor and its employees are prohibited from making alterations to the any facility. When storing equipment, storage areas shall be kept in an orderly and professional manner to facilitate use and minimize loss or damage of equipment.

3.1.1 Hazardous Material

The Contractor shall comply with base Hazardous Material (HAZMAT) regulations for all issues of hazardous materials, and ensure storage procedures meet all federal, state, and local requirements.

3.1.2

Utilities The Government shall furnish utility services such as water and electric for Contractor use in the performance of this SOW. The Contractor shall ensure employees conserve utilities.

3.1.3 Communications

3.1.3.1 Telephone

The Contractor shall be allowed the use of the telephone for contacting Government Officials (e.g. Contracting Officer (CO), Civil Engineers, Fire Department, Security Forces) facilitating this contract, responding to customer complaints, and any other directly contract related communications.

3.1.3.2 Communication Security (COMSEC) All DoD communications are subject to COMSEC review. Use of DoD telephones and telephone systems constitutes consent to COMSEC monitoring. The Contractor shall comply with LAAFB COMSEC procedures and rules.

3.1.4 Refuse Collection Waste generated by the Contractor in performance of the services specified with this SOW shall be deposited in Government dumpsters, excluding hazardous materials in which proper disposal instructions shall be complied with. The Contractor shall comply with base recycling regulations.

3.1.5 Emergency Medical Service

Emergency medical treatment and emergency patient transportation service is only available through the local community.

3.1.6 Security Forces

The Government will provide general security service. Security Forces phone extensions are 911 for emergencies, and 653-5787 for routine calls.

4.

General Information

4.1 Contractor Personnel

4.1.1 Contract Manager

The Contractor shall appoint a Program Manager (PM) or Contract Manager (CM) to provide quality control, and who shall represent the Contractor and be responsible for the performance of the work throughout the term of the contract. The name of this person and alternate(s) who shall act for the Contractor when the manager is absent shall be designated in writing to the CO and the QAP. The PM shall be able to speak, read, write, and understand English. The PM shall be able to effectively communicate with Contractor employees.

4.1.2 Contractor Employees

The Government reserves the right to restrict the employment, under this contract, of any Contractor employee, or prospective contractor employee who is identified as a potential threat to health, safety, security, general well-being, or the operational mission of the installation and its population. Employees shall not be allowed to work if it is apparent he/she has been consuming alcoholic beverages, or controlled substances. At no time shall an employee consume alcoholic beverages or use tobacco products in or around, the Youth center facility. Employees shall not engage in arguments or behave in an unprofessional manner during, prior, or after scheduled classes.

4.1.3 Employee Certifications/YP Training/Security Requirements The Contractor shall make sure employees have current and valid formal professional certification in musical instructions or experience before starting work under this contract. In addition, favorable background investigations must be obtained for all contractors that work with minors IAW AFI 34-144 and DoDI 6060.04. The Non Appropriate Funds Instrumentalities (NAFI) is responsible for the cost of all background investigations. If any of the required investigations return unfavorable, the contract is terminated on the spot. Child and Youth Program (CYP) Training & Curriculum Specialist will provide required Child & Youth Training as required utilizing DoD Air Force Form AF1098.

Touch Policy Appropriate Touching is based upon the Air Force Child & Youth Programs Positive Guidance & Appropriate Touch Instructional Guide as follows:

a. Recognition of the importance of physical contact in child nurturance and guidance.

b. Adult respect for personal space of children. Children always have the right to refuse these touches.

c. Responses affecting the safety and well-being of the child for example, holding the hand of a child when crossing the street; holding a child gently, but firmly during a temper tantrum.

d. Other examples of appropriate touching include hugs, holding hands, reassuring touches on the shoulder, assisting with toileting where needed for preschoolers, cleaning the genital area when diapering infants and toddlers, naptime back rubs, shaking hands, and pats on the back.

e. Children are taught through modeling and verbal guidance to use words rather than physical interaction to settle their difference with others. Touches of restraint shall be done as a last resort to prevent a child from injuring him/herself or others. In addition, touches of restraint should not be done in a humiliating or harmful way.

Inappropriate Touching Inappropriate touching involve the following depending on the severity, immediate removal from working with children for retraining or dismissal from the program:

a. Coercion or other form of exploitation of the child's lack of Knowledge.

b. Satisfaction of the adult's needs at the expense of the child.

c. Violation of laws against sex and contact between adults and children.

d. An attempt to change child behavior with adult physical force often applied in anger.

e. Example of inappropriate touching include: corporal punishment, slapping, striking or pinching, picking a child up by his/her arm, shaking, fondling, or molestation.

4.1.3.1 Employment of Government Employees The Contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, or the appearance of a conflict of interest, nor shall the Contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives proper approval. The Contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station (PCS), change in duty hours, or deployment. Military reservists and National Guard members may be subject to recall and active duty. Their absence at any time shall not constitute an excuse for nonperformance under this contract. The Contractor is prohibited from employing off-duty QAP who are managing any contract or subcontracts awarded to Contractors.

4.2 Hours of Operation

4.2.1 Normal Hours of Operation

The Contractor shall perform the services required under this contract in accordance with the estimated workload data in Appendix B of this SOW.

4.2.2

Federal Holidays

The Contractor is not required to provide services on the following federal holidays:

New Year’s Day

Martin Luther King’s Birthday

Presidents Day

Memorial Day

Independence Day

Labor Day

Columbus Day

Veterans Day

Thanksgiving Day

Christmas Day

If the federal holiday falls on a Saturday or Sunday, it may be observed on Friday or Monday as directed.

4.2.3 Performance Evaluation Meetings:

The Contracting Officer (CO) may require the contract manager to meet at least weekly with the Quality Assurance Personnel (QAP) and the Contracting Officer during the first month of the contract. Meetings will be as often as necessary thereafter as determined by the CO. However, if the Contractor requests, a meeting will be held.

4.2.4 Government Quality Assurance The Government may evaluate the Contractor's performance under this contract by inspecting each task as completed. Government personnel will record all surveillance observations.

4.2.4.1 Scope Changes

Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer.

4.3.

Safety The applicable Occupational Safety and Health Act (OSHA) standards will be mandatory for this contract. The Contractor shall comply with all Federal, State, and local laws concerning safety. The Contractor shall manage all work areas to ensure the safety of building occupants, base personnel, or visitors in or near the area. Contractor must ensure that personnel are properly trained on the equipment they are tasked to operate.

4.3.1 Insect and Rodent Control

If evidence of insect or rodent infestations is discovered, the Contractor shall immediately notify the COR or Civil Engineer service call desk at 310-363-1775.

4.3.2 Emergency Medical Service

Emergency medical treatment and emergency patient transportation service is only available through the local community.

4.3.3 Security Forces

The Government will provide general security service. Security Forces phone extensions are 911 for emergencies, and 363-2121 for routine calls.

4.4 Forms And Publications The Contractor is responsible for obtaining and maintaining all forms and publications needed to perform the contract in Appendix C.

4.4.1 Physical Security

The Contractor shall be responsible for safeguarding all Government property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured.

4.4.1.1 Dress and Appearance

Contractor personnel shall present a clean, neat and professional appearance at all times and be easily recognized as contract employees. This may be accomplished by wearing a Contractor provided badge depicting company name, employee’s name, and title. Each employee shall wear the badge on the outer clothing on the front of the body between the neck and waist so the badge is visible at all times. No item of military clothing shall be worn as an outer garment.

4.4.1.2 Employment of Government Employees

The Contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, or the appearance of a conflict of interest, nor shall the Contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives proper approval. 4.5

Phase Out

If the contracted operation reverts to in-house operations, the Contractor shall cooperate with SMC/DS personnel to ensure an orderly change over. In the event a follow-on contract is awarded to other than the incumbent, the incumbent Contractor shall cooperate to the extent required to permit an orderly transition to the successful Contractor. Recruitment notices may be placed in each facility to allow successor Contractor's access to incumbent employees.

Appendix C - Applicable Publications and Forms Publications (to include their supplements at any organizational level) and forms that apply to this SOW are listed below. The publications and forms have been coded as mandatory or advisory. The contractor is obligated to follow those publications and use those forms coded as mandatory to the extent specified in other sections of this SOW. The Contractor shall be guided by those publications or use those forms coded advisory to the extent necessary to accomplish requirements in this SOW. All publications and forms listed shall be made available by the Government at the start of the contract. Supplements or amendments to listed publications from any organizational level may be issued during the life of the contract. The Contract shall immediately implement those changes that result in a decrease or no changes in the contract price and notify the contracting officer in writing such changes. Before implementing any change by the Contractor. The contracting officer and the Contractor shall negotiate the change into the contract under the provisions of the contract clause entitled "Changes". Failure of the Contractor to submit a price proposal within 30 calendar days following receipt of the change entitles the Government to performance according to such a change at no increase in contract price (unless the time requirements is waived by the contracting officer).
