ATTACHMENT 1

STATEMENT OF WORK

PROJECT: Compressor Change for Chiller Daikin

Santa Catarina, Nuevo Leon, Mexico

March 2022

1.0 INTRODUCTION

1.1 The United States Consulate General Monterrey requires the supply and professional installation of One (1) compressor for chiller Daikin model

AWS300ADHEWNN-ER10.

1.2 Location: Prolongacion Ave. Alfonso Reyes #150 in Santa Catarina, Nuevo Leon, 66196.

1.3 Working days: Monday to Friday from 08:00 PM to 4:30 PM. Activities can interfere with regular building activities and after-hours work may be required for this job, either after 4:30 PM or during the weekend days.

1.4 Contractor must follow all working safety regulations and provide their personnel with appropriate safety equipment like gloves, security shoes, safety glasses, hearing protection, falling protection etc. The US Consulate General Monterrey is providing in Attachment 10.1 the Safety Policy which must be signed by the Contractor.

2.0 GENERAL REQUIREMENTS

2.1 The Contractor must be qualified for the job, have verifiable references and own equipment required for the job.

2.2 The Contractor shall provide the following information: personnel, equipment, materials, tools, and supervision as needed to complete the services that meet the technical requirements in this Statement of Work [SOW].

2.3 The personnel of the contractor shall be escorted all the time by Facilities workers of the US Consulate.

3.0 CONTRACT ADMINISTRATION

3.1 The Contractor shall not conduct any work that is beyond this Statement of Work and accompanying specifications unless directed in writing by the Contracting Officer [CO]. Any work done by the Contractor beyond this SOW and accompanying specifications without direction from the CO will be at the Contractor’s own risk and at no cost to the US Consulate General Monterrey and/or US Government.

3.2 The Contracting Officer shall provide a Notice to Proceed [NTP] to the Contractor.

No work shall be initiated until the NTP is issued by the CO.

3.3 The Contracting Officer may designate more than one individual to serve as the Contracting Officer’s Representative [COR]. The Contractor will be furnished evidence of COR appointments, including explicit authority delegate to each COR and their responsibilities.

3.4 The Contracting Officer has the authority to issue a temporary stop order during the execution of any phase of this SOW. This authority may be executed when the US Consulate General Monterrey requires time for official functions or is in possession of specific credible information indicating that the lives of US Consulate General Monterrey personnel are immediately threatened, and that the execution of the project will increase the US Consulate General Monterrey’s vulnerability. The Contractor shall promptly notify the CO that work has been stopped.

3.5 If any of the Contractor’s services do not conform to the contract requirements, including safety requirements, the COR may require the Contractor to perform the services again in conformity with the contract requirements. The US Consulate General Monterrey may by contract or otherwise, perform the services and charge the Contractor any cost incurred by the US Consulate General Monterrey that is directly related to the performance of such service or terminate the contract for default.

3.6 The US Consulate General Monterrey has the right to terminate this contract of convenience at any time in whole, or from time to time, if the Contracting Officer determines it is in the interest of the US Consulate General Monterrey.

4.0 RESPONSIBILITY OF THE CONTRACTOR

4.1 The Contractor shall be responsible for the professional quality, technical accuracy, and the coordination of all Work and other services furnished under this contract.

The Contractor shall, without additional compensation, correct or revise any errors or deficiencies in its repairs and other services.

4.2 The Contractor shall identify a Project Site Manager who shall be responsible for the overall management of the project and shall represent the Contractor on the site during Work. The Project Site Manager shall be approved by the COR.

4.3 The Contractor shall provide and submit to the COR Weekly Work Reports, indicating events, work accomplished, materials delivered, etcetera; reports must be provided in writing.

4.4 The Contractor shall verify that all materials, equipment, and systems provide operational dependability. The Contractor assures the completed works shall be easily maintained or replaced with readily available materials and services.

4.5 Any cost associated with services subcontracted by the Contractor shall be borne by and be the complete responsibility of the Contractor under the fixed price of this contract.

4.6 The Contractor is responsible for safety and shall comply with all local labor laws, regulations, customs, and practices pertaining to labor, and similar matters. The contractor shall promptly report all accidents resulting in lost time, disabling, or fatal injuries to the COR. The Contractor must fill and sign the Safety Plan (attachment 10.1) which must be returned and approved by A-POSHO.

4.7 The Contractor shall be and remain liable to the US American Consulate in accordance with applicable law for all damages to the US Consulate General Monterrey caused by the Contractor’s negligent performance of any of the services furnished under this contract. The rights and remedies for the US Consulate General Monterrey provided for under this contract are in addition to any other rights and remedies provided by law.

5.0 PRE-WORK REQUIREMENTS

5.1 Provide a statement that Contractor’s company and all personnel are experienced in works same type and scope required for the work.

5.2 The Contractor shall prepare and submit a Project Safety Plan [PSP] to address the project. The PSP are intended to document the entire project from beginning to end.

6.0 REQUIREMENTS

6.1 No works shall begin until approvals of the Pre-Works Submittals are accepted by the COR.

6.2 The approval of the drawings and/or materials by the Contracting Officer shall not be construed as a complete check but will indicate only that the general method of work and detailing is satisfactory. Approval of such drawings and/or materials will not relieve the Contractor of the responsibility for any error which may exist as the Contractor shall be responsible for the dimensions, design, quality, adequate connections, and details and satisfactory completion of work.

6.3 The Contractor shall be responsible for all required materials not provided by the US Consulate General Monterrey, equipment, and personnel to manage, administer, and supervise the project. All workmanship shall be of a good quality and performed in a skillful manner as determined by the COR.

6.4 All materials and equipment incorporated into the project shall be new unless noted otherwise. The Contractor shall transport and safeguard all materials and equipment required for works.

6.5 Equipment and materials shall be carefully handled, properly stored, and adequately protected to prevent damage before and during installation, in accordance with the manufacturer’s recommendations. Damaged or defective items shall be replaced.

The contractor will be responsible for security of all materials and equipment.

6.6 Receipt of Materials – Shipment of equipment, materials, and supplies shall be addressed to the Contractor – not the US Consulate General Monterrey. The

Contractor must be on hand to accept shipments; the US Consulate General Monterrey will not accept shipments.

6.7 The Contractor will be provided with a storage and staging area as determined by the COR. The Contractor shall be responsible for restoring the area to its original condition at the completion of the work. The Contractor shall be responsible for repair of any damage incurred to buildings or pavement. The Contractor is responsible for obtaining any additional off compound storage areas as required.

6.8 The Contractor shall always keep the work area free from accumulation of waste materials. Upon completing works, the Contractor shall remove all temporary facilities and leave the project site in a clean and orderly condition acceptable to the

COR.

6.9 The Contractor shall perform the work at the site during US Consulate General Monterrey‘s normal workdays hours, unless agreed upon with the COR.

6.10 At the end of each workday, or notification of a temporary stop order, the Contractor shall lower and fixed all temporary work platforms and/or harnesses. Contractor shall notify the COR of the temporary barricade locations. Beginning the next workday, the contractor shall remove the temporary barricades before continuing the project.

6.11 Cleanup – The Contractor shall keep the work area, including storage areas, free from accumulations of waste materials on a daily basis and comply with all Federal, state and local regulations pertaining to the storage, transport and disposal of wastes.

The Contractor shall not use US Consulate General Monterrey waste disposal facilities including garbage cans, trash piles or dumpsters.

7.0 STATEMENT OF WORK

The Contractor shall provide all labor (except from crane support), material, supplies, tools, equipment, and supervision necessary to complete the chiller compressor installation in accordance with the manufacturer’s most current specifications and meet or exceed best practices as recommended by manufacturer(s), National Electric Code (NEC), Building Officials and Code Administrators (BOCA), National Fire Protection Association (NFPA), Underwriters Laboratories (UL), American Society of Testing and Materials (ASTM) and other standard not specifically listed.

7.1 Supply of One (1) NEW Daikin Applied Compressor change out with the following items included:

Overall Description of work and equipment to be provided:

o Compressor model: HSA2320517YA, style: 332529262 o Materials such as gaskets, oil, filters, required for correct installation of new compressor Certified Daikin Applied Service Tech to perform installation and commissioning – correct start and continuous use of the unit for at least 72 hours

7.2 Complete mechanical and electrical disconnection of current compressor (SN: C- 111062) (damaged)

7.3 Support to move the compressor away from below the chiller and place it upon the roof in a suitable location so crane can conduct lift operations. (not from the roof to the ground, crane service by a third party)

7.4 Mechanical and electrical installation and connection of the new compressor

7.5 Charge of oil lubricant, oil filter and filter driers to circuit in service

7.6 Recharge of R-134a to circuit in service with as much as needed to make circuit functioning and in good working order (estimated amount of 90lbs)

7.7 Validation of the control conditions

7.8 Startup and first monitoring of the operation

7.9 Setup of the chiller for operation

7.10 Service report with notes and comments about service

8.0 CRITERIA

8.1 The Contractor work shall perform the work in accordance with U.S. codes and standards.

8.2 The Contractor shall provide specifications, samples, and manufacturer’s data sheets of all products used.

8.3 The Contractor must provide dedicated personnel to perform the job without interruptions, extending work completion without COR authorization could incur in penalizations.

9.0 DELIVERABLE SCHEDULE AND PERIOD OF PERFORMANCE

9.1 The Contractor shall commence work under this contract promptly, execute the work diligently, and achieve final completion and acceptance including final cleanup of the premises within 30 days from the Notice to Proceed and be completed no later than 07/11/2022. Work is to be performed during normal business hours 0800 to 1630, Monday through Friday unless approval is granted by the Contracting Officer.

10.0 PROJECT SECURITY

10.1 The work to be performed under this contract requires that the Contractor, its employees, and subcontractors shall be cleared by US Consulate General Monterrey Security. Contractor must submit personnel information for review by the US Consulate General Monterrey. Any personal deemed not qualified due to security issues, it is the Contractor’s responsibility to provide additional staff to meet the job requirements.

10.2 The Contractor shall submit this information including the work vehicle requirements within 3 days of the Notice to Proceed.

10.3 The Contractor shall be aware of the potential presence of hazardous materials, specifically lead based paint and asbestos, in any buildings located at the US Consulate. It is the responsibility of the contractor to take appropriate measures in accordance with all local, state, and federal environmental and occupational safety and health laws and regulations.

11.0 GENERAL REQUIREMENTS:

11.1 Contractor must provide at least three days before works: list of personnel with social security evidence, work plan or schedule of activities, and list of materials and tools to access the Consulate.

11.2 Contractor shall ensure that all materials and finishes provide high durability and are easy to maintain or replace.

11.3 Contractor will be entirely accountable for any damage caused by his workers and/or subcontractors, to the building and/or third parties. Contractor shall repair all adjacent areas affected by the work.

11.4 Contractor shall comply with all local laws regarding working safety regulations.

Contractor is responsible for supplying all individual and collective protective equipment for his/her employees who shall wear appropriate uniforms and badges that clearly indicate them as Contractor’s employees.

11.5 Regarding work safety, the Contractor shall provide PPEs and demand that staff and subcontractors to be worn at all times on site, such as: safety helmets, uniform, boots, pants and sleeve shirts. Others should be used as needed: gloves, respirator masks, protection glasses, hearing protection and others.

11.6 Contractor personnel must bring their own tools and all material required to perform works.

11.7 Contractor shall keep a full time Work Supervisor on site during all working hours;

Facility Senior Supervisor must be informed.

11.8 Contractor personnel must clean area of all tools, debris, and leftover materials on a daily basis before leaving.

11.9 Hazards assessment is contractor responsibility before start working, work area must be restricted with signages during activities with appropriate signage and blockage if needed; Facility personnel can provide guidance and assistance if necessary.

11.10 Works can be stopped if safety measurements are not being followed or Facility Management personnel considers people safety is compromised. COR must be informed immediately, safety issues must be corrected and validated by COR before restarting works on site.

11.11 Consulate will provide electric power and water if needed.

11.12 Facility personnel will escort contractor’s personnel during activities inside

Consulate at all times.

11.13 If the Contractor requests a document or information to the Facility Senior

Supervisor, and it is English only, the Contractor shall be responsible for translation and interpretation thereof.

11.14 Contractor shall present the Consulate with a final proposal, including all the services, estimated schedule of activities, and breakdown of total price.

Contractor will be entirely responsible for all direct and indirect expenses including, salaries, subcontractor payments, taxes, fines, materials purchase, equipment rental costs, and Personal Protective Equipment for this project. Payment will be processed after final acceptance by the Facility Senior Supervisor.

12.0 INSPECTION

12.1 Contractor shall maintain a system of quality control to ensure that the materials and services meet the requirements of this contract. The Government reserves the right, as provided herein, to inspect the Contractor's work as well as his system of QA/QC.

12.2 Contractor shall nominate a key individual responsible for work execution and quality control.

13.0 ACCEPTANCE

13.1 Acceptance of deliverable items shall be by the Facility Senior Supervisor.

Acceptance or use of documents developed under this contract shall not in any way relieve the Contractor of responsibility for the design and workmanship.

14.0 WARRANTY

14.1 The Contractor shall provide a signed warranty of sixty (60) days on labor and one

(1) year on product defects after installation is completed; including any damage to US Consulate property, defective material and improper workmanship on any material provided in this contract.
