About this file

This is an Addendum to Justification and Approval (J&A) for use of other than full and open competition issued by the United States Marine Corps Systems Command (MCSC). The addendum documents schedule delays affecting a sole-source procurement for Microwave Radio Test Sets (MRTS) from Keysight Technologies, Inc., located at 1400 Fountaingrove Parkway, Santa Rosa, CA 95403. The original J&A 25169 was signed by the Director of Contracts on March 18, 2025, approving an Indefinite-Delivery/Indefinite-Quantity (IDIQ) Firm-Fixed-Price (FFP) contract.

Contract award was delayed from Fiscal Year 2025 (FY25) to Fiscal Year 2026 (FY26) due to command-wide manpower resource assessments, administrative staffing cycles, and a 43-day federal government shutdown from October 1 through November 12, 2025. The requirement scope, total estimated value, proposed source, statutory authority, and competition justification remain unchanged. The anticipated four-year contract ordering period has been realigned from the original FY25-FY28 timeframe to FY26-FY30. The revised funding profile table reflects annual appropriations shifting one fiscal year later, with the contract ordering period potentially extending into FY30 depending on the exact award date in FY26. No additional ceiling authority or funding beyond the originally approved amount is requested. All terms, conditions, justifications, and certifications of the original J&A remain in full force and effect.

J&A Number: 25169.1

ADDENDUM TO JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

(Addendum (1))

The purpose of this addendum is to document schedule delays and the resulting revision to the anticipated contract schedule for contract action supported by J&A 25169.

Due to command-wide manpower resource assessments, administrative staffing cycles, and a subsequent federal government shutdown in late Fiscal Year 2025 (FY25), contract award was delayed from FY25 to FY26. The schedule delay did not affect the scope of the approved J&A.

The Government’s requirement to procure and service the Microwave Radio Test Sets (MRTS) remains unchanged and necessary to support Marine Corps operational requirements. The delay deferred the anticipated start of contract performance and realigned the annual funding profile and four-year ordering period with the revised award schedule. The anticipated 4-year contract ordering period is now expected to occur during FY26-FY30, rather than the previously estimated FY25-FY28 timeframe.

This revised schedule does not change the approved requirement, total estimated value, proposed source, statutory authority, competition approach, or justification for other than full and open competition. The addendum does not authorize contract award or modify the approved J&A. The J&A remains applicable to the anticipated contract action.

The following chronology outlines the procurement delay:

RFP Planning and Submission (May 2025): Following J&A approval on March 18, 2025, the program office finalized the technical requirements and acquisition planning documents for the Request for Proposal (RFP). The package was submitted to counsel for legal review in May 2025.

Conditional Approval and RFP Release (June 2025): Legal Counsel granted conditional approval of the RFP package in June 2025. The RFP was subsequently issued to Keysight Technologies later that month to obtain their sole-source proposal.

Proposal Negotiations (July – August 2025): The Government and Keysight engaged in active negotiations and technical clarifications throughout July and August 2025 to refine pricing, establish technical baselines for the calibrations and repair software, and ensure a fair and reasonable price structure.

Command Workforce Assessment (August 2025): Parallel to negotiations, senior leaders executed a command-wide workforce assessment from August 6 –7, 2025, to address critical personnel vacancies. Under this assessment, the MRTS program was identified as a Category 3 program and recommended temporary suspension to prioritize higher-need, fleet-facing portfolios.

Award submission and Staffing Conflict (September 2025): On September 3, 2025, the program office submitted the final contract award package to Counsel for legal sufficiency review. On September 4, 2025, the command formally initiated a tasker (ETMS2 Tasker DON- 250904-M3RN) to route the program suspension. Because the program’s disposition was actively being staffed, the legal review of the final contract award was held in suspension pending a final leadership determination.

Federal Government Shutdown (October – November 2025): Before the staffing could be completed, a lapse in federal appropriations resulted in a 43-day government shutdown from October 1, 2025, through November 12, 2025, halting all administrative, legal, and procurement operations.

Decision Memorandum (November 2025): Following the restart of operations, the Commander, Marine Corps Systems Command (MCSC) officially signed FY25 MCSC Manpower Assessment Determination on November 19, 2025, formally accepting the suspension/deferment of the MRTS program, with associated personnel moves becoming effective on December 1, 2025.

Re-evaluation & Re-solicitation (FY26): Following subsequent requirements re-validation, the MRTS procurement was cleared to proceed and was subsequently resolicited under the revised schedule, shifting the contract award into FY26.

The Director of Contracts signed J&A 25169 on 18 March 2025. The J&A granted approval to award a sole-source Indefinite-Delivery/Indefinite-Quantity (IDIQ), Firm-Fixed-Price (FFP) contract for the MRTS to Keysight Technologies, Inc (Keysight Technologies), 1400 Fountaingrove Parkway, Santa Rosa, CA 95403.

Below is an updated version of Table 1, Funding Profile, in Paragraph 3 of approved J&A 25169. The table reflects the revised anticipated four-year contract ordering period and associated annual funding profile:

Original Table 1 Funding Profile changes from:

Appropriation FY25 FY26 FY27 FY28 Total

To:

Appropriation FY26 FY27 FY28 FY29 Total

The contract ordering period will extend to FY30, depending on the exact date of award in FY26.

No additional ceiling authority or funding is requested beyond the originally approved

All terms, conditions, justifications, and certifications of J&A 25169 remain in full force and effect.
