About this file

This document is a Justification and Approval (J&A) for a sole source award of a 5-year requirements contract to General Dynamics Land Systems (GDLS) for M10 Booker Non-Provisioned Spares in support of the initial fielding of the M10 Booker Combat Vehicle. The contract will provide Authorized Stockage List (ASL), Spares Acquisition Integrated with Production (SAIP), Special Tools and Test Equipment (STTE), and Test, Measurement, and Diagnostic Equipment (TMDE) for the Booker Vehicles. The award is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1(a)(2)(ii)(B) due to unacceptable delays that would result from a competitive acquisition, as the government does not currently have the necessary technical data package to enable competition. The contract was awarded to GDLS on September 20, 2024 under Solicitation Number W912CH24D0026 for an unknown amount.

The Spares in Support of Initial Fielding are defined as follows:

a. ASL: ASLs will provide the fielded M10 Booker units with the spare parts necessary to initially sustain the vehicles during fielding. The ASL consists of spare parts authorized to be stocked with each unit to ensure the readiness of the vehicles.

b. SAIP: SAIP will provide Booker Vehicles with replenishment spare parts concurrent with parts being produced for the end-items. These spare parts are needed to prime the supply pipeline with the initial stock of spare parts needed to sustain the Booker Vehicles during its initial operational period until requirements can be forecasted based on actual demands and appropriately provisioned.

c. STTE: Special tools will provide Booker Vehicles with required capabilities at the field level of maintenance beyond those found in the Army’s common sets, kits, outfits, and tools. Special tools and special tool kits are end-item specific and cannot be used on any other platform. They are designed to perform a specific task for use on a specific end-item or component of an end-item.

d. TMDE: TMDE will provide Booker Vehicles with a system or device used to evaluate the operational condition of an end-item or subsystem thereof to identify and isolate any actual or potential malfunction. TMDE includes diagnostic, prognostic equipment, semiautomatic test equipment and automated test equipment, to include test program set and calibration test or measurement equipment.

4. Authority Cited: The statutory authority permitting other than full and open competition for this action is 10 United States Code (U.S.C.) 3204(a)(1), as implemented under Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements,” specifically, FAR 6.302-1(a)(2)(ii)(B), “Unacceptable delays in fulfilling the agency’s requirements.”

5. Reason for Authority Cited: This requirement cannot be satisfied through full and open competition. The competitive acquisition processes will not support an award to any source other than GDLS because the USG does not have the pertinent technical data package (TDP) delivered and approved to enable competitive procurement. A competitive award will result in unacceptable delays in fulfilling the agency’s requirements.

a) Unacceptable Delay:

Event Competitive (months) Reference Technical Data Packages (TDP) 21 months 5.i Provisioning 36-48 months 5.ii solution to avoid further delay and support the program’s current fielding schedule.

Finally, ACC-DTA awarded the Fielding Agile Supplies, Support, and Training (FASST) requirement on 22 September 2022 as a Multiple Award IDIQ to 10 vendors. Although the requirement for M10 Booker initial fielding spares could potentially be procured under the FASST contract and competed among the multiple award vendors, the M10 Booker TDP will not be under USG configuration control . The completed TDP/drawings are required for the USG to compete a requirement under the FAAST contract. Delaying the acquisition until the receipt of the final/complete Booker Vechicle TDP in would create schedule delays that are outlined in Section 5 of this document.

6. Efforts to Obtain Competition:

a. Effective competition: For reasons stated in sections 5 and 8, ACC-DTA and Product Manager (PdM) Booker do not anticipate effective competition for this acquisition beyond GDLS. The USG is taking action to increase competition as described in section 7, Actions to Increase Competition, below. Notices required by FAR 5.201, Publicizing Contract Actions, will be published and any bids or proposals received shall be considered.

b. Subcontracting competition: All appropriate Small Business Subcontracting clauses will be included in the solicitation and contract award.

7. Actions to Increase Competition: Although no action to increase competition is contemplated at this time, the USG will continue to survey the marketplace and review its approach should additional information be received. Any information received will be considered to determine if a competitive acquisition should be conducted or to determine potential future requirements. At a minimum, the USG will determine if, in the future, the USG possesses the necessary technical data with sufficient Intellectual Property (IP) rights to compete the spare parts requirements under a future contract.

Additionally, once the vehicle is provisioned, DLA will procure through normal procurement practices established by its agency and the parts will be available to the federal supply system.

8. Market Research: ACC-DTA posted a Sources Sought Market Survey for Booker Vehicle Spare Parts to Sam.gov on 22 November 2022. The market survey aimed at obtaining information on industry capability and interest in providing Booker Vehicle spare parts to support initial fielding of the M10 Booker Vehicle platform. The market survey closed on 7 December 2022. Only GDLS responded.

The market survey asked interested sources to state what spare parts, inventorying, and warehousing it has provided for the USG. The GDLS response demonstrated experience providing non-provisioned items for major system fielding and centralized inventory management, obsolescence management, and warehouse management, OPSEC Program Schedule

OPSEC Program Schedule accomplishing the USG objectives. Based on the market research/survey results, GDLS was the only respondent and the only contractor to demonstrate the knowledge, technical data, and resources necessary to produce and perform the projected requirements of the proposed contract.

9. Interested Sources: To date, no other sources have expressed interest in this type of acquisition. The USG will evaluate any responses to the synopsis.

The USG will consider these rights as a factor in the down-select to use, modify, reproduce, release, perform, display or disclose acquired information.

Explanation of results: The contract with GDLS includes option prices for data and patent rights. . The USG will determine if, in the future, the USG possesses the necessary technical data with sufficient IP rights to compete the spare parts requirements under a future contract.

5) No prior contract for this requirement was accomplishing using full and open competition. This requirement is for Spare Parts while the previous J&A was for LRIP and STS services.
