About this file

This is a Sole Source Procurement Request form submitted by the Colorado Division of Criminal Justice, Office of Community Corrections (OCC) for the purchase of Mpathic software from vendor Empathy Rocks, Inc. The OCC seeks to procure software that enables direct audio upload, automated transcription, and partial scoring capabilities aligned with Motivational Interviewing Treatment Integrity (MITI) and Motivational Interviewing Competency Assessment (MICA) criteria. Currently, community corrections facility staff submit audio recordings that OCC personnel manually transcribe and score; the proposed Mpathic solution would automate these processes and reduce the feedback turnaround time from approximately 21 days to 5-7 business days, thereby enabling more frequent staff coaching and supporting continued skill development. The approval period runs from November 1, 2026 through June 30, 2028, representing a two-year non-renewable procurement period.

The total estimated cost for this procurement is $100,000, allocated at $50,000 per year for two years. No price reasonableness analysis, catalog price comparison, or historical price comparison was conducted by the agency. The OCC justifies the sole-source status on the basis that Mpathic is the only evaluated solution that integrates all required capabilities in a single platform; competing transcription tools lack MITI/MICA scoring capabilities, while standalone scoring tools require separate manual transcription and lack the required end-to-end workflow. The procurement has been previously approved through the Office of Information Technology (OIT) vetting process and will be funded through SIPA Government Grant funds awarded to the Office of Community Corrections. The sole-source determination was approved and signed by Valarie Schamper on October 14, 2026, with NPSS1 Number RDAA 2027*075.

Sole Source Request § 24-103-205, C.R.S.

A sole source procurement is justified when there is only one good or service that can reasonably meet the need and there is only one vendor who can provide the good or service. A requirement for a particular proprietary item (i.e., a brand name specification) does not justify a sole source procurement if there is more than one potential bidder or offeror for that item. Note: All sole source requests will be posted on an electronic procurement system in accordance with §24-106-103(5) C.R.S.

SECTION C – Description of Goods/Services

The OCC requests approval to purchase Mpathic software through a sole-source procurement to support communication-fidelity auditing and staff coaching. Currently community corrections facility staff submit audio recordings made with handheld recorders which OCC staff must manually transcribe and score. Mpathic would allow direct upload, automated transcription, and partial scoring under the applicable Motivational Interviewing Treatment Integrity (MITI) or Motivational Interviewing Competency Assessment (MICA) criteria, reducing staff effort.

These capabilities are expected to reduce the time required to provide actionable feedback from approximately 21 days to 5–7 business days, enabling more frequent coaching and supporting continued staff skill development

identifying this as a sole source?

OCC is requesting a sole-source procurement because Mpathic is the only evaluated solution identified by OCC that combines all required capabilities in one integrated platform: direct audio upload, automated transcription, partial scoring aligned with both MITI and MICA, and a workflow for reviewing results and delivering coaching feedback. Each capability is necessary to support OCC’s existing auditing process and required turnaround time. General transcription tools do not apply MITI or MICA criteria, while standalone fidelity-scoring tools require separate manual transcription and lack the required end-to-end workflow. Combining multiple products would add manual steps, system coordination, and staff time and would not provide the same integrated process or expected efficiency.

Based on OCC’s and OIT's documented evaluation of available solutions, no other identified vendor meets all mandatory requirements in a single solution. Mpathic is therefore the only evaluated source capable of providing the functionality required for OCC’s communication-fidelity auditing and staff-coaching needs and achieving the expected reduction in turnaround while meeting OIT's stringent security requirements

The purchase of this software has been previously approved through the OIT vetting process and will be paid for from grant funds through SIPA Government Grant which has been awarded to Office of Community Corrections.
