About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for tire maintenance services at the Military Ocean Terminal Sunny Point (MOTSU) in Southport, NC. The U.S. Army Contracting Command - Rock Island Arsenal (ACC-RI) is seeking to award a sole-source contract to McCarthy Tire Service Company for tire maintenance and related services for the 596th Transportation Brigade. The contract will cover tire maintenance for 31 bomb carts/31-yard trucks, including tire inspection, rotation, repair, and replacement, with foam filling capabilities.

The contract period spans from 01 May 2025 to 30 April 2029, with a base year and three one-year options. Market research confirmed McCarthy Tire Service as the only qualified vendor, with unique capabilities including specialized tire service lift trucks, foam filling equipment, and a storage location within 50 miles of the customer. The total contract value is not fully disclosed, but the government determined that awarding to any other source would result in substantial duplication of costs and potentially negatively impact mission readiness. The incumbent has previously demonstrated 100% completion of performance objectives under the existing contract.

Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: As described in 6.302-1(a)(2)(ii)(A), Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued tire service of critical material handling equipment, container handling equipment and non-tactical emergence equipment in support of the ammunition cargo mission providing support to the War-Fighter. Movement, loading and offloading ammunition containers safety with highly specialized equipment, including tire lift truck, when it is likely that award to any other source would result in a break in service that would negatively impact on the readiness of equipment and operational effectiveness.

(A) Substantial duplication of costs to the Government is not expected to be recovered through competition that an equal item must meet to be acceptable for award. These authorities are cited for the following reasons:

a. Essential equipment and supplies required:

1) Tire Service lift truck

The level of expertise drivers need to support the mission, specifically regarding the operation of these trucks and the handling of these oversized tires.

2) Foam Filling equipment (foam tanks and pumps)

Personnel require specific expertise to operate the equipment necessary for filling these oversized tires with foam, a critical component of the mission.

3) Storage location for tires required within a 2-hour drive to meet deliverable time frame

(B) McCarthy Tire Service (McCarthy) has demonstrated competence under their current contract and met all requirements of the performance work statement (PWS) and the deliverables. McCarthy has expertise, the foam filling equipment with expertise, and storage facilities within 50 miles of customers location which shortens delivery time. Within the current contract, they have handled tire maintenance on forklifts, off-the-road (OTR), material handling equipment/container handling equipment/construction equipment. McCarthy successfully met all contract requirements, achieving 100% completion of Performance Objectives and Deliverables as specified in the PWS.

6. Efforts to Obtain Competition: In accordance with FAR 5.201, ACC-RI will synopsize this action. This is a sole source action, effective competition is not

applicable. There are no subcontracting opportunities associated with this requirement for competition. The Government intends to post a Notice of Intent to SAM to notify industry the requirement will be sole sourced under FAR 6.302-1(a)(2)(ii)(A), only one responsible source and no other supplies or services will satisfy agency requirements.

7. Actions to Increase Competition: The Government will continue to explore other options to meet the U.S. Armys ever-changing mission. Future market research may identify new sources that can provide the U.S. Army with the equipment it needs for mission success. ACC-RI will conduct market research in support of future acquisitions of this requirement to determine if another supplier becomes available with the goal of competing future requirements, if possible.

8. Market Research: In accordance with Federal Acquisition Regulation (FAR) Parts 10, Market Research; 11, Describing Agency Needs; and 12, Acquisition of Commercial Items, which describes the policies and procedures for conducting market research to determine the most suitable approach to acquiring, distributing, and supporting supplies and services. This part implements requirements of 41 U.S.C. 253a (a) (1), 41 U.S.C.

3307, and 10 U.S.C. 2377. In accordance with DFARS 205.205-71, DFARS 206.302- 1(d), and DFARS PGI 206.302-1(d), ACC-RI posted a sources sought notice on the SAM.gov website on 28 April 2025 through 30 April 2025 for these services at MOTSU, to which one interested vendor replied, However, . did not respond to further contact about their ability to perform the requirement.
