What is a Pre-Grant Publication (PGPub)

• The purpose of a patent: Provides exclusive rights in exchange for public disclosure.

• Before November 2000: Patent applications were only published when the patent was granted, which significantly delayed the benefit to the public of learning about new inventions.

• Since November 2000: The USPTO publishes the content of an application

18-months after the effective filing date. These documents are called ‘Pre-

Grant Publications’ (PgPubs).

PGPub data

Primary PGPub data files (used internally and externally):

– Yellow Book (TIFF images of publication document pages – WIPO ST.33)

– Red Book XML (XML ‘text’ representation of publication document - WIPO ST.36)

Next-Gen PgPub Process

Application completes Pre-Examination

(Perfected) & is eligible for publication

(Receives Projected Publication Date)

Initialization

Real-time data retrieval from internal USPTO systems (CMS, OPSG, CPC); & Automated

Validation

Publication Files Transmitted when

Ready (Redbook XML, Yellowbook images, metadata files)

~ 9 Weeks

Application Filing (Electronically or Paper

Submission)

Front End Processing (Scanning, Indexing &

QC)

Integrated Iterative Quality Check/Inspection

Q1. What capabilities do you have in unstructured data conversion? (i.e.

can you convert text and embedded objects into other formats)

A1. We have partnered with a plurality of entities over the last 10 years to convert PDF and TIFF documents into XML, including the automated identification, extraction, and transformation of chemistry and mathematical formulas into SVG. We also have in-house capability to perform automated OCR on documents and review XML outputs.

Q2. What capabilities do you have in categorization/classification of unstructured data? (i.e. can you recognize what an object is as in math, chemistry, special character, foreign language characters, etc.)

A2. While we can recognize non-text objects, we do not yet have the reliable sophistication to categorize those objects by type, but it is one of the goals we strive to obtain.

Q&A

Q3. Do you have capabilities for the bulk review of documents to verify data entry?

A3. Most of our data entry is automated today. However, there are certain business process that do not support automation at this time and solutions to this shortcoming is a goal we’re looking to accomplish.

Q4. Do you have familiarity with XML and its use in complex document processing?

A4. We are quite familiar with XML and complex document processing. While we have not been generating XML independently for all that long, we have made major advances recently and are looking to continue leveraging this skill to improve USPTO data reliability during patent application lifecycles.
