Task/Delivery Order Number: GS-00F-008DA/DJO-BJA-16-G-0201
LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM
Upon the basis of the following justification, I, Joy Garrett-Bey, as Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(C). This acquisition is conducted under the authority of the Multiple-Award Schedule Program (FAR 8.401).
1. Identification of the agency and the contracting activity.
Requiring Activity: U.S. Department of Justice (DOJ), Office of Justice Programs (OJP) Office of the Bureau of Justice Assistance (BJA) 810 7th Street NW Washington DC 20531.
Contracting Activity: U.S. Department of Justice (DOJ), Office of Administration (OA), Acquisition Management Division (AMD), 810 7th Street NW Washington DC 20531.
2. Nature and/or description of the action being approved.
This is a Limited Sources Justification (LSJ) to support the award of new work as a logical follow-on of the requirement for contractor to support the operation of the Bureau of Justice Assistance National Training and Technical Assistance Center (BJA NTTAC). This action would expand the work of the BJA NTTAC to meet a critical and emergent need to provide training and technical assistance to communities to address community understanding of public safety topics.
BJA has requested one modification to task 5.2: Facilitation of special TTA projects that involve multidisciplinary teams of stakeholders to support BJA in identifying and assessing needs of emerging and critical needs: Plan for and execute up to 3 meetings of criminal justice stakeholders on special topics annually under the BJA NTTAC Contract. This change is being requested to increase the level of effort an existing task, but will not result in a change in scope.
The purpose of this task is for the Contractor to coordinate the delivery of special TTA projects that may involve teams of stakeholders including BJA staff, TTA providers, other subject matter experts, and state, local, or tribal criminal justice stakeholders. The purpose of sub-task 5.2 is to plan meetings for BJA to explore emerging issues with experts from across the country, identify best practices, and develop a plan of action for next steps. The current scope allows for up to 3 meetings of 50 people each.
Due to Department of Justice priorities, BJA is seeking to increase initiatives under the current task. On February 27, 2017, Attorney General Jeff Sessions sent a memo to all Heads of Department Components within the U.S. Department of Justice. The memo established the Attorney General’s Task Force of Crime Reduction and Public Safety. This is federal task force that is chaired by the Deputy Attorney General and includes representatives from relevant U.S. Department of Justice Department offices and divisions. The memo requires that the Task Force consult with Federal, State, tribal, and local entities in furtherance of its mission. As part of this consultation process, the Task Force will convene a National Summit on Crime Reduction and Public Safety that will bring together representatives of Federal, State, tribal, and local law enforcement, as well as victims’ and community advocacy organizations, among others, to learn about successful local efforts and how they can best be supported at the Federal Level. Per the memo, it is required that the National Summit on Crime Reduction and Public Safety occur within 120 days of the date of the memo (by June 27, 2017). OJP Acting Assistant Attorney General and BJA Acting Director have identified BJA NTTAC as the best contract vehicle to deliver on logistics for the National Summit on Crime Reduction and Public Safety. The proposed National Summit on Crime Reduction and Public Safety aligns with existing Task 5.2 activities, but the level of effort related to this specific activity is greater than the current level of effort planned.
Competition for the establishment of the BJA NTTAC was sought via the Federal Supply Schedule (FSS), General Services Administration (GSA) and a Task Order awarded Booz, Allen Hamilton, Inc. of McLean, VA., hereto after known as Booz Allen. The Task Order was issued against GSA Schedule Contract GS-00F- 008DA/DJO-BJA-16-G-0201 under MOBIS Federal Supply Schedule SIN 874-1 Consulting Services.
The DOJ intends to award a modification to the current task order as a logical follow-on to Booz Allen under GS-00F-008DA GSA Schedule to provide for support needed to conduct the National Summit on Crime Reduction and Public Safety. This work is a logical follow-on and the action and will result in an increase in the task order ceiling in the amount of $349,930.93 in the Base Period.
The following activities and deliverables are expected to support the National Summit on Crime Reduction and Public Safety:
Identify space for an estimated 300-400 person Summit to include plenary sessions and breakout sessions, as well as sleeping rooms at the government rate for up to 200 participants.
Coordinate all logistical arrangements including registration, A/V, hotel set-up, and other tasks necessary for a successful meeting.
The Contractor may be asked to consult with a DOJ planning committee for the Summit to include officials from the Task Force to develop the agenda, identify invitees, and develop materials for distribution.
Onsite Summit logistics support that may be needed include onsite logistics staff to handle coordination with hotel staff and VIP attendees, a Summit app, facilitation for breakout sessions, professional note taking services, and video recording services.
Work with relevant subject matter experts to prepare for a post-Summit report that summarizes the findings and recommendations discussed at the Summit to share with the Task Force members.
3. A complete description of the supplies and/or services required to meet the agency’s needs
On August 31, 2016, a Task Order was competitively awarded under the authority of FAR 8.404 to Booz, Allen, Hamilton Incorporated of McLean, VA against GSA Schedule GS-00F-008DA. The Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, required a contractor to operate and manage the BJA NTTAC. Task 5.2 required the facilitation of special TTA projects that involve multidisciplinary teams of stakeholders to support BJA in identifying and assessing needs of emerging and critical needs. These tasks describe exactly the scope of work needed to support the National Summit on Crime Reduction and Public Safety.
4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor’s unique qualifications to provide the required supply or service.
The tasks incorporated in Task Order DJO-BJA-16-G-0201 support the operation of the BJA NTTAC. Booz Allen Hamilton has developed the expertise and business protocols to successfully complete these tasks without delay. Further, the work specific to the National Summit on Crime Reduction and Public Safety is a logical follow on to current BJA NTTAC work, which focuses on providing training and technical assistance to law enforcement agencies.
Under FAR 8.405-6(a)(1)(i)(C) this logical follow-on work is permissible because the original task order was placed in accordance with FSS procedures. In the interest of economy and efficiency these funds are being added to the BJA NTTAC Contract because the tasks fall under the scope of the existing contract and under the contract BJA has invested funds in developing, and perfecting the exact technical assistance provision required to support the National Summit on Crime Reduction and Public Safety. Thus, funding the BJA NTTAC task order to use those procedures and mechanisms is the most efficient and most economical way for the government to achieve the goal of providing timely, expert assistance to conduct the National Summit on Crime
Reduction and Public Safety. The new work is a logical follow on to an original FSS order and was placed in accordance with FSS procedures and was not issued under sole source or limited sources procedures.
5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
The total increase in the task order ceiling to accommodate this work, which is all to commence and cease in the Base Period of Performance, is $349,930.93 In accordance with FAR Subpart 8.404(d) GSA has already determined the price of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d).
The Time & Material price for these deliverables will be provided under the GSA Schedule. At a minimum the price will be determined fair and reasonable via the use of price analysis based on the comparison to prior engagements of similar size and scope, and comparing the price to the Independent Government Cost Estimate (IGCE), which will be documented in the Award Summary in the file. Based on this price analysis, the anticipated price represents the best value to the Government.
After considering the level of effort and the mix of skills available for the tasks needed, the Contracting Officer has determined that proposed order represents a reasonable total price and represents the best value for the Department of Justice.
6. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS.
Market Research was not conducted because a new competition would be impracticable. This requirement is suited to a logical follow-on in accordance with FAR 8.405-6(a)(1)(i)(C) as awarding to another source is likely to result in the disruption of the development of the Department’s response to a critical, emergent need for TTA to support the National Summit on Crime Reduction and Public Safety.
Through work on the original Task Order Booz Allen has gained a unique insight and working knowledge of the BJA NTTAC. Additionally, Booz Allen has extensive experience developing and deploying a training and technical assistance event in a manner most beneficial to the localities being served and most cost effective to the federal government.
Awarding to a Contractor other than Booz Allen could result in substantial duplication of effort and costs to the Government and would cause unacceptable delays. These costs would not expect to be recovered through competition. The Government has chosen to minimize its risk for the successful completion of the requirement by determining a logical follow-on to the original Task Order would be in the best interest of the Government.
7. Any other facts supporting the limited source justification.
Booz Allen is currently providing support under Task Order GS-00F-008DA with the Statement of Work entitled BJA NTTAC. The Statement of Work for Task Order GS-00F-008DA presumed that the Government knew at the time the Statement was developed all the categories under which TTA would need to be provided through the BJA NTTAC. However, critical needs have since emerged that the BJA NTTAC is the most effective operation to address this requirement. Booz Allen possesses the specific knowledge required to perform this additional task successfully as a follow-on requirement to what was originally competed.
Based on the Cost Proposal submitted by Booz Allen to support the work of under the original Task Order, the funds required to establish the National Summit on Crime Reduction and Public Safety under Task 5.2 outlined above would require a substantial investment of time and money. Using the Base Year Cost proposal as a guide, I estimate that establishing a new entity to recreate the structures and staffing necessary to provide the support for the National Summit on Crime Reduction and Public Safety would cost over $349,930.93, the entire sum available for this task. Based on the Cost Proposal submitted by Booz Allen to support the work of the National Summit on Crime Reduction and Public Safety under Task 5.2 under the original Task Order, the funds required to provide the TTA will cost $349,930.93.
8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
None, no subsequent acquisitions are anticipated and areas currently identified are being provided for under this task order; if new areas are identified, a new competitive procurement will be conducted to fulfill any future requirements.
9. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.
