BRAND-NAME JUSTIFICATION
J&A Number: JA14-140
Upon the basis of the following justification, I, as the Procuring Activity Competition Advocate, hereby approve this brand-name justification for the proposed contractual action, pursuant to FAR 16.505(a)(4), as the particular brand name, product, or feature is essential to the Government’s requirements; and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
a. Requiring Agency:
United States (US) Army Program Manager (PM) Warfighter Information Network Tactical (WIN-T) program Software Engineering Center (SEC) 3200 Raritan Avenue Aberdeen Proving Ground, Maryland 21005-1850
b. Contracting Office:
DISA/DITCO/PL8321
2300 East Drive Scott Air Force Base, Illinois 62225-5406
2. NATURE/DESCRIPTION OF ACTION(S):
a. The nature of this action is to procure brand name, commercial off-the-shelf (COTS) Cisco UCSS support for the US Army PM WIN-T program. This acquisition will perpetuate previous coverage under a direct Cisco sales order issued by the Army from September 1, 2011 through August 31, 2014. This procurement will be awarded as a firm-fixed-price delivery order to an
Cisco Software Subscription Renewal-JA14-140 authorized reseller of Cisco, the original equipment manufacturer, against an Information Technology Enterprise Solutions 2-Hardware (ITES-2H), an Indefinite Delivery/Indefinite Quantity contract valid until June 23, 2015.
b. The period of performance will be the date of award though August 31, 2015. Contractor will provide any updates/fixes that may have occurred during the lapse in coverage. Fiscal year 2014 Operation and Maintenance Army funds have been provided for this procurement. The applicable North American Industry Classification System code is 541519, Other Computer- Related Services, with a sales size standard of $27.5 million.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The objective of this contracting effort is to procure brand-name Cisco COTS UCSS, which provides the user with the latest software updates and releases as well as online tools and communities that help the users to solve issues quickly. The subscription is used to support the lab environment and to maintain battlefield communications systems. The subscription provides the users with up-to-date, capable, secure software and hardware readiness. The software updates provide the Army the capabilities to perform Post-Deployment Software Support/Post- Production Software Support on behalf of Product Manager WIN-T Increment 1 with quarterly software releases to update WIN-T Increment 1 communications material with Information Assurance Vulnerability Alert patches and service updates. The required description consists of Cisco Unified Communications Manager Enhanced Single User-Under 1000 (1K) software subscription, part number LIC-CUCM-USR-A, to provide support for 3856 subscriptions, for a total of 192,800 users.
4. SUPPORTING RATIONALE FOR BRAND-NAME JUSTIFICATION:
a. This acquisition requires the purchase of brand-name Cisco UCSS for the Cisco Unified Communications Manager Enhanced Single User-Under 1K software licenses for the warfighter.
The Cisco Call Manager is a portion of the Warfighter Information Network Increment 1 Lot 10 baseline that was selected for use during the discovery portion of the acquisition process in 2010.
There are a total of 3856 subscriptions of Cisco Call Manager deployed throughout the world that require the Cisco UCSS in order to remain current on the vital software and security patches.
Cisco UCSS is only available from Cisco or their authorized resellers. Cisco owns the copyrighted software with all legal rights, privileges, and ownership contained therein. No other contractors or distributors can legally obtain access to the software nor make duplicate copies since copyrights and patent laws protect this Cisco software. The software maintained through this purchase is an integral part of the Army mission.
b. Cisco Unified Communications software licenses and support formerly acquired by the Army in 2011 were used to develop in-house applications, integrating the Cisco COTS software products into the existing Cisco application systems. The failure to maintain the system would cause vulnerabilities in the communication of the warfighter and lead to the potential leakage of vital and secret information. Not only are the Cisco Unified Communications software products an integral part of the Army mission, but the Army has been supporting the Cisco infrastructure since it was developed in 2001. In order to replace the Cisco Unified Communications software, Page 2 of 3 Pages
Cisco Software Subscription Renewal-JA14-140 the entire Army infrastructure would require re-standardization because no other brand of software is compatible with the current Cisco infrastructure. Replacing the existing Army infrastructure with a different brand-name product would result in loss of function and performance, creating obstacles and interruptions in essential mission support. Consequences of obtaining replacement software products from other sources would include massive software conversions, resulting in additional costs and unnecessary standstills for the Army users. The Army has already invested substantial man-hours and technical support resources to develop the current environment that relies on Cisco technology and products including, but not limited to, Cisco routers, switches, firewalls, and access points, organized to support the Army and their mission. There would be additional costs to convert the uniquely created programs, engineer a cross-platform integration method (to remain compatible with Cisco as well as other database products), test the new solution, and re-train the directorate’s employees in the use of software with entirely different structure and format.
c. The required Cisco Unified Communications software is licensed solely to Cisco, and the UCSS is required to maintain proper security. To duplicate another functional replacement initiative through full and open competition is not in the best interest of the government at this time. As referenced above, it is not economically feasible to deviate from the currently installed proprietary Cisco brand-name software, as only Cisco brand-name software is suitable for this requirement.
5. COST/PRICE FAIR AND REASONABLE DETERMINATION:
The products are being procured through an ITES-2H contract, a contract vehicle specifically designed as the primary source of information technology equipment/products to support the Army enterprise infrastructure. All of the products to be purchased have been verified to be on the ITES-2H contract. Even though rates have been established on the ITES contract and are considered fair and reasonable in accordance with FAR Part16.505, the contracting officer will determine whether the anticipated costs are fair and reasonable based on the comparison of quotes received from ITES responses, historical pricing, and/or the Independent Government Cost Estimate. A determination will be made by the contracting officer that the order represents the best value to the government. Additional discounts will be sought prior to placing an order.
