Sole Source Justification for 2SLS FM9 Okaya Trial
This is a Memorandum for Record documenting a sole source justification for a new, firm-fixed-price purchase order for a commercial, brand-name product. The United States Space Force, Space Launch Delta 30 is procuring a three-month Okaya Feasibility Study Trial from SmarTec Inc.
The requirement derives from prior SBIR Phase I (FA864921P0971) and Phase II/D2P2 (FA864924P0008) awards. The Okaya platform and SBIR-developed methodology are proprietary to SmarTec and protected by SBIR/STTR nondisclosure requirements (DFARS 252.227-7018). SmarTec is identified as the only source possessing the requisite technology, data rights, and unvalidated platform. The sole source justification cites RFO Part 6.103-1 and FAR 8.405-6(a)(1)(i)(B), establishing that only SmarTec possesses the unique and specialized software nature necessary to meet the Government's requirements. The contractor holds proprietary design authority for the Okaya Trial and is the only vendor authorized to provide replacement parts meeting Government needs without incurring unacceptable mission delays and reverse engineering costs. Christopher Hummel, GS-12, USAF Contracting Officer PKB, certified the anticipated cost as fair and reasonable and that the justification is accurate and complete. The memorandum is digitally signed and dated July 8, 2026.
