About this file
This is a Memorandum for Record – Limiting Competition document for a sole-source pool maintenance contract awarded by the U.S. Army Mission and Installation Contracting Command (MICC) at Joint Base Lewis McChord (JBLM), Washington. The Directorate of Public Works is procuring one-time repair services for Keeler Pool through a firm-fixed price purchase order (W911S8-25-P-#s%) with USA Pools of Florida, located at 1480 Woodstock Road, Roswell, Georgia 30075-2130. The contract is valued at an unspecified total amount (pricing details are redacted) and covers replacement of sand filter tanks and filter media, circulation pump, BECSys chemical controller, bleach washing, expansion joint replacement, main drain grates replacement, and tile and grout replacement. The period of performance runs from September 15, 2025 through November 30, 2025, with an anticipated award date of August 22, 2025. Fiscal year 2025 Operations and Maintenance funds will support the contract.
The procurement is justified under FAR 13.106-1(b)(1) as a sole-source acquisition below the Simplified Acquisition Threshold due to urgent operational need and contractual limitations. The current contractor, United Pools Maintenance LLC, holds existing contract W911S823C0016 (awarded September 8, 2023 as a small business set-aside) but cannot absorb these repairs within existing funding constraints. The justification cites urgent military training requirements dependent on pool operability, including SCUBA certification for deployment, coupled with historical difficulty obtaining qualified contractors and price volatility. An Independent Government Cost Estimate was developed using publicly available Grainger.com pricing to establish fair and reasonable costs. Market research was waived citing unusual and compelling urgency. No public synopsis is required due to the dollar threshold and operational readiness exception. The Contracting Officer certified fair and reasonable pricing based on the IGCE, with technical certification provided by John Wao, Project Manager, and approval by Jason McCormick, Contracting Officer, both digitally signed on August 21, 2025.

4. Authority:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
a. JBLM requires immediate repairs to its pool facilities. The related contract (W911S823C0016, awarded 2023) is ongoing, but the scope of work exceeds the existing over and above CLIN limit. The current contractor of W911S823C0016 is willing and capable of performing the repairs but is contractually restricted due to funding limitations within the existing contract. The IGCE for this requirement was developed prior to seeking a quote from the contractor. We confirmed the materials and their prices using Grainger.com, which is a publicly available catalog for business and industrial supplies. The pricing was deemed fair and reasonable as the maintenance needed requires putting in new components that have failed or are already failing. Historically, the acquisition has been fraught with problems getting contractors able and willing to meet the requirement.
b. Based on the urgency to get Soldiers back to training to meet their mission, a
Justification and Approval was signed pursuant to FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization. Based on the data herein, full and open competition is not recommended at this time due to the urgent need, contractual limitations, and the history of price volatility and technical bid acceptability issues. The KO has determined that a sole source requirement to the current contractor leverages existing performance, minimizes delays, and ensures faster project completion.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at FAR 5.202, the current closure of the pool negatively affects the Army's ability to maintain the required operational readiness levels, with the inability for SCUBA certification for deployment.
