SIMPLIFIED ACQUISITON PROCEDURES (SAP)
Justification for Urgent Acquisitions Over $3,500 But Not Exceeding the Simplified Acquisition Threshold
URGENT REQUESTS ARE FOR SUPPLIES OR SERVICES THAT WILL RESULT IN WORK STOPPAGE OR ARE MISSION ESSENTIAL AND NORMAL PROCESSING TIMES WILL RESULT IN INJURY TO THE GOVERNMENT. THIS JUSTIFICATION MUST BE SUPPORTED BY THE REQUESTOR. THE REQUEST MUST DESCRIBE THE COMPELLING NATURE OF THE URGENCY, HOW THE GOVERNMENT WILL BE SERIOUSLY INJURED AND WHAT THE FINANCIAL IMPLICATIONS MIGHT BE. STATEMENTS SUCH AS "EMPLOYEES WILL BE SENT HOME" OR "THE LINE WILL GO DOWN" ARE INADEQUATE TO SUPPORT AN URGENT PURCHASE. THE CUSTOMER SHALL PROVIDE THE
FOLLOWING INFORMATION:
1. PURCHASE REQUEST OR REQUISITION NUMBER
Remote Actuating Headworks Valve
2. PROJECT/TASK NUMBER 3. ESTIMATED AMOUNT
4. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE.
Gate and actuator are to be used to control the flow of influent to the sewer plant. It is also to be used in the time of emergency to prevent contamination from reaching the plant by diverting flow to the flow equalization basin (lagoon).
In the time of emergency the gate will need to be remotely operated from the control room located at the water plant.
5. PROVIDE EXPLANATION, DATA, ESTIMATED COSTS OR OTHER RATIONALE AS TO THE NATURE AND EXTENT OF HARM THE
GOVERNMENT WILL EXPERIENCE, FINANCIAL OR OTHERS, IF THE AWARD WERE DELAYED.
MCAAP exceeded Sewer Treatment Plant (STP) fecal coliform effluent limitation in 2019, 2020, and 2021. MCAAP received Notice of Violation No. I-61000110-21-1 and subsequent Consent Order, Memorandum of Understanding Case No. 22-023 as a result of these exceedances. The installation of a remote actuating valve at the STP head-works would give influent flow control and allow for the diversion of high flow to the STP flow equalization basin and keep flow into the STP at a constant and reasonable flow rate that can be properly treated by the plant and prevent effluent limitation exceedances in the future.
6. PROVIDE THE REQUIRED DELIVERY SCHEDULE AND MANUFACTURING LEAD-TIME INVOLVED.
7. PLEASE PROVIDE THE DATE THE REQUIREMENT WAS FIRST KNOWN TO EXIST.
The first fecal coliform effluent limitation exceedance occurred July 2019 and continued through 2021. Effluent limitation exceedances are expected to continue if the STP influent flow cannot be properly regulated.
8. PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO
COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.
It will become too costly and detrimental to public health and the environment if the STP influent flow rate cannot be controlled to prevent the release of contamination/inadequately treated wastewater from entering the receiving stream, Bull Creek. Bull Creek is a tributary to receiving stream, Peaceable Creek, a public water supply.
