These goals are applicable to all the Contractor's construction work (whether or not it is Federal or federally assisted) performed in the covered area. If the Contractor performs construction work in a geographical area located outside of New York State, it shall apply the goals established for the geographical area where the work is actually performed. With regard to this second area, the Contractor is subject to the goals for both its federally involved and non-federally involved construction.
The Contractor's compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a), and its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, the Executive Order and the regulations in 41 CFR Part 60-4. Compliance with the goals will be measured against the total work hours performed.
3. The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. 4. As used in this Notice, and in the contract resulting from this solicitation, the “covered area” is described on the Project Title Sheet located in the Contract Proposal.

NYSDOT ELECTRONIC BIDDING
AASHTOWARE PROJECT BIDS AND BID EXPRESS
ELECTRONIC BIDDING RESOURCES:
• PROJECT BIDS - Project Bids allows bidders to receive electronic proposal bid item information from the Department's web site and Bid Express to produce an electronic bid.
Project Bids is provided free of charge and can be used on almost any Windows-compatible PC.
Benefits may include:
o Project Bids computes item and overall bid totals as estimators work through the list, and alerts estimators if an item is accidentally omitted.
o Electronic files of item bid data will be posted to the NYSDOT website and Bid Express to coincide with advertising and contract document publication dates.
o When an amended item bid data is downloaded, recognition of changes is automatic.
o Electronic bids are processed faster than paper bids, decreasing the time needed for verification of bids by NYSDOT.
• BID EXPRESS - Bid Express allows secure, encrypted bid submittal over the internet. It integrates with Project Bids and includes electronic bid bond verification. Bid Express is a fee-based service.
Benefits may include:
o Real-time bid submittal from any location.
o No concerns about driving bids to Albany or mail services arriving after the deadline.
o The ability to submit a "safety bid" early while continuing to solicit better quotes from subs and suppliers and to overwrite the safety bid with a new bid right up to the submission deadline.
o As data accumulates on Bid Express, there is the ability to search and analyze bids on prior contracts for specific work items, and/or by specific competitors, etc.
o The ability to solicit and receive quotes from subcontractors through the Small Business Network on Bid Express.
o Contractors who use Bid Express do not submit a paper bid.
ALL ELECTRONIC BIDDERS SHOULD:
• Enter prices for all bid items in the Schedule of Items.
• Enter DBE Participation Package and upload required documents (Federal-Aid contracts).
• Enter days for the B portion(s) of A + B bids on the A+B Days tab (if applicable).
• Enter the required info in the JURAT and Disclosure of Lobbying Activity folders.
• Complete the Contract Document Bid-Ability Survey (optional).
• Enter the required info in the Bid Bond folder if submitting a bid through Bid Express and click
Verify to verify the bid bond.
All bids submitted through Bid Express should be 100% complete as noted at the top of the page and all required tabs marked with a green check showing completion. Submitting a bid that is less than 100% complete through Bid Express could lead to the bid being declared informal.
D26585330
0850 2 of 2 Per Contract Management L05/01/25
FIRST TIME ELECTRONIC BIDDERS SHOULD:
• Allow at least seven business days to obtain a digital ID and password for bidding through Bid Express.
• Follow the procedures in "Download AASHTOWare Project Bids", which are posted at http://www.dot.ny.gov/bids-and-lettings/construction-contractors/electronic-bid-system
• Enter the Agency as NYSDOT.
• Use the appropriate Federal-ID and firm name. Federal-ID must be in the format 12-3456789.
Joint ventures must create a new digital ID. Joint ventures must also send evidence of the authority of the agent or attorney-in-fact for the joint venturers to act on behalf of all joint venturers to the Office of Contract Management prior to the Letting.
PAPER BID DOCUMENTS:
• NYSDOT recommends and encourages contractors to bid electronically with Bid Express because of its many advantages, but contractors are not required to bid electronically.
• If NYSDOT receives both a Bid Express bid and a paper bid from the same contractor, the Bid Express bid will prevail.
• Bidders who do not use Bid Express are encouraged to submit an electronic bid file on a flash drive with their paper bid.
• NYSDOT will not accept electronic bids on any media without a paper bid.
• If there is any discrepancy between an electronic file submitted with the paper bid and the paper bid, the paper bid will prevail.
• When submitting an electronic bid file with your paper bid, include only one .EBSX (Project
Bids) file on the flash drive. This should be the only file on the flash drive.
AMENDMENTS:
Contractors are solely responsible for recognizing and responding to changes by amendment. Not all amendments will involve changes to item bid data, however, if an amendment involves changes to item bid data, an amended Project Bids file will be posted to the Department's website and to Bid Express. This file must be applied to your electronic bid.
If there is any discrepancy in the itemized proposals published in paper and electronic formats, in either the contract pay items or quantities, the Department will evaluate the bids based only on that portion that is common to all formats. For example, if an item is missing from any format, the bids will be evaluated excluding that item and if item quantities are different in any format, the bids will be evaluated using the lowest item quantity.
Please notify the Department through the Contract Documents/Contact Us tab for that project, located at https://www.dot.ny.gov/portal/page/portal/doing-business/opportunities/const-notices, if you find any such discrepancies.
FOR ASSISTANCE:
• NYSDOT 518-457-2124 or 518-457-3583
• Bid Express Help Desk (888) 352-2439 or (352) 381-4888

In accordance with Standard Specification Section 105-05 VENDOR RESPONSIBILITY, “The
Contractor shall at all times during the contract term remain responsible.” Failure to maintain and provide responsibility documentation may result in non-payment or suspension of work.
A New York State Vendor Responsibility Questionnaire For-Profit Construction (CCA-2) is the primary tool used to perform this review. An approved CCA-2 must be on file with
NYSDOT to be considered for the award of a contract or for the approval of a subcontract. An approved CCA-2 covers NYSDOT work for one calendar year.
Forms are available at: http://osc.state.ny.us/vendrep/forms_vendor.htm#Construction.
Firms may file either electronically through the OSC site or can print out the CCA-2, and mail a signed and notarized original copy to:
New York State Department of Transportation
Contract Management
50 Wolf Road, 1st Floor, Suite 1CM
Albany, NY 12232
Whichever method of submission is selected, the Contractor must complete and include
Attachments A, B and C. Further information can be found at: https://www.dot.ny.gov/bids-and-lettings/construction-contractors/general-info.
Please note if you file online through the OSC site, a responsibility review must still be completed by NYSDOT before work can start. Therefore, once certified on-line, you must notify NYSDOT via email at VendorResponsibility@dot.ny.gov which will initiate the review process. If you file online and do not notify NYSDOT within 3 months, it may be necessary for you to resubmit and recertify, restarting the process.
If you are not currently performing work for NYSDOT but anticipate bidding or subcontracting during the next 12 months, you should complete and submit a CCA-2. Please do not wait until you are scheduled to work on a project.
Questions may be sent to VendorResponsibility@dot.ny.gov.

USE OF WORK ZONE CAMERAS
Camera setup in each work zone is subject to the nature of the work and available locations which do not pose a hazard or conflict with the safe operation of proposed work and equipment. Cameras and associated equipment should not be placed in an area where they could be struck by traffic or moving equipment, or where they pose sight distance restrictions or other safety concerns.
Cameras should be positioned to have full view of traffic activity within the work zone and will be used primarily to record video of flaggers (or other traffic controlling devices) and traffic entering and exiting the work zone. The location of the camera installation is to be recommended by the contractor and approved by the Engineer for each camera setup. Additionally:
• Mount cameras on a stationary base so the recorded video produces a clear and consistent image.
•A minimum of two (2) cameras shall be used at each work zone and positioned so that one camera captures a direct view of vehicles entering the work zone and the other camera captures a direct view of vehicles departing the work zone.
• Direct cameras toward the approach and flagger station if one exists.
• Direct at least one camera toward the work crew when they are working adjacent to live traffic and no positive protection is provided.
General Requirements for the use of Work Zone Cameras:
1) “WORK ZONE CAMERA” sign shall be placed within the advance warning sign setup according to the details shown in the contract documents. Sign size shall be in accordance with the MUTCD for warning signs for the applicable roadway type.
2) Work Zone Cameras are not to be used as a substitute for any other safety device or work zone requirement.
3) All video and audio recordings shall be the property of the State of New York and shall not be used for any purpose outside those deemed acceptable by the State.
4) If there is any work zone intrusion, hostile encounter, or event where law enforcement is called, the Engineer and the Regional Construction Safety Coordinator shall be immediately notified. The contractor will transfer the video to the Engineer or another NYSDOT representative. The contractor will then immediately replace the removable video storage device, if applicable, with a new device and turn on the camera again. NYSDOT staff shall prepare and submit a Construction Incident
Report through the Department’s current incident reporting software and attach any relevant documentation inclusive of video, photo, and/or witness statements.

AUTOMATED WORK ZONE SPEED ENFORCEMENT (AWZSE)
The Contractor is hereby notified that the Department may elect to deploy an automated speed enforcement unit at certain times during the project. Project locations that qualify for the deployment of automated speed unit must meet the following criteria:
• Limited Access Highways only
• No mobile work zones
• Workers must be present
The automated unit may consist of a trailer mounted unit, a free-standing unit, or one contained within a work vehicle. The unit will be deployed and operated by a private vendor under the direction of the Department and the Engineer. The “Speed Photo Enforcement Warning Sign” will be provided by the AWZSE vendor. If necessary, the contractor shall provide a temporary regulatory speed limit sign within half mile ahead of the start of the work zone. The cost of this extra sign shall be included as part of the Basic Work Zone Traffic Control item.
The contractor shall coordinate with the Engineer and the speed enforcement vendor to find a safe location for the unit within the work zone that does not interfere with on-going work. The vendor will set up and take down/remove their unit and sign(s) each day they are deployed.

ENVIRONMENTAL PRODUCT DECLARATIONS (EPDs)
EB 26-022 Page 1 of 2 L 09/01/2026
Projects must comply with all applicable New York State (NYS) laws and policies to reduce the embodied carbon of buildings and infrastructure projects. This includes:
▪ New York State Executive Order 22 (2022) o Executive Order 22 Embodied Carbon Guidance (2025 or current version)
▪ Buy Clean Concrete guidelines (2023 or current version) pursuant to State Finance Law § 136-d.
These laws and policies require entities subject to their application to disclose the embodied carbon that will result from construction projects utilizing specified construction materials, and to procure low-embodied carbon concrete on certain contracts. To comply with these requirements, NYSDOT is requiring Contractors to submit
EPDs for certain building and construction materials supplied to NYSDOT contracts. EPDs must be Product-specific, Facility-specific, or Supply chain-specific, Type III (Third Party Reviewed), in adherence with ISO
14025 Environmental Labels and Declarations, ISO 14044 Environmental Management – Life Cycle
Assessment, and ISO 21930 Core Rules for Environmental Product Declarations of Construction Products and
Services. Industry-wide EPDs are not acceptable.
For permanently incorporated construction materials manufactured for, and supplied to state construction projects, the Contractor shall obtain and submit EPDs for asphalt mixtures, concrete mixtures (excluding precast concrete), and steel, when certain thresholds are met. The Embodied Carbon Guidance document identifies the covered construction materials and quantity thresholds, which are summarized for NYSDOT projects below.
When the quantity of any covered materials supplied to the project meets or exceeds the quantity thresholds listed below, EPDs for those materials must be submitted to the Department.
▪ Asphalt Mixtures 8,000 Tons (per individual mix design)
▪ Concrete Mixtures 200 Cubic Yards (per individual mix design) *
▪ Steel Category * o Rebar - 20,000 lbs o Hollow Structural Sections - 15,000 lbs o Fabricated Steel Plate - 15,000 lbs o Hot Rolled Sections - 15,000 lbs o Cold-Formed & Galvanized - 15,000 lbs
* When multiple covered materials are included in a single pay item, each covered material quantity is counted separately. For example, a single pay item for steel-reinforced concrete includes both concrete and steel, and each material quantity is tracked individually. If the concrete amount meets the requirements for an EPD, but the steel amount does not, a concrete EPD is required but a steel EPD is not.
One goal of Executive Order 22 (EO-22) is to reduce the embodied carbon content of common construction materials. Since it is the Contractor’s responsibility to select material suppliers, and since different suppliers may provide similar materials but produced in different locations using different equipment, the quantity thresholds established in EO-22 Embodied Carbon Guidance must be determined by individual mix design or steel material category and supplier. If one mix design or steel category is used for multiple different pay items within a contract, the total quantity of that specific mix design or steel category supplied to the project (summed across all pay items) is counted. Conversely, if multiple different mix designs are installed for the same pay item (for example, a multi-location paving project supplied by multiple different local asphalt plants), an EPD is only required for the mix designs that meet or exceed 8,000 tons for the contract.
The Buy Clean Concrete Guidelines require transportation construction projects with contract values at award
